An Ordinance specifying and selecting the paving, material to be
used and letting,a contract for the paving, excavating,
curbing 'and guttering of JEt+aELL .AVENUE.. in the City of
Galina, tLansas from the west line of Santa Fe Avenue to
the east line of Ninth Street in said.City.
BE IT ORDAINED by the Board of Commissioners.of the City of Salina,
Kansas:
Section 1. That it is hereby determined that.JEWELL AVENUE
in the City of Salina, Kansas from the west.line of Santa Fe Avenue
to the east line of Ninth Street in said C.it.y shall be paved with
one -course vitrified vertical fiber_plain_wire..cut brick, not
less than three (3) inches.:deep, with asphalt filler laid on a
foundation five (5) inches in depth of.Portland Cement Concrete base
with one (1) inch sand cushion,, such pavement within the limits
above defined to be twenty-six.(26) feet in._width excluding curb
and gutter.
Section 2. That it is hereby determined that JEWELL AVENUE
in the City of Salina,`tLansas fr.om.the west line of Santa Fe Avenue
to the east line of Ninth Street in said City shall be curbed and
guttered with one piece coinbination cement curb and gutter, said
combined curb and gutter shall be comprised of a cirb (6) six inches
thick at the top and six and one-half (62) inches wide, six (6)
inches thick at the throat and seven (7) inches thick next to the
pavement.
Section 3. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict conformity
to and in compliance with the plans and specifications heretofore
made by the City Engineer.of Salina, R:ansas and now on file with the
City Clerk of said City, which said.plans and specifications are
hereby incorporated in and made a part hereof in all respects as
fully and completely as though written out.at length.herein; which
plans and specifications are hereby adopted as and for the plans and
specifications of such work and improvements.
Section 4. That a contract is hereby awarded to Ni. R. Amer-
man for the paving, curbing and guttering, excavating and filling the
above mentioned street in the limits aforesaid with the materials
hereinbefore specified, for the paving actually laid and put in
place, for the labor actually performed _and _the.materials actually
furnished as the following prices: For excavating and grading sevehty
cents (70�) per cubic ,yard; for Portland Cement Concrete combined
curb and gutter eighty cents (80�) per linear foot and for paving
actually laid and put in place Three and 18/100 Dollars 03.18)
-per, square ,yard. All of said work shall be paid for according to the
measurement made by the City Engineer of the.City of.Salina. It is
hereby determined and found_ that the prices..to.be paid ... for the improve.
ments as aforesaid is,less than the estimated prices. -of each and all
of said improvements as now on file with the City.,Clerk of the City
of Salina, nansas.
Section 5. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance with
and in -compliance with the plans and specifications -of -the -City Engineer
therefor, which plans and specifications are hereby made a part.of this
ordinance and of the contract awarded and upon fur.ther..conditions among
others that M. R. Amerman to whom said contract-ds.awarded shall furnisl
to the City of Salina a surety company bond in the approximate sum of
the cost of such improvements guaranteeing the prompt.,..proper and work
manlike construction of all the same together.with a.surety company bond
guaranteeing such pavement against all defects in-mate-rial and workman-
ship for a period of five (5) years from.the date of its completion
and acceptance by said City; and said contract is,awardedupon a further
condition that said M. R. Amerman shall.fur.nish the.City of Salina a
good and sufficient surety company bond guaranteeing said curb and gutt+
against all defects in material and workmanship_for..,.a period of two (2)
years from the date of its completion and acceptance of such work by
the City; together with a good and sufficient surety company bond
running to the State of Kansas in an amount approximately equal to the
contract price of said improvements and conditioned that said i+7 R.
Amerman shall pay all indebtedness for labor and material furnished
in making the

provided for herein.
Section
6.
The Board
of Commissioners of the City of Salina are
hereby authorized to make and enter into on behalf of said City all
written agreements necessary'in order to secure the construction of
the improvements herein provided for.
Section 7. This ordinance shall'take effect and be in full force
from and after its publication once in the official City paper.

Salina, Kansas from the west line o Santa Fe Avenue to
the east line of Ninth Street in said City.

Santa Fe Avenue to the east line of Ninth Street in said City

actually furnished at the following priced: For excavating and
grading seventh cents (70¢x) per cubic yard; for Portland Cement
Coherete combined curb and gutter eighty cents (80�) per linear
foot and for paving actually laid and put in place Three and 18/100
Dollars ($3.18) per square yard. All of said work shall be paid
for according to the measurement made by the City Engineer of the
City of Salina. It is hereby determined and found that the prices
to be paid for the improvements as aforesaid is less than the esti-
mated prices of each and all of said improvements as now on file
with the City Clerk of the City of Salina, Kansas.
Section 5. Such contract is awarded upon the express condi-
