07-10387 Zone Oakdale Addition(Published in the Salina Journal on May ' , 2007) ORDINANCE NUMBER 07-10387 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE z REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE W PROPER USES THEREOF AND AMENDING THE COMPREHENSIVE PLAN. ro WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -I". PLANNED RESTRICTED BUSINESS DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots Three (3) through Seven (7) in Block Seven (7) of the Oakdale Addition to the City of Salina, Saline County, Kansas shall become a part of District "PC -I ". PLANNED RESTRICTED BUSINESS. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the PLANNED RESTRICTED BUSINESS DISTRICT. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. Permitted uses on Lots Three (3) — Seven (7) shall be limited to business, professional, and medical offices and single-family and two-family dwellings and shall be subject to the bulk and use limitations of the C-1 district. 2. Signage shall comply with the regulations governing the C-1 district. 3. The dwellings on Lots Three (3) and Four (4) shall not be sold off separately without arrangements being made to provide off-street parking for residents. 4. The project shall be completed in substantial conformance with the approved site development plan, building elevations and parking lot plan which are hereby incorporated by reference. 5. The 20 ft. alley adjacent to Lots Three (3) — Seven (7) shall be paved in accordance with city standards as part of the parking lot construction. 6. A detailed landscape plan for the area between the expanded parking lot and Oakdale Avenue showing the location, type and size of proposed plantings shall be submitted for review and approval prior to issuance of a building permit. 7. A building permit for this project shall be obtained within 18 months of site plan approval. Section 3. That all prior ordinances in conflict herewith as it relates to the above described real estate are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
