An Ordinance specifying and seleetingthe paving material to be used
.and letting.a contract for the curbing, guttering, excavating,
grading, and paving of PHILLIPS STREET -in the City of Salina,
Kansas from the north line of nark Street, to the south line of
Bishop_ Street in said City.
BE IT ORDAINED by the Board. of Commissioners of the City of Salina,
Kansas
Section 1. That it is hereby determined that vHILLIPS STREET in
the City of Salina, F.ansas from the north.line of-Park.Street to the
south line of Bishop Street in said City shall be paved with one -course
vitrified vertical fiber plain wire cut brick, not less.than three (3)
inches in depth of Fortland Cement Concrete base with one.(l) inch sand
cushion, such pavement within the limits above def-ined.to be thirty-
three (33) feet in width excluding curb and gutter.
Section 2. That it is hereby determined that Phillips Street in
the City of Salina, Kansas from the mor.th.line.of..11.ark Street to the
south line of Bishop Street in said City shall be curbed and guttered
with one piece combination cement.curb And gutter,,said combined curb
and gutter sha ll.be comprised of a curb six.(6) inches thick at the
top and six and one-half (6) inchesthick at, the throat, with gutter
twenty-four. ,(240 inches wide, six (6)..inches thick -at the throat. and
seven '7) inches thick next to the pavement.
Section 3. All excavating, filling and rolling necessary for the
proper construction of such improvements shall be done and all of such
improvements shall be made and done inn.strict conformity to and in
compliance with the plans and specifications heretofore made by the
City Engineer of Salina, tiansas ' and now on file with the City Clerk of -
said City, which plans, and -specifications are hereby incorporated in
and made a part hereof in all respects as fully and completel.y.as thou
written out at length herein; which said plans and specifications are
hereby adopted as,and for the plans and specifications of such work
and improvements.
Section 4. That a contract is hereby awarded to M. R. Amerman
for -the paving, curbing, guttering, excavating and filling the above
mentioned street in the limits aforesaid with the materials hereiribefo
mentioned for the paving actually laid and put in place, forlabor
actually performed and the materials 'actually furnished at the follow-
ing prices:. For excavating and grading seventy cents (70�) per cubic
,yard, for Portland Cement Concrete combined curb and gutter eighty
cents (80�) per lineal foot, and for 'paving actually laid and put in
place, Three and 18/100 Dollars 03.18) per square ,yard. All of said
work shall be paid for according to the measurement made by the City

Engineer of the City of Salina. It is hereby determined and found
that the prices to be paid for the improvements as aforesaid is less
than the estimated prices of each and all of said improvements as
now on file with the City Clerk of the City of.Salina, i�.ansas.
Section 5. Such contract .is. awarded upon -the express condi-
tion

tion that such work and improvements shall be dbne.in strict accor-
dance with and in compliance with the plans and specifications of
the City Engineer therefor, which plans and speci.fi.cations are here
by made a part of this ordinance and of the contract awarded, and
upon further conditions among others that the person to whom said
contract is awarded shall furnish to the City.of balina a surety
company bond in the approximate sum of the cost of such improvements
guaranteeing the prompt, proper and workmanlike construction of all
the same together with a surety compan'y.bond guaranteeing such pave-
ment against all defects in material and workmanship for a period
of five (5) years From the date of its completion and acceptance by
said City; and said contract is awarded upon a further condition that
said M. R. Amerman shall furnish the City of Salina a good and

sufficient surety company bond guaranteeing said curg and gutter
a6ainst all defects in material and workmmnship for a period of two
(2A years from the date,of its completion and acceptance of such
work by the City; together with a good and sufficient surety company
bond running to the 6tate of r�ansas ±n an amount approximately equal
to the contract price of said improvements and conditioned that said
M. R. Amerman shall pay all indebtedness for labor and material
furnished in making the improvements provided for herein._
.Section 6. The Board of Commissioners of the City of Salina
are'hereby authorized to make and enter into on behalf of said City
all written agreements necessary in order to secure the construe -
tion of the improvements provided .for herein.
Section 7. This ordinance shall take effect and be in full
force from and,after its publication once in the official: City paper.

ORDINANCE NO. 2722
An Ordinance specifying and selecting the paving material to -be
used and letting a contract for the curbing guttering,
excavating, grading and paving of Philli s Street in the
City of Salina, Kansas from the no-rTh line of PaFE Street
to the south line of Bishop Street in said City.
BE IT ORDAINED by.the Board of..Commissioners of the City of Salina,
Kansas:
Section le That it is hereby determined that Phillips Street
in the City of Salina, Kansas from the north line of Park Street
to the south line of Bishop Street in said City shall be paved with

tion of five (5) inches in depth of Portland Cement Concrete base
with one (1) inch sand cushion, such pavement within the limits
above define.d.;.to be thirty-three (33) feet in width excluding curb

Section 2. That it is hereby determined that Phillips Street
in the City of Salina, Kansas from the north line of Park Street to the
