2592 Selecting Paving Material__ORDINAiTOE_I\TO._2.59 l Atah1 i ,Tied in The Salina Evening Journal 0 133 An ordinance specifying and selecting the paving material to be used and letting a contract for the excavating, grading and paving of certain streets in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of j Salina,, Kansas: Section 1. That it is hereby.determined that ELM STREET in the City of Salina, Kansas from the east line of Third Street to the west line of Front Street in said City, shall be pave with one course vitrified vertical fiber side wire cut brick paving blocks not less than three (3) inches deep with asphalt filler, laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pave- ment within the limits above defined to be forty-one (41) feet in width from gutter to gutter. Section 2. All excavating,, filling and rolling necessary for the groper construction of such improvements shall be done and all of such improvements shall be made and done in strict con- formity to and in compliance with the plans and.specifications heretofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said. City, which said plans and spe- cifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which plans and specifications are hereby adopted as and for the plans and specifications of such work and improve- ments. Section 3. That a contract is hereby awarded to G. M. Smith and Mat Graham, Jre, co-partners doing; business under the firm name and style of The Smith -Graham Construction Company, for the paving, excavating, and filling the above mentioned streets in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place, for the labor ' actually performed and the material actually furnished at the following prices: For excavating and {trading Eighty (00) cents per cubic yard; for paving actually laid and put in place Three and 22/100 Dollars ($'3.22.) per square yard. All of said work shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as afore- said is less than the estimated prices of each and of said im- provements as not; on file with the City Clerk of the City of mSalina, Kansas. Section 4. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifica- tions of the City Engineer therefor, which plans and specifica- tions are hereby made a part of this ordinance and of the contract awarded', and upon further conditions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a surety bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike con- struction of all the same together with a surety company bond guaranteeing; such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and. acceptance by said City and said contract is awarded upon a further condition that said persons shall furnish a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness for labor and material furnished in making the im- provements for herein. Section 5. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the i-rwprovements herein provided for.
