An Ordinance specifying and selecting the paving material to be used
and letting a contract for the paving, excavating.,. curbing and
guttering of NINTH STREET in the City of Salina., Kansas from the
south line of Crawford Avenue.to the north line.of Bond Street
in said City.
BE 1T ORDAINhD by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby._determined that ninth Street in
the City of Salina, -Ansas from the south line of.Crawford Avenue to
.the north line of Bond Street in said City shall be paved with one
course vitrified vertical fiber plain wire cut bricl� not less than three
(3) inches deep with asphalt filler laid on a foundation five (5)
inches in depth of Portland Cement Concrete base with one (1) inch sand
cushion, such pavement within the limits above defined to be thirty-
three (33) feet in width excluding curb.and gutter.
Section 2. That it is hereby determined that.Ninth Street in
the City of Salina, t.ansas from the south line.of Crawford Avenue to
the north line of Bond Street in said City shall be curbed and guttered
with one piece combination cement curb.and gutter,.said combined curb
and gutter sh§Lll be comprised of a curb six.(6.) inches thick at the top
and six and one0half (62-) inches thick at the throat, with gutter twenty.
four (24) inches wide,.six (6) inches thick at the throat and seven (7).
inches thick next to the pavement.
Section 3. ,H11 excavating, filling and rolling necessary for the
proper construction of such iriprovements shall be done and all of such
improvements shall be made and done in strict conformity to and in
compliance with the plans and specifications heretofore made.by the City
Engineer of Salina, Eansas and now on file with the City Clerk of said
City, which said plans and specifications are hereby incorporated in
and made a part hereof in. all respects as fully and completely as though
written out at length herein; which plans Yadd specifications are hereby
adopted as and for the plans and specifications of such work and im-
provements.
Section 4. That a contract is hereby awarded to t'.'[ . R.Amerman
for the paving,, curbing and gut i_.ering, excavating and filling the above
mentioned street in the limits aforesaid with the materials hereinbefore
mentioned.for the paving actually laid and put in place, for the labor
actually performed and the materials actually furnished at the follow-
ing prices: For excavating and grading seventy cents (70�) per cubic
yard; for Portland Cement Concrete combined curb and gutter eighty cent--
(80�) per linear foot and for paving actually.laid and put in place

shall be paid for according to the measurement made by the City
Engineer of the City of Salina. It is hereby determined and found
that the prices to be paid for the improvements.as aforesaid is less
than the estimated prices of each and all of .said. improvements as
now on file with the City Clerk of the City.of.Salina, Kansaa.
Se ction 5. Such contract is awarded_upon.the express con-
dition that such work and iiprovements shall.be_.done. in strict acc-
ordance with and in compliance with the plans and specifications of
the City Engineer therefor, which plans and specifications are here-
by made a part of this ordinance and of the contract awarded and,.
upon further conditions among others that M. R. Amerman to whom said
contract is awarded shall furnish to the City of Salina a surety cow
pany bond guuarantee'ing the prompt, proper and workmanlike con
struction of all'the same, in the approximate sum of the cost of
such improvements, together with a surety company bond guaranteeing
such pavement against all defects in material and workmanship for
a period of five (5) years from date of its completion and accep-
tance by said City; and said contract is awarded upon a further con
dition that said Id. R. Amerman shall furnish the .City of Salina a
good and sufficient surety company bond guaranteeingsaid curb and

gutter against all defects in material and workmanship for period
of two (2) years from the date of its completion and acceptance of
such work by the City; together with a good and sufficient surety'
company bond running to the State of Kansas in an amount approximate-
ly equal to the contract price of said improvements and conditioned,
that said M. R. Amerman shall pay all indebtedness for labor and°
material furnished in making the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina
are hereby authorized to make and enter into on behalf of the City
all written agreements necessry in order to secure the construction
of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in official City paper.

ORDINANCE NO. � 72
An Ordinance specifying and selecting the paving material to

BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:

Section 4.. That a contract is hereby awarded to M. R.
Ammerman, for the paving, curbing and guttering, excavating and

filling the above mentioned street in the.limits aforesaid with
the materials hereinbefore specified, for the paving actually laid,
and put in place, for the labor actually performed and the materials
actually furnished at the following prices: For excavating and
grading seventy (701, cents per cubic yard; for Portland Cement
Concrete combined curb and gutter eighty cents (80¢) per linear
foot and for paving actually laid and put in place Three and 18/100
Dollars ($3.18) per square yard. All of said work shall be paid
for according to the measurement made by the City Engineer of the
City of Salina. It is hereby determined and found that the prices
