An Ordinance specifying and selecting the paving material to be
used and letting.a contract for the paving, excavating, curb-
ing and guttering of PENN AVENUE in the City.of Salina, Kansas
from the north line of Ash Street to.the.south line of Elm
Street in said City.
BE IT ORDAINM) by. the Board of.Commissioners of the City of Salina,
Kansas:
Section 1. That it is -hereby determined that PENN AVENUE in
the City of Salina, Kansas from the north line o:f..-_Ash. Street to the
south line of Elm Street in said -City shall be paved with one -course
vitrified vertic&l fiber plain wire cut brick,.not..l.ess than three
(3).inches deep, with asphalt filler laid.on a foundation five (5)
inches in depth of Portland Cement Concrete base.with one (1) inch
sand cushion, such pavement within the limits..above devined to be
thirty-three (33).feet in width excluding_curb and gutter.
Section 2. That it is hereby determined. that PENN AVENUE in
the City of Salina, Kansas from the north line,o.f Ash Street to the
south line of Elm Street in said City.shall be curbed and guttered
with one piece combination cement curb and gutter, said combined c
curb and gutter shall be comprised of a.eurb six (6) inches thick,
at the top and six and one-half (62) inches thick at the throat,
with gutter twenty-four (24) inches wide, six (6) inches thick at
the throat and seven (7) inches thick next to the pavement.
Section 3. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina, Y,_ansas and now on file with the City
Clerk of said City, which said plans and specifications are hereby
incorporated in and made a part hereof in ail respects as.fully and
completely as though written out at length herein, which plans and
specifications are hereby adopted as and for the plans and specifin -
cations of such work and improvements.
Section 4. That a contract is hereby awarded to M. R. Amer-
man for the paving, curbing and guttering, excavating and filling tYe
above mentioned street in the limits aforesaid with.the materials
hereinbefore specified for the paving actually laid and put in place,
for labor actually performed and ma&erials actually furnished at
the following prices: For excavating and grading seventy cents (700
per cubic yard; for Portland Cement Concrete combined curb and gutter
eighty cents (80�) per linear foot and for paving actually laid and
put in place Three and 18100 Dollars (:;3.18) per square ,yard. All

of said work shall be paid for according to the measurement made by
the City Engineer of the City of Salina. It...is hereby determined and
found that the prices to be paid for the improvements as -aforesaid is
less than the estimated prices of each and all of said improvements as
now on file with the City Clerk of said City of Salina, Y,ansas.
Section 5. Such contract is awarded upon the express condition
that such work and improvement shall be done in strict accordance with
and in compliance with the plans and specifications of the City Engineer
therefor, which plans and specifications are hereby made a part of this
ordinance and of the contract awarded, and upon further conditions among
others that M. R. Amerman to whom said contract .is awarded shall furnish
to the. City of Salina a surety company bond in the approximate sum of
the cost of such improvements, guaranteeing the..prompt, proper and work-
manlike construction of all the same, together with a.surety company
bond guaranteeing such pavement against all defects -in material and
workmanship for a period of five (5) years from.the date of its com-
pletion and acceptance by said City; and said contract is awarded upon
a further condition that said M. R. Amerman shall furnish the City of
Salina a good and sufficient surety company bond guaranteeing said
curb and gutter against -all defects in material and workmanship for a
period of two (2) years from the date of its completion and acceptance
of such work by the City; together with a good and sufficient surety
company bond running to the State of Kansas in an amount approximately
equal to the contract price of -said improvements and conditioned that
said M. R. Amerman shall pay all indebtedness for labor and materials
furnished in making the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina are
hereby authorized to make and enter into on behalf of said City all
written agreements necessary in order to secure the construction of
the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City paper.

actually furnished at the following'prices: For excavating and
grading seventy Bents (70�) per cubic yard; for Portland Cement
Concrete combined curb and gutter eighty cents (80¢) per linear
foot and for paving actually laid and put in place Three and 18100
Dollars ($3.18) per square yard. All of said work shall be paid
for according to the measurement made by the. City Engineer of the
City of Salina. It is hereby determined and found that the prices

mated prices of each and all of said improvements as now on file with
