2718 Improve Charles Street-- ORD.INANCE_N_O_._27.18_._ p __ (Published in The Salina Evening Journal, -VNN ory 1923) An Ordinance specifying and selecting the paving material to be used and letting a contract for the curbing, gutterins, ex- cavating, grading and paving of CHARLES.STREET in the City of Salina, j�.ansas from the vest fine, Qf Ninth. Street to the east line of Eleventh Street, in said City. BE 1T uRLAINr;D by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that CHH-RLES STREET in the City of Salina, iiansas from the west line of Ninth Street to the east line of Eleventh Street in said City shall be paved with one - course vitrified vertical fiber plain wire cut brick, not less than three; (3) inches deep, with aspahlt filler laid.on a foundtion of five (5) inches in depth of Portland Cement Concre.te..base with One�)l) inch sand cushion, such pavement,` within the limits above defined to be twenty-six (26) feet in width excluding.curb and gutter. Section,2. That it is hereby determined. that CHARLES STREET in the City of Salina, Kansas from the west line of.runth Street to the east line'of Eleventh Street in said City shall be curbed and guttered with one piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches, thick at the top and six and one-half (Q,) inches thick at the throat, with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement, Section 3. 'All excavating,'filling and rolling necessary for the proper constructionof such improvements shall be done and all of 'i such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely d at though written out at length herein; which saidplans and specifica- tions are hereby adopted as and for the plans and specifications of such work and improvements. Section 4. That a catitract is hereby awarded to 1I. R. Amerman for the paving, curbing, guttering,I excavating and filling the above mentioned street in the limits aforesaid with the materials herein- before specified, for the paving actually laid and put in place, for the labor actually performed and the materials actually furnished as the following prices: For excavating and grading seventy cents(70�) per cibuc ,yard, for Portland Cement Concrete combihed curb and gutter eighty cents (800) per lineal foot and for paving actually laid and ;i put in place Three and 18/100 Dollarsl!(4�3.18) per square yard. 1 1 1 1 1 1 1 1 All of said work shall be paid for according to the measurement Haab by the City Engineer of the City of Salina. It is hereby de- termined and found that prices to be paid for the improvements as aforesaid is less than.the estimated prices.of_.each and all of said improvements as now on file with the City Clerk of the City of Salina, -c1ansas . Section 5. Such contract is awarded upon the express con- dition that such work and improvements shall..be done in strict accordance with and in compliance with the plans and specifications of the City Engineer thereof, which plans. and specifications are hereby made a part of this.ordinance and of the contract awarded, and upon further conditions ainong others that the person to whom' said contract is awarded shall furnish to the City of Salina a sur- ety company bond in the approxi?-ate_sum of.the cost of such im- provements guaranteeing the prompt, proper and workmanlike con- struction of all the same, together with a surety.company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said -City; and said contract is awarded upon a further condition that said M. R. Amerman shall furnish the City of Salina a good and sufficient surety company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said M. R. Amerman shall pay all indebtedness for labor and material fur- nished in making the improvements provided for herein. Section e, rhe Board of Commissioners of the City cr Selina are hereby authorized to make and enter into on behalf os said City all written agreements necessary in order to secure the con- struction of the improvements herein provided for. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1.
