2716 Improve Eleventh Street9L An Ordinance specifying and selecting',the paving.material to be used and letting a contract for the curbing,, guttering, ex- eavating, grading and paving of Eleventh Street in the City of -Salina, Kansas from the south)11ine of Charles Street to the north line of Crawford Avenue in said City. BE IT ORDAINED by the board.of Commissioners.of the City of Salina, Kansas: Section 1. That it is hereby determined that ELEVENTH STREET in the City of Salina, Kansas from the south line -of Charles Street to the north line of Crawford Avenue in said City.shall be paved with one -course vitrified vertical fiber plain.wire .cut brick, not less than three (3) inches deep wiitha'sphalt filler laid on a foun- dation of five (5) inches in depth of.Portland.Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined to be twenty-six (26) feet in width excluding curb and gutter. Section 2. That it is hereby determined that ELEVENTH STREET in the City of Salina, Kansas from th;e south line of Charles Street to the north line of Crawford Avenue in said City shall be curbed and guttered with one piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half,(64) inches thick at the throat with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for - the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to And in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Eansas and now on file with ii the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though writte'n out at length herein; which said plans and specifications are hereby adopted as and for the plans and specifications of such work!' and improvements. Section That a contract is hereby awarded to M. R. Amerman for the paving, curbing, guttering, exeavaging and filling the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in 'place,, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading seventy cents 1 1 1 1 1 1 1 1 1 C CZ �b (70�,) per cubic yard; for Portland Cement Concrete. combined curb and gutter eighty cents (80¢) per lineal foot and for paving actually laid and put in place three and 18/100 dollars ($3.18) per square yard. All of said work shall.be.paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined.and found that the prices to be paid for the improvements as aforesaid.is less than the es- timated prices of each and all of said.improvements as now on file in the office of the CityClerk of the City of Salina, Kansas. Section 5. Such contract is awarded_.upon.the express con- dition that such work and improvements shall_be done in strict accordance with and in compliance with the.plans,and specifica- tions of the City Engineer.therefor, which plans and specifica- tions are hereby made a part of this ordinance.and of the con - tract awarded, and upon further conditions among others that the person to whom said contract is aivarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same together with a surety company bond guaranteeing such pavement against all defects in material and workmamship for period of five (5) ,years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said M. R. Amerman shill furnish the city of Salina with a good and suffic- ient surety company bond guaranteeing.said curb and gutter againt all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas'in an amount equal to the contract price of said improvements and conditioned that said M. R. Amerman shall pay all indebtedness for labor and material furnished in making the improvements provided,for herein. Section 6. The Board of Commissioners of.the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements.herein provided for.
