WHEREAS, under the provisions of Ordinance No. 1730, the mayor and council decided to build and construct certain sewer in the city of Salina, in said ordinance described; and, WHEREAS, proposals for the construction of such sewer have been filed with the city clerk, and such proposals have been examined by the mayor and council, and the proposal or bid of Otto Peterson of Salina, Kansas, is hereby found and determined to be the lowest and most responsible bid for the building and construction of such sewer, and such bid or proposal of said successful bidder aforesaid does not exceed in amount the estimated cost of building and constructing such sewer as heretofore made by the city engineer of said city and now on file with the city clerk; therefore, Be it ordained by the mayor and councilmen of the city of Salina: Section 1. That a contract be and is hereby let to Otto Peterson of Salina, for the building.and construction of the said sewer provided for and descr$bed in said Ordinance No. 1730, to -wit: a thirty-six (36) inch Monolithic Concrete sewer, commencing at the present terminus of the Ash street or Main sewer of said city, at the Smoky Hill River where the same intersects with or near to Front Street, to a point in said Smoky Hill river just east of Ohio street at the eastern end of Ash street, the ap- proximate length of said sewer being (3100) feet, including all manholes and other work specified in said specifications; at and for the prices given and specified in the said proposal of said Otto Peterson, this day filed with the city clerk, and not exceeding the tutall'sum of (413160.00), which said bid of proposal is hercb;y specially rel cx-red to 04id wade a sari, of this ordinance in all respects as if tree same were -written out in full herein. Sec. 2. That such sewer and all work connected therewith and embraced in and covered by said Ordinance No. 1730 and hereby let to said successful bidder shall be done in accordance with the city engineer's specifications mentioned and referred to.in said Ordinance No. 1730, which said specifi- cations are hereby also made a part of this ordinance by special reference to the same. 3. In payment of the cost of the work and improvement hereby let, the mayoend council shall issue installment improvement bonds, as provided in said Or nce No. 1730, which bonds may, at the option of the mayor and council, i�ni proper amount, be delivered to said Otto Peter son in payment of the contract he-*1%eby let; and said successful bidder shall execute a written contract with t said city of Salina embodying the provisions of this ordinance and said Ordi nce No. 1730 and of the said specifications aforesaid, and execute in favor said city the nec- `�essary bonds specified and required in said specifications d as required by the laws of the State of Kansas. To the City Council, Salina, Kansas: Gentlemen:— I herewith respectfully return to you with my veto and disapproval Ordinance No./ —, being an ordinance letting the contract for the extensio. of the Ash street sewer, for the reasons that, in my judgment, it will be unwise to expend the necessary amount, of money for which such a contract will call to build a sewer over the line suggest -ad and described in said ordinance, since that that part of such sewer as crosses the Smoky Hill river will at all times be in danger of being washed out, and the expense necessary to be expended from time to time in replacing such river crossing will in time amount to as much as the difference in expense that it would cost at this time to run the proposed sewer by the northern route. heretofore sug- gested and recor_vnanded by the city engineer; and that -at the end of a few years the connection between the two sides of the river will be carried or washe,,�-d away by high water and. drift' in the river and xmax l ing abandoned and some three thousand feet of sewer pipe will eAunder the ground east of the river, unfit for use and abandoned,xmi representing a useless waste of the people's moneir.
