An..Ordinance ,specifying .and selecting the TRving material to be used
and letting -a contract for the -cur-bing.,,guttering, excavating.,
grading and paving of ELM STREET..in.the City of Salina,, Kan-
sas from the west line of Ninth.6tree,t-to the east line of
College Avenue in said City (except the, intersections 'of Twelfti
Street and Thirteenth Street which are already paved).
BE IT ORDAINED by,.the Board of Commissioners..of the City of Salina.,
Kansas:
Section 1. That it is herebe determined that ELM STREET in
the City of Salina, Fansas from the west.line of. Ninth Street to
the'east line of, College Avenue,in said City,. (except the inter-
sections of Twelfth Street and Thirteenth Street.which are already
paved), shall be paved with.one-course vitrified. -vertical fiber
plain wire cut brick, not less than threeo-(_3) inches deep, with
asphalt filler laid on a foundation of-five...(.5). inches in depth
of Portland,Cement Concrete base with,.one.(l),.inch,sand cushio-nv
such pavement within the limits above defined to be thirty-three
(.73) feet in width excluding curb and gutter.
Section 2. That it is hereby determined that ELM STREET: in
the City of Salina., Yansas from -the west line of.Ninth Street to
the east line of College Avenue in said City (except the intersec-
tions of Twelfth Street' and Thirteenth Street Which are 'already
paved) shall be curbed and guttered with one piece combination ce-
ment curb and gutter, said combined curb and, gutter shall be com-
prised of a curb six (6) inches. thick at the top and six and one-
half (62) inches thick at the throat., with gutter twenty-four (24)
inches wide, six inches thick -at the throat and seven (7) inches
thick next to the pavement.
Section 3. All excavating, filling and -rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity
to and in compliance with the plans and specifications heretofore
made by the City Engineer of Salina, Y,,ansas and now on'file with
the City'Clerk of said City, which plans and specifications are here-
by incorporated in and made a part hereof in all respects as fully
and completely as though written out. at length herein; which said
plans and specificationx are hereby adopted as and for the plans
and specifications of such work and improvements.
Section 4. That 9. contract is hereby awarded to b1l. R.,hmer-
man for the paving, curbing, guttering,, excavating and filling the
above mentioned street in the limits aforesaid with the materials
hereinbefore specified -i --for thepaving actually -laid and~ put in place
for the labor actually performed and the materials actually used at
the following prices: For excavating and grading seventy cents (70�)
per cubic yard; for.Portland Cement Concrete -combined -curb, and gutter
eighty cents (80�) per lineal foot and for.paving.actually laid and
put in place, '.i`hree and 18/100.Dollars ($3.18).. per.. square yard. All
of said work_ shall be paid for according to the measurement made by
the City gngineer' of said City of Salina. It .is. her.eby.determined and
found that the prices to be paid for the improvements -as aforesaid is
less than the estimated prices of each and all -of said,improvements as
now on file with the City Olerk of the City of Salina., Kansas.
Section 5. ''Such contract is awarded upon the express condition
that such work and improvements shall be done .in -strict accordance
with and in compliance with the plans and specifications of the City
Engineer therfor, which plans and specifications are hereby made a part
of this ordinance and of the contract awarded.and.upon further condi-
t-ions among others that the person to whom.said_contract is awarded
shall furnish to the City of Salina a surety company bond in the
approximate sum of the cost of such improvements.guaranteeing the prompt
proper and workmanlike construction o,f all the same together with a
surety company bond guaranteeing such pavement against.all defects in
material and workmanship for a period of -five (5) years from the O'ate
of its completion and acceptance by said City; and said contract is
awarded upon a further condition that said M. R. Amerman shall furnish
the City of Salina a good and sufficient surety company bond.guarantee-
ing said curb and gutter against all 'defects in material and workmanshij
for a period of two (2) years from the date of its completion and
acceptance of such work by the City; ''together with a good and suffici
surety company bond running to the State of Kansas in an amount approx-
imately equal to the contract price of said improvements and conditioned
that said M. R. Amerman shall pay all' indebtedness for labor and ma-
terial furnished in making the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina,
Kansas -are hereby authorized to make !'and enter into on behalf of
said City all written agreements necessary in.order to secure the
construction of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full force
from and after its publication once in the official City paper.

ORDINANCE NO. L721
An Ordinance specifying and selecting the paving material to be
used and letting a contract for the curbing, guttering, exca-
vating, grading and paving of Elm Street in the City of Salina,
'Kansas from the west line of N -FI +Str et to the east line
of College Avenue in said City, (except the intersections of
Twelfth Street and Thirteenth Street which are already paved).
BE IT ORDAINED by the Board of ('ommissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined -that Elm Street in the
City of Salina, Kansas1 from the west line of Ninth Street to the east
line of College A,,enue in said City, (except the intersections of
Twelfth Street and Thirteenth Street which are already -paved), shall
be paved with one -course vitrified vertical fiber plain wire cut
brick, not less than three (3) inches deep, with asphalt filler laid
on a foundation of five (5) inches in depth of Portland Cement
Concrete base with one (1) inch sand cushion, such pavement within
the limits above defined to be thirty-three (33) feet in width
excluding curb and gutter.
Section 2. That it is hereby determined that Elm Street in the
City of Salina, Kansas from the west line of Ninth Street to the east
line of College Aenue in said City, (except the intersections of
Twelfth Street and Thirteenth Street which are already paved), shall
be curbed and guttered with one piece combination cement curb and
gutter, said combined curb and gutter shall be comprised of a curb
six (6) ienhes thick _at the top and six and one-half (62 ) inches 'thick
at the throat, with gutter twenty-four (24) inches wide, -six (6)
inches thick at the throat and seven (7) inches thick next to the
pavement .
Section 3. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made.,and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina, Kansas and now on file with the City

man for the paving, curbing, guttering, excavating and filling'
the above mentioned street in the limits aforesaid with the materi-
als hereinbefore specified, for the paving actually laid and put 'in
place, for the labor actually performed and the materials actually
furnished at the following prices: For excavating and grading
seventy cents (70�) per cubic yard; for Portland Cement Concrete
combined curb and gutter Eighty Cents (80�) per lineal foot, and
for paving actually laid and put in place Three and 18/100 Dollars
per square yard. All of said work shall be paid for aeeord-
ing to the measurement made by the City Engineer of the City of
Salina. It is hereby determined -and found that the prices to be
paid for the improvements as aforesaid is less than the estimated
prices of each and all of said improvements as now on file with
the City Clerk of .the City of Salina. -Kansas.

Section 6, The Board of Commissioners of the City of. Salina
are hereby authorized to make and enter into on behalf of said City
all ti -Witten agreements necessary in order to secure the construction
of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.
