1730 Sewer ExtensionTPA Y 1 1 1 1 31 ORD- I-NAN-CE N0._1130- An ordinance providing for the extension of the main or Ash Street sew er in the City of Salina, Kansas and providing for the manner of construct- ion and for the payment of the cost thereof. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. It is hereby ordered thatthe main or Ash Street sewer in the.City.o:r Salina shall be extended from its present terminus at the Smoky Hill.River, where the same intersects with or near to Front Street, east on said Ash Street, to a point in said Smoky Hill River just east of Ohio Street at the eatern end of said Ash Street; and such extension shall be construct- ed as -herein provided. Section 2. The plans and specifications for such sewer extension and of the construction of the same,,made and prepared by the City Engineer of said city and now on file with the City Clerk, are hereby adopted and ap- proved as and for the plans and specifications for such work and improvement , and the same and every part thereof are hereby made a part of this ordinance in all respects as if the same were written out in full herein, and all the work and improvement specified and described in said plans and specifications shall be done and performed in strict compliance with such plans and speci- fications and under the direction of said City Engineer aforesaid. Section 3. After the passage, approval,by the Mayor or disapproval and veto by the mayor and passage over such veto, and publication of this ordinance the ciVy clerk shall advertise for bids for the construction of the improvement provided for in this ordinance. Such advertisement shall be printed in such paper or papers as the mayor and council may direct, and shall be printed for a period of thirty (30) days; and such advertisement shall state the time when such bids shall be received and opened, which shall be November 24, 1913; and upon the receipt and opening of such bids the mayer and council may, and are hereby authorized to let the contract for the con- struction of such sewer extension to the most satisfactory and responsible bidder, as determined by the said mayor and council may reject any and all of such bids so received and re -advertise for other bids for such work and improvement. Section 4. The cost and expense of constructing such sewer shall, be assessed against all lots and pieces of ground contained in the City of Salina as a sewer district, as provided by Ordinance No. 613 of the printed ordinan- ces of said city, passed and approved December 23, 1887, and the mayor and council are hereby authorized to provide for the payment of the cost thereof by installments, instead of levying the entire tax or special assessment at one time, and for such installments the mayor and council are hereby author- ized to issue improvement bonds of the City of Salina, payable in install - merits of equal amounts each year, none of which bonds or the installments 3�2 thereof shall run longer than ten (10) years, or bear interest exceeding five (5),per cent per annum. Such bonds may be issued to the contractor or con- tractors constructing such improvement in payment thereof, or the mayor and council may sell said bonds, at not less than their par value, and pay the proceeds thereof to such contractor or contractors, and such bonds shall be of such deniminations as the mayor.and council may determine. And for the pur- pose of paying principal and interest on said bonds as they severally become due, the mayor and council shall each year, during the life of said bonds, levy an assessment against all taxable read: estate in said city at the assesse value thereof for general revenue purposes in an amount sufficient to pay the ,principal and interest for that year, and the city clerk shall certify such assessments as they severally made to the county clerk of Saline County, -Kan- sas, at the same time and in the same manner as other city taxes are certi- fied. October- 20, 1913.,- TO 913.• TO THE COUNCIL: I herewith return with my disapproval, Ordinance No. 1730, en- titled, " An Ordinance providing for the extension of the main or Ash St, sewer in the City of Salina, Kansas, and providing for the manner of con- struction and for the 'payment of the cost thereof. It seems to me that error was made in -the original construction of the sevrer in Salina, Kansas, in that it did not extend.further north, and enter the river on or about North Street at the extreme north bend of the river, and to carry the sewer east of Ash St. makes it necessary to cross the river, and seems to me not to be the feasible and correct outlet. If the sewer should be constructed simply across to the first bend of the river it would leave the sewer problem unsolved, and at that point it 'is entirely. too. close tothe city for the construction of septic tanks, as in my judgment and from the best information that I can get, I am satisfied that no septic tanks solution should be installed closer than one mile from the present out-skihts of the City of Salina. I believe error would be commit°ted in extending the sewer across the river form 1 g&, any obstruction in the river. For the above reasons I hereby veto the above described ®rdin- ante.
