An Ordinance relating to and apportioning and levying special asses
ments on certain -lots and pieces of ground in the'City of
Salina,:Kansas to pay the cost of curbing, guttering, excav&t-
ing, grading and paving.Elm Street from the east side of Elm
Street Bridge to the west side of...Ohio Street, in.said City
and relating to and providing for the collection and payment c
such assessments.
BE IT ORDAINED by.the Board of Commissioners o.f the City of Salina,
Kansas:
Section 1. For the purpose of paying the cost of curbing,
guttering, excavating, grading and paving Elm_Street..in.the City of
Salina, Kansas from the east side of Elm Street Bridge'to the west
line of'Ohio Street in said City, there are hereby levied and
assessed on the property liable therefor, being all of the lots
pieces of ground lying on either side of said -Elm Street for the
distance improved as aforesaid to the center.of'the block on
either side thereof,.according to the appraised value of such lots
and pieces of ground, without regard to the buildings or improve-
ments thereon, special assessments, covering the cost of such work
and improvements: said special assessments being based on the
special valuation and appraisement of said lots and pieces of grow
heretofore made by three disinterested appraisers, appointed by
the Board of -Commissioners of the City of Salina, Kansas, which sa

appraisement is hereby referred to and made a part of this ordinance,
and the several amounts levied, apportioned and assessed against
each of"said lots and pieces of ground for the purpose aforesaid
are.hereby found and determined to be as follows:

Section 2. Said amounts levied, apportioned and assessed aforesaii
shall be due and collectible in'10 equal installments, the first be-
coming due with the taxes levied for the year 1923, and one of said
installments falling due each and every year thereafter until all are
paid and all to be collected with .interest as in this ordinance provid eff
PROVIDED0 that the owner of any pie-ce, of .property liable, for any such
assessment may-itedeem his property from such .liability by paying into
the City Treasury the entire amount chargeable against the same', as in
this ordinance- designated at any time within" 30 days after the publicato
tion.of-this ordinance and before the issuance of the bonds of said
City in payment of the balance of said improvements, and his .property
so paid.on shall not thereafter be liable for any further assessments
for the. cost of said improvements, nor for any part of said bonds
Section 3. There is hereby farther levied and.as-;essed against.
each -lot -and
each -lot and piece of ground described in this ordinance 6% interest

per annum on all of said installments therein mentioned from the date of

the bonds, which may be issued at the -end of '30 days as specified in the
preceding section hereof".., as by „law -provided- to the time of collection
of the last of 'said installments as provided.by 1'aw, which said intere6t
shall be collected annually at the 'same- time -and in the same mariner as
said installmentst are collected; and after the taking effect of -this
ordinance it shall -be the duty of the City Clerk of said City to annually
at the same time other taxes are -certified and until all'of said assess
rrents so apportioned ,and -levied herein have been certified, ' to certify Ito
the County Clerk of Saline County, Kansas a full`"list of all ... property
liable to assessmentand taxation .for .such work and. improvement, except
such property on which the special as,ses'sments aforesaid have been paid
in full as hereinbefore providedj, together with the respective.amounts;due
on each of such lots and pieces of ground, which amounts shall-ineludelthe

for one year at the rate of,*6% aper annum on all unpaid balances of such
assessments at the beginning of each such year,as aforesaid, and such

amounts so certified as herein provided shall be placed upon -the tax roll
by the County Clerk. -of Saline County, Kansas and collected as all other
taxes are collected.:

Section 2. Said amounts, -levied., apportioned and assessed
aforesaid, shall be due.and collectible in 10 equal installments,
the first becoming due with the,taxes levied for the year 1923,
and one of said installments falling due each and every.year there-
after until all are paid, and all to be collected with interest;as;
in this ordinance provided.; PROVIDM), that the owner of any piece
of property liable for any such assessment may redeem his property
from such liability by paying into the City Treasury the entire
amount chargeable against the same, as in this ordinance designated
at any time within 30 days after the publication of this ordinance
and before the issuance of the bonds of said City in payment of the
balance of said improvements, and his property so paid on shall not
thereafter be liable for any further assessments for the 'cost of
said improvements, nor for'any part of said bonds.
Section 3. There is hereby further levied and assessed.
against each lot and piece of ground described in this,ordinance
6% per annum on all of said installments therein mentioned from the
date of the bonds, which may be issued at the end of 30 days a6 spe-
ci:ef ed,." in>.the. pree;c6d ng section hereof, as by law provided, to
the time of collection of the last of.said installments as provided
by law, which said interest shall be collected annually at the same
time and in the same manner as said installments are collected; and
after the taking effect of this ordinance it shall be the duty of
the City Clerk of said City to annually at the same time other taxes
are certified, and until all of said assessments so apportioned and
herein
levied/have been certified, to certify to the County Clerk `of Saline
County; Kansas, a full list off all property liable to assessment and
taxation for such work and improvement, except such property on which
the special assessments aforesaid have been paid in full, as herein-
provided, together with the respective amounts due on each of
such lots and pieces of ground, which amounta shall include the annual.

installments of such special assessments, together with the interest for
one year at the rate of 6j per annum, on all unpaid balances of such
assessments at the beginning of each such year as aforesaid, and such
amounts so certified as herein provided, shall be placed upon the tax
roll by the County Clerk of Saline County, Kansas and collected as all
other taxes.are collected.
Section 4. This ordinance shall take effeet'and be in full
force from and after its publication once in the official city paper,
