2593 Selecting Paving MaterialAn Ordinance specifying and selecting the paving material to be, used and letting a contract for the paving, excavating, curbing and guttering of certain streets in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that ELM STREET in the City of Salina, Kansas from the west line of Front Street to the west side of Elm Street Bridge in said City, shall be paved with one course vitrified vertical fiber side wire- cut brick pav- ing blocks not less than three (3) inches deep; with asphalt filler laid on a foundation five (5) inches deep of Portland Cement Concrete base with one (1) inch sand suchion, such pavement within -the limits above defined to be forty-three (43) feet in width from gutter to gutter. Section 2. That it is hereby determined that ELM STREET in the City of Salina, Kansas from the viest line of Front Street to the wrest side of .Elm Street Bridge in said City, shall be curb- ed and guttered with one piece combination cement curb and gutter. Said combined curb and gutter shall. be composed of a curb six -(6) inches thick at the top and six and one-half (6?) inches thick at the throat, with gutter twenty-four inches (24) wide, six (6 ) inches thick at the throat and seven (7) inch,s thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction.of such improvements shall be done and all of such improvements shall be made and done in strict conform- ity to and in compliance with the plans and specifications hereto- fore made by the City Engineer of Salina, Kansas, and now on file. with the City Clerk of said City, which said plans and specifica- tions are hereby incorporated in and made a part hereof, in all respects as fully and completely as though written out at length herein; which plans and specifications are hereby adopted as and for- the plans and specifications of such work] and improvements. Section 4. That a contract is hereby awarded to G. M. Smith and Pkat Graham, Jr., co-partners doing business under the firm name and style of The Smith -Graham Construction Company, for the paving, curbing, guttering, excavating and filling the above mentioned streets in the limits aforesaid with the materials here- inbefore specified, for the paving; actually laid and put in place for the labor actually performed and the materials actually furn- ished at the following prices; For Portland Cement Concrete combined curb and gutter -eighty-five cents (85g�) per lineal foot; 1 1 1 1 1 d n 1 I 1 I for paving actually laid and put in place Three and 22/100 Dollars (0.22) 'per 'sq_u.aro yard. All of said. work shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as noirii on file truth, the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awarded upon the express condition -that such vaork and improvements shall be done in strict accordance with and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this.ordinance and the contract awarded, and upon further conditions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same together with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5 ) years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said persons shall furnishe the City of Salina a good and .sufficient surety company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such ,work by the City together with a good and sufficient company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay 'all indebtedness for labor and material furnished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina are hereby authorized to make and enter.into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. Section 7. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, September 5th, 1922.
