2708 Improve Sewer ImprovementsA .11C.E _T,'i_0_.-2.7_0.8 An Ordinance providing for the construction of certain sewers in the City of Salina, Kansas. WHEREAS, by certain resolutions 'duly adopted on the 5th day of February, 1923, the Board of Commissioners of the City of Salina., Kansas have declared that the construction of certain lateral sewer districts of said as heretofore provided by ordinance are improv1ementz necessary to be made, and WHEREAS, said resolutions in each instance were published for six consecutive days in The Salina Evening Journal, a daily newspaper published in the City of Salina, the ';official city paper of said City, and ANHEREAS, the majority of the resident owners of property liable to taxation for the cost of said improvements did not within twenty days from the date of the last publication of any such resolutions file with the City Clerk of said City their protest in writing against such improvements or the making thereof, THEREFOR BE IT ORDA INED by the Board of Commissioners of the City .of Salina, Kansas: Section 1. That the following described sewers be constructed., laid and built in the City of Salina, "hansas, to -wit:, A 10 -inch sanitary sewer lateral, in Lateral Sewer District No. 6-F, commencing at the proposed manhole at the intersection of Tenth Street and Crawford Avenue in said City, running thence south to Frost Street. Manholes as designated on plans. An 8 -inch sanitary sewer lateral in Lateral Sewer District No. 6-C, commencing at the present manhole at the intersection of Park Street and Phillips Street in said City, running thence north on Phillips Street to bishop Street.,Manholes as designated on plans. An 8 -inch sanitary sewer lateral in Lateral Sewer District No. 5-C, commencing at the present manhole at the intersection of Uni- versity Place and Railroad Street in slid City, running thence south on Railroad Street to Walnut Street.`Ivlanholes as designated on plans. An 89inch sanitary sewer lateral in Lateral Sewer District No. 4-F, commencing at the present manhole`at the intersection of 'Tenth Street and Charles Street in said Citly, one lateral running east on Charles Street to Ninth Street and one lateral running west on Charles Street to Eleventh Street. Manholes as designated on plans. A 10 -inch sanitary sewer lateral; in Lateral Sewer District No. 5-F, commencing at the present rianhole at the intersection of Tenth Street and Crawford. Avenue in said City, running thence east on Craw- ford. Avenue to Ninth Street. Manhole,a as designated on plans. An 8 -inch sanitary sewer lateral on Lateral Sewer District No. 7-F, commencing at the present manhole at the intersection of Bond Street and Wilson Street in said City.. running thence east on Wilson Street to Third Street. Manholes as designated on plans. A 10 -inch sanitary sewer lateral, in Lateral Sewer District No. 9-F, commencing at the present rmanhole at the intersection of Fourth `street and Republic Avenue in said City, running thence east on Republic Avenue to 'Third Street. i�'lanholes as designated on plans. For the work and improvement herein provided for the City Engineer shall mute and file with the City Clerk on or be- fore the 20th day of t4arch, 1023 complete plans and specifications. for the construction of the above named sewers and that on or be- fore the last said named date said City Engineer shall submit to the Board of Commissioners, under oath, detailed estimates of the cost of such sewer construction as mentioned in Section One (1) of this ordinance. Section 3. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may adver- tise, by advertisement published in the official City paper of the City of Salina for three consecutive days for the receipt of seal- ed proposals for the construction of the sewers as mentioned in Section One (1) hereof; and after the receipt of such proposals the Board of Commissioners may and are hereby authorized to let a contract for• the construction of said sewers to the lowest respon- sible bidder therefor; said Board of Commissioners shall and are hereby reserving the right to reject any and all bids. Section 4. That for such sewer construction special assess- ments shall be made in regard to each separate sewer herein pro- vided for, for the full cost thereof, on all lots and pieces of land to the center of the block_ on either side of the street for the distance in each instance to be ir,)proved according to the appraised value of said lots or pieces of land without regard to the buildings or improvements thereon, said appraisement to be made in the manner as hereinafter provided for. Section 5. After the passage and publication of this ordin- ance the Board of Commissioners shall appoint three disinterested appraisers, householders, who, after having taken an oath to makea true and impartial appraisement of all lots and pieces of land lia- ble to assessment and taxation for the cost of the improvements herein provided for, shall within five says after having been noti- fied of their appointment, proceed to appraise said lots and pieces of land liable to. assessment and taxation as aforesaid and as may be designated by the Board of Commissioners of said Uit.y, without regard to the buildings or improvements thereon, and after making such appraisement shall return the.sE,.me to the Board of Comrlission- ers at the first meeting of said Board after such appraisement shaIL have been completed, and after said alppraisement is returned to the Board of Commissioners, said Board ofiCommissioners shall designate a time for holding a special session of,such Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid,'''of which special session due notice shall be given in the official City paper, at which special session the Board of Commissioners may alter the valuation of any lot or piece of land if, in their opinion', the same has been appraised too high or too low. Section 6. For the purpose of pa ging for the work and improve- ment in this ordinance provided for, Ithe Board of Cormiissioners are hereby authorized and directed to issue internal improvement bonds of the City of balina, in an amount not to exceed the contract price of such improvement, and to run for a period of not less than ten years and be payable in ten equal installments, together with the interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agency of the btate of Kansas; and for the par - pose of paying principal and interest' on said bonds as they severally become due and payable the Board of C'mmissioners shall apportion and assess against the lots and pieces ofl"eland within the taxing district of such improvements, special assessments covering the cost of such improvements, and the apportionment therein contained shall hold good for all. the installments that are to be collected from the specific property chargeable with said improvement. Such assessment and appor- tionment ordinance shall contain the total amount of tax apportioned - to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City',Ulerk shall annually, at the same time other taxes are to be certified, I',; certify to the Uounty Clerk of Saline Uounty, Kansas, a full list of all property liable for such work and improvement together with the respective amounts due on each of said tracts and parcels of land, whicl-i amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of six (6) per cent per annum, and such amounts so certified shall to collected as other taxes are collected. Section 3. That after such plans and speeificAtions shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official City paper of the City of Salina for consecutive days for;the receipt of sealed proposals for the construe - tion of the sewers as mentioned in. Section One (1) hereof; and after the receipt of such proposals the.Board of Commissioners may and are hereby authorized to let a contract for the construction of said sewers to the lowest responsible bidder therefor; said Board of Commissioners shall and hereby reserve the right to reject any and all bidet.
