An ordinance specifying and selecting the pay' ng material to be
used and letting contract for the xcavating, grading
and paving of certain streets in the City of Salina,
Kansas.
BE IT ORDAINED by the Board of Commissioners if the City of Salina,
Kansas:
Section 1. That it is hereby determ)ned that all of the
unpaved portion of Iron Avenue in the City oflSalina, Kansas in
the center of said Iron Avenue occupied by the traces of The
Salina Street Railway Company, from the east line of Penn Avenue
to the west line of Delaware Avenue in said City shall be paved
with one course vertical vitrified.f?ber side wire cut brick pav-
ing blocks not less than three (3) inches de,e frith asphalt filler,
laid on a foundation five (5) inches in depth RAlith Portland Cement
Concrete base �iith one (1) inch sand cushion, such pavement within
the limits above defined to be eight and one -'half (8�) feet in
width from gutter to gutter.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and don in stri ct conform-
ity to and in compliance with the plans and 'sp cifications hereto-
fore made by the City Engineer of Salina, Kansas and now on file
zrri th the City Clerk of said City, which plans and specifications
are hereby incorporated in and made a part her of in all respects
as fully and completely as though written out at length here_

which plans and specifications are hereby adopted as and for the
plans and specifications of such work and improvements.
Section 3. That a contract is hereby awarded to G. 11,
Smith and Mat Graham, Jr., co-partners doing business under the
firm name and style of The Smith -Graham Construction Company, for
the paving, excavating and filling the above,m ntioned streets in
the limits aforesaid with the materials hereinbefore specified,
for the paving actually laid and put in place, for the labor
actually performed and the material actually frnished at the
following prices: For excavating and grading 1''ighty Cents (80�)
per cubic yard; for paving actually laid and : p't in place Three
and 22/100 Dollars, ($3.22) per square yard,ll of said viork
shall be paid for according to the measurements made by the City
Engineer of the City of Salina. It is hereby determined and round
that the prices to be paid for the improvemerto as aforesaid is
less than the estimated prices of each and all
of said ii-iprovemen.ts

Section 4. Such contract is awarded upon the express
conditions that, such work and improvemnents shall be done in strict
accordance with and in compliance `gyri th the plans and specifica-
tions of the City Engineer -therefor., which plans and specifica-
tions
pecifica-tions are hereby made apart of this ordinance and of the contract
awarded, and upon further conditions among others that the persons
to whom said contract is awarded shall furnish to the City of
Salina a surety company bond in the approximate sum of the cost
of such improvements, guaranteeing the prompt, proper and work-
manlike construction of all the same together with a surety
company bond guaranteeing such pavement against all defects in
material and workmanship for a period oi: five (5) years from the
date of its completion and acceptance by said City and. said con
contract is awarded upon a further condition that said persons
shall furnish a good and sufficient surety company bond running
to the State of Kansas in an amount approximately equal to the
contract price of said improverients and donditioned that said
persons shall pay all indebtedness for labor and material furnish-
ed in making the improvements provided for herein.
Section 5. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf of
said City all written agreements necessary in order to secure the
construction of the improvements provided for herein.
Section C. This ordinance shall take effect and be in
full force from and after its rublication once in the official
City paper.

:. Section 1. That it is hereby determined that -,all of the unpaved

phalt filler, laid on a foundation five (5). inches in depth with portland
cement concrete base with one (1) inch sand cushion, such pavement within
the limits above defined to be eight and. one-half (82) feet in width
from gutter to gutter.

per construction of such improvements shall be drne and all of such improve-
ments shall be, made and done in strict conformity to and in compliance with
the plans and specifications heretofore made by the City Engineer of Salina,
Kansas and now on file with the City Clerk of said City, which plans and

spects as fully and completely as though writtenout at length herein;
