2596 Selecting Paving Material1 i 1 C n The Sa An ordinance specifying and selecting the paving material to be used and letting a contract for the paving, excavating, curbing and guttering of certain streets in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that ELIVI STREET in the City of Salina, Kansas from the east side of Elm Street Bridge to the west line of Ohio Street in said City, shall be paved with one course vitrifi_ed vertical fiber side wire cut brick paving blocks not less than three (3) inches in depth with asphalt filler laid on a foundation five (5 ) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined to be thirty-three (33) feet in width from gutter to gutter. Section 2. That it is hereby determined that EL11 STREET in the City of Salina, Kansas from the east side of Elm Street Bridge to the west line of Ohio Street in said City, shall be curbed and guttered with one piece combination cement curb and gutter. Said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half (6a) inches thick at the throat, with gutter tvrenty-four (24) inches wide, six inches thick at the throat and seven (7) inches thick next to pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which said plans and specifications are hereby incorporated in and made a part hereof in all 'respects as fully and completely as though written out at length herein; which plans and. specifications are hereby adopted as and for the plans and specifications of such work and improve- ments. Section 4. That a contract is hereby awarded to G. M. Smith and Fiat Graham, Jr., c'o-partners doing business under the frim name and style of The Smith -Graham Construction Company, for the paving, curbing, guttering, excavating and filling the above mentioned streets in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid. and put in place, for the labor actually performed, and the materials actually furnished at the following prices: For excavating and grading eighty cents (80p) per cubic yard; For Portland Cement Concrete combined curb and gutter eighty-five,cents (85�) per lineal foot; For paving actually laid and putjin place Three and 22/100 Dollars (4;3.22) per square yard. All of said work shall be paid for according to the measurement made;by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awardedlupon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and. specifica- tions of the City Engineer therefor; which plans ans specifica- tions are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the persons to whom said contract'is awarded shall furnish to the City of Salina a surety company bond in the approximate surae of the cost of such improvements guaranteeing the prompt, proper and workman- like construction of all the same together with a surety company bond guaranteeing such pavement against all defects in material and ,workmanship for a period of five '(5) years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said persons shall furnish the City of Salina a good and sufficient surety corgpany bond guaranteeing said curb and gutter against all',defeets in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in the amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness for labor and material furnished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina are hereby authorized'to make and enter into on behalf of said City all written agreements necessarylin order to secure the construction of the improvements herein provided for.
