ORDINANCE NO. 2727

An ordinance specifying and selecting.the paving material
to be used and letting a contract for the curbing,
guttering, excavating and grading.and paving of
111" , STRJ'ET in the City of Salina, Yansas ,from the
-- north line of Bond 'z3treet to the south -line of
'Wilson Street in said City.

Section 1. That it is hereby determined that. NINTH
STREET in the City of Salina, 1,ansas frons .the north line .
of Bond Street to the south line of Wilson Street in said
City shall be paved with'one.course vitrified.vertieal fiber
plain wire cut brick, not less than three (3) inches deep
with asphalt filler laid on a foundation -five (5) inches
in depth of'Portland Cement Concrete base with one (1)
inch sand cushion, such pavement within the limits above
defined to be thirty-three.(33) feet.in.width excluding
rcurb and gutter.
Section 2. That it is hereby determined that NINTH
STREET in the City of Salina, Kansas from the north line
of Bond Street to the south line of Wilson Street in said
City shall be curbed and. guttered with one piece combina-
tion cement curb and gutter, said combined curb and gutter
shall be.eomprised of a curb six (6) inches thick at the
top and six and one' -half (64) inches thick at the throat,
with gutter twenty-four (24) inches wide, six (6) inches
thick at the throat and seven (7) inches thick next to
the pavement.
Section 3. All excavating, filling and rolling
necessary for the proper construction of such improvements
shall be done and all of such improvements shall be made
and done in strict conformity to and in compliance with
the plans and specifications heretofore made by the City
Engineer of Salina, Kansas andnowr on file with the City
Clerk of said City, which said plans and specifications are
hereby incorporated in and made a part hereof in all re-
spects as fully and completely as though written out at
length herein; which plans and specifications are hereby
adopted as and' for the ,plans and specifications of s. eh
work and improvements.

Section 4. That a contract is hereby awarded to
M. R. Amerman for -the paving, curbing,. guttering, ex-
cavating and filling the above mentioned street in the
limits aforesaid'with the materials hereinbefore speci-
fied, for the paving actually laid and put'in place, for
the labor actually performed and the materials actually
..furnished at the following prices: For excavating and
grading seventy cents (70�) per cubic yard; for Port-
land Cement Concrete combined curb and gutter eighty
cents. (60�) per linear foot and for paving actually
laid and put. in place Three and 18/100 Dollars ($3.18)
per square yard. All of said work shall be paid for
according to the measurement made by.the City Engineer of
the City of Salina. it is hereby determined and found
that the prices to be paid for the improvements as afore-
said is less than the -estimated prices of each and all
of said improvements as now on file with the City Clerk
of said City of Salina, Kansas.
. Section 5. Such contract is awarded upon the
express condition that such work and improvements shall
be done in strict accordance with and'in compliance with
the plans and specifications of the City Engineer therefor
which plans and specifications are hereby made a part of
this ordinance and of the contract,awarded, and upon
further conditions among others that M. H. Amerman, to
whom said contract is awarded shall furnish to the City
of Salina a surety company bond in the approximate sum of
the cost of such improvements, guaranteeing the prompt,,
proper and workmanlike construction of all the same, to•
gether wit!: a surety company bond guaranteeing such pave-
ment against all defects in material and workmanship :for
a period of five (5) ,years from the date of its completion
and acceptance by said City; and said contract is awarded
upon a further condition that said M. R. Amerman shall
furnish the City of Salina a good and sufficient surety
company bond guaranteeing said curb and gutter.against all

defects in material and workmanship for a period.of two
.(2) years from the date of its completion and acceptance
of such work by the City; together with a good and suffic-
ient surety company bond running to the State,of Kansas
in an amount approximately equal to the contract price of
said improvements and conditioned that said M, R. Amerman
shall pay -all indebtedness for labor and material in mak-
ing the improvements provided for herein.
Section 6. The Board of Commissioners of the City
of Salina are hereby authorized to make and enter into
on behalf of said City all written agreements necessary
in order to secure the construction of the improvements
herein provided for.
Section 7. This ordinance shall take effect and
be in full force from and after its Dublication once in
the official City paper..

An Ordinance specifying and selecting the paving material to
be used and letting a contract for the curbing, guttering,
excavating and grading and paving of NIN,.'H STREET in the
City of Salina, Kansas from the north line of Bond Street
to the south line of Wilson Street in said City.
BE IT ORD,INED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that NINTH STREET
in the City of Salina, Kansas from the north line of Bond Street
to the south line of Nilson Street in said City shall be paved
with one course vitrified vertical fiber plain wire out brick,
not less than three (3).inches deep, with asphalt filler laid on
a foundation five (5) inches in depth of Portland Cement Concrete
base with one (1) inch sand cushion, such pavement within the
