An ordinance specifying and selecting the paving material to be
used and letting a contract for the paving, excavating,
curbing and. guttering of certain streets in the City of
Salina, Kansas.
BE'IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that PENN
AVENUE in the City of Salina, Kansas from the north line of Elm
Street to Riverside Boulevard, in said City, shall be paved with
one course vitrified vertical fiber side wire cut brick, paving
blocks not less than three (3) inches deep, with asphal filler,
laid on a foundation five (5) inches in depth of Portland .Cement
Concrete base with one (1) inch sand cushion, such pavement
within the limits above defined to be thirty-three feet ('33) in
tirridth from gutter to gutter. -
Section 2. That it is hereby determined that PENIA
AVENUE in the City of Salina, Kansas from the north line of Elm
Street to Riverside Boulevard, in said City shall be curbed and
guttered with one piece combination cement curb and gutter. Said
combined curb and gutter shall be comprised of a curb six (6)
inches thick at the top and. six and one-half (6h') inches thick at
the throat, with gutter twenty-four (24) inches wide, six.(6)
inches thick at the throat and seven (7) inches thick next to
pavement.
Section 3. All excavating, filling and rolling; necessary
fop the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict conform-
ity and in compliance with the plans and si)ecifications heretofore
made by the City Engineer of Salina, Kansas and noir on file with
the City Clerk of said City, which said plans and specifications
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein;
which plans and specifications are hereby adopted as and'for the
plans and specifications of such work and improvements.
Section 4. That a contract is hereby awarded to G. M.
Smith and Mat Graham, Jr., co-partners doing business under the
Firm name and style of The Smith -Graham Construction Company,
for the paving, curbing, guttering,.excavating and filling the
above mentioned streets in the limits aforesaid with the materials
hereinbefore specified, foil the paving actually laid and put in

furnished at the following prices: For excavating and grading

of such improvements guaranteeing the prompt, proper and work-
manlike construction of all the same together with a surety
company bond guaranteeing such pavement against all defects in
material and workmanship for a period of' five (5) years from the
date of its completion and acceptance by said City; and said
contract is awarded upon a further condition khat said persons
shall furnish the City of Salina a good and sufficient surety
company bond guaranteeing; said curb and gutter against all defects
in material and workmanship for a period of two (2) years from the
date of its completion and. acceptance of such work by the City;

contract price of said improvements and conditioned that said
persons shall pay all indebtedness for labor and material furnish-

BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:

limits aforesaid with,the materials hereinbefore specified, -for the
paving actually laid and -,pat in place for the labor actually performed
and the materials actually furnished at the following prices: For
excavating and grading eighty (80) cents per cubic yard; for Portland
Cement Concrete combined curb and gutter eighty-five (85) cents per
lineal foot; for paving actually laid and put in place Three and
22/100 Dollars (0.22) per square yard.. All of said work shall be paid
for according to the measurement made by the City Engineer of the City
of Salina. It is hereby determined and found that the prices to be
paid for the improvements as aforesaid is less than the estimated prices
of each ,..nd all of said improvements as -'now on file with theCity Clerk of
the City of Salina, Kansas.
S-ection 5. Such contract is awarded upon the express condition
that such work arad improvements shbIl be done in strict accordance
with and in compliance with the plans and specifications of the City
Engineer therefor, which plans and specifications are hereby made a part
of this ordinance and of the contract awarded, and upon . further conditions
among others that the persons to wh.om said contract is awarded shall
furnish to the City of Salina a surety company bond in the approximate sum
of the cost of such irrprovements guaranteeing the prompt, proper and work-
manlike construction of all the same. together with a surety company bond
guaranteeing such pavement against all defects in material and work-
manship' f or a pe r iod of f ive (5) years f rom the da to of its completion and
acceptance by said City; and said contract is awarded upon a further con-
dition that said persons shall furnish the City of Salina a good and
sufficient surety company bond guaranteeing said curb and gutter against
all defects in

hereby authorized to make and enter into on behalf of said City all
written agreements necessary in order to secure the construction of the
improvements herein provided far .

force from and after its publication once in the. official City paper.
