I TvA NCE - An Ordinance specifying and selecting the paving material to be used and letting a contract for the curbing, guttering, excavating, grading and paving of CEDAR .STREET in the City of Salina, Kansas. from the west line.of Baker Street to the east line of Phillips Street in said City. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas Section 1. That it is hereby determined..that CEDAR bTREET in the City of Salina, P,ansas from the west line...of Baker Street to the east line of Phillips Street in_said.City..sha11 be paved with one -course vitrified vertical_fiber.plain-wire cut brick, not less than three (3.) inches deep, with asphalt filler laid on a foundation of five'(5) inches in.depth.o.f Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined .to be thirty-three (33)`feet in width excluding curb and gutter. Section 2. That it is hereby determined that CEDAR 6TREET in the.City of Salina, Kansas .from the west.line of Baker Street to the east line of Phillips Street in said City shall be curbed and guttered with one piece combination cement curb and gutter, said combined curb and gutter shall be eomprised.of a curb six (6) inches thick at the top and six and one0half (61) inclies thick at the throat, with gutter twenty-four (24A inches wide, six (6) inches thick at the throat and seven (7)'inches thick next to the pavement. Section $. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and -completely as though written out at length her which plans and specifications are hereby adopted as and for the plans and specifications of such work -and improvements. Section 4.. That a contract is hereby awarded to Me R. Amerman for the paving, curbing, guttering, excavating and fill- ing the above mentioned street in the limits aforesaid with the 33 434 materials hereinbefore specified for the paving actually laid and put in place., -for the labor actually performed and th.e materials actually furnished at the following prices: For excavating and grading seventy cents (700) per cubidl yard; for Portland Cement Concrete combined curb and gutter eighty,cents (80�) per lineal " foot and for paving actually laid and, put in.place Three and 18/100 Dollars,(,$3.18) per square yard. All' of said work shall be paid for according to the measurement made by the.,City.Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as aforesaid is.less than the es- timated prices of each and all of said.improvements as now on file with the City Clerk of the.City of Salina, Kansas, Section 5. Such contract is awarded upon the express condition that such work and improvements shali'be done.in strict accordance with and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the. contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bod in the approximate sum of.the cost ofilsuch improvements guaranteeing -the prompt, proper and workmanlike construction of all the same to- ' gether with a surety company bond guaranteeing such pavement against all defects in mater-ial and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said person i shall furnish the City of Salina a good and sufficient surety company bond guaranteeing said.curb and gutter against all defects in material and workmamship for a period of two (2) years from the I date of its completion and acceptance of such work by the City; to gether with a good and. sufficient surety coripany bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said M. R. Amerman shall pay all,,indebtedness for labor and material furnished in mal-ing the improvements provided for herein. Section 6. 'rhe board;of Commissioners of the City of Salina are hereby authorized to make and enter into.on behalf of said City all written agreements necessary in order to secure the construction r of the improvements herein provided for. 1 1 1 1 L P PG e. R. Amerman shall pay all indebt- edness for labor and material furnished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina, are hereby authorized to make and enter into on behalf of said .City all written agreements necessary in order to secure the construction of the improvements herein provided for.
