ORDINANCE_ni0.2626 -- ---- -- --__ (Published in Salina Evening J urnal December 11- 1222) An Ordinance providing for the condemnation and appropriation of certain lots, tracts and pieces -of ground in. the City of Salina. -Kansas -for the purpose of ' opening - and extending Eleventh Street in' -said City from Crawford Street to Republic Avenue therein and providing for the appointment of appraisers therefor. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary that there should be appropriated and condemned and there is hereby appropriated and condemned for the purpose of opening and extending Eleventh Street in the City of Salina, Kansas from the south line of Crayford Street to the north line of Republic Avenue therein, which said street when so opened and extended shall.be known as Eleventh Street the following described tracts, lots and pieces of ground to -wit: The guest 27.2 feet of lots 2, 43 6, 8, 10 and 12 in Block 3, and the VITest 27.2 feet of Lots 2, 4, 6, 8, 10 and 12 in Block 4, all in Surveyors Plat Number 10 in the City of Salina, Saline County, Kansas according to the recorded plat thereof, and the East 12.8 feet of Block__6 in Surveyors Plat Number 10, in the City"of Salina, Saline County, Kansas, according to -the recorded plat thereof; -A 60 foot strip running north -and south through Block 7 and Block 9 in Surveyors Plat Number 10 in the City of Salina, Saline County, Kansas according to the recorded plat thereof, the -east line of said strip to be parallel to and 600 feet west of the west line of Ninth Street in said City; the west 30 feet of Block 11 and of Block 17 in' Sur- veyors Plat Number 10 -in the City of Salina, Saline County, Kansas, and the east 30 feet of Block 12 and Block 16 in'Surveyors P1at'Number 10 in the City of Salina, Saline County, Kansas, according to the recorded plat thereof; except so much of said described tracts, lots and pieces of ground as shall have been heretofore or other- wise appropriated and condemned for the opening, widening or extending of any other public street or streets in said City. Section 2. That the Board of Commissioners shall appoint three disinterested appraisers and householders to assess the damage and benefits caused by the appropriation and condemna- tion of such lots abd pieces of ground and who shall ascertain the actual value of the land so taken without reference to the projected improvements, and the actual damage done to all other property thereby; for the payment of such valuation and damages, the appraisers shall assess against the City the amount of bene- fit to the public generally by reason of the proposed improvement and the remainder of such amounts shall be assessed against the property within the benefit district to be created which, in the opinion of the appraisers shall be especially benefited by the proposed improvement.
