BE 1T uRDAI1TED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that ELEVENTH STREET in the City of Salina, lansas from`the`north line of Prescott Avenue to the south line of charles street in said City.shall be paved with one -course vitrified verticiLl. fiver plain wire cut brick., not less than three -(3) inches deep, with asphalt filler laid on a foundation of five (5) inches in depth of.I'ortland Cement Concrete base with one (1) inch sand cushion, such.pavement within the lim- its above devined to' be twenty-six. (26..). feet in width ' excluding curb and gutter. Section 2. That it is hereby determined that ELEVENTH STREET'in the City of Salina, Y�ansas from the north line of pres - eott avenue to the south line of Charles Street in said City shall be curbed and guttered with one piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six inches thick at the top and six and one-half inches thick at the throat, with gutter twenty-four inches wide, six inches thick at the throat and seven inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Y�ansas and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and"completely as though written out At length herein; which said. plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 4. That a contract is hereby awarded to M. R.. Amerman for the paving, curbing, guttering, excavating and filling the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place, for the labor actually performed and'the' materials actually furnished at the following prices: For excavating and grading seventy cents (70�) per cubic yard; for Portland. Cement Concrete combined curb and gutter eighty cents (800) per lineal.foot and for paving actually laid and put in place Three and 18/100 Dollars ($3.18) per square yard. All of.said work shall be paid for according to the measurement made by the.0ity Engineer of the City of Salina. It is hereby determined and.found that the prices t.o be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas, Section 5. Such contract is awarded upon the express condition that such work and improvement shall be done in.str.ict accordance with and in compliance with the plans and specificationsof the City Engineer therefor, which plans and specifications.are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same, to gether with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; and said contract is,awarded upon a further condition that said 14. R. kmerman shall furnish the City of Salina a good and sufficient suret,,; company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) ,years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said ISI. R. Amerman shall pay all indebtedness for _labor and material furnished in the making of improvements herein provided for. Section 6. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Eleventh Street in the City of Salina, Kansas from the north line of Prescott Avenue to the south line of Charles Street in said City shall be paved with one -course vitrified vertical fiber plain wire cut brick, not less than three t3) inches deep, with asphalt filler laid on a foundation of five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such,pavement within the lim- its above defined to be twenty-six feet (26) in t1idth excluding curb and gutter. Section 2. That it is hereby determined that Eleventh Street in the City of Salina, Kansas from the north line of Prescott A',enue to the south line of Oharles Street in said City shall be curbed and guttered with one piece combination cement curb.and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half (62) inches thick at the. throat, with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3.
