B:, 1T ORDAINED by the Board of Commissioners of the City of talina, riansas : Section 1. That the hoard of Commissioners of the City of Salina, Kansas deem it necessary and hereby order that the following described storm sewer, together with the following described manholes and catch basins be built and constructed in.thE City of Salina, Kansas, as follows: A 10 -inch storm sewer, commencing at the end of the present stub of sewer at the intersection of Highland Avenue and Wilson Street in said City, running thence west on Wilson Street to the intersection of Wilson Street with Ninth Strut therein, together with three (3) catch basins and one (1) manhole. Section 2. r'or the work and improvement herein provided for the City Engineer shall make and. file with the City Clerk of said City on or before the 20th day of March, 1923, complete plans and speci- fications for the construction of the above named storm sewer, and that on or before the last said named date said City Engineer of said City shall submit to the Board of Commissioners,,under oath, detailed estimates of the cost of such sewer construction as mentioned in 6ection One (l) of this ordinance... Section 3. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with said City 'ilerk as aforesaid, the Board_ of Commissioners shall advertise, by advertisement,nublished in the official City paper -of the City of Salina for three consecutive days for the receipt of sealed proposals for the construction of the sewer ir;.provernent mentioned in Section One (1) hereof, and after the receipt' of such proposals the Boarry of Vomnissioners Tnnay and are nereby authorized to let a contbact for the construction of said sewer to the lowest responsible bidder therefor, said Board of Commissioners hereby reserving the right of rejecting any and all bids. Section 4. The cost and expense of constructing such sewer, catch basins and manhole shall be assessed against all lots and pieces of ground contained in the City of Salina, as one sewer dis- trict, provided.for under and according to the terms and provisions ,of.Ordinance No. 613, passed and approved, December 23rd, 1887, it being hereby determined that the benefit accrueing thru the construe - 0 1 1 1 1 1 tion of said sewer accrues to the benefit of the City of Salina as a whole; and the Board of Commissioners are hereby authorized to provide for the cost of the construction thereof by installments instead of levying the entire amount at one time and for such installments they may issue sewer improvement bonds of the City of Salina, Kansas, payable in installments of equal amounts in each year, none.of which bonds nor the installments shall run longer than ten (10) ,years nor bear interest to ex- ceed the rate of five:(5) per centum per annum and such.bonds may be delivered to.the contractor building such sewer in pay- ment thereof, or the Boafd of Commissioners may sell such bonds at.not less than their par value and out of the, proceeds thereof may pay said contractor, and for the purpose of paying interest and principal on said bonds as they severally becorie due, the Board of Commissioners shall each ,year, during the life of such bonds, levy assessments against all taxable propertyin said Uity of Salina, at the assessed value. thereof for general revenue purposes, in an amount sufficient to pay the principal and inter- est for that ,year; and the City Clerk shall certify said assess- , ments as they are severally made and levied as aforesaid to the Uounty Clerk_ of Saline Uounty, Kansas at the same time and in the same manner as other city taxes are certified, to 1�e collect- ed according to law.
