BE IT ORDAiTvED by the . Board of Commissioners f the City of Salina, Kansas: Section 1. That it is hereby determined that ELEVENTH STREET in. said. City from the north line, of Iron Avenue to the south line of State Street therein, shall be aved with one course ire ,paving blocks not vitrified vertical fiber side mcut bric��av less 'than three (3) inches deep, with asphalt filler, laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch. sand cushion, such pav {hent within the limits above defined to be twenty-eight (28) leet in width from gutter to gutter. Section 2. That it is hereby determined that ELEVENTH STREET in said City from the north line of iron Avenue to the South line of State Street, therein, shall be, curbed and gutter- ed with one piece combination cement curb and gutter. Said combined curb and gutter shall be comprised If a curb six (6 ) inches thick at the throat, with. gutter tvienty-four ('24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All excavating„ filli g and. rolling necessary construction of such improv ; c 'm rov meats shall be done and for she proper cons all of'such improvements shall be made and done in strict conform- ity to and in compliance with the plans an Epecifications here- tofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said City, ch said plans and speci- fications are hereby incorporated in and mid. a part hereof in all tely as though written out at length respects as fully and comple herein; which plans and specifications are h�reby adopted as and for the plans and specifications of such work and improvements: Section 4. That a contract is her y ayaarded to G. M. Smith and Mat Graham, Jr.,.co-partners doing business under the firm name and style of The Smith -Graham Cons ,ruction Company, for the paving, curbing, guttering, excavating a. d filling the above mentioned streets in the limits aforesaid vii h the materials hereinbefore specified9 for the paving actua�ly laid and put in place for the labor actually performed and tjie materials actually furnished at the follo 'ing prices: For ex,ca acing and grading eighty cents (80�) per cubic yard; ,for Por tlo.nd Cement Concrete combined curb and gutter eighty-five cents (i85�) per lineal foot; 1 1 I- I N 1 1 1 1 1 for paving actually laid and put in place. Three and 22/100 Dollars (��3.22) per square yard. All of said vrork shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improve;nent as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifica- tions of the City Engineer therefor, which plans and specifica- tions are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same together with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; and said contract is a -warded upon a further condition that said persons shall furnish the City of Salina a good and sufficient surety company bond guaranteeing said curb and gutter against all defects in material and. workmanship for a period of two (2) wears from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness.for labor and material furnish- ed in making the improvements provided for herein. Section 5. The Board of Co?mnissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City. all written agreements necessary in order to secure the construction of the improvements herein provided for. Section 7. This ordinance shall take effect and be in full,force from and after its publication once in the official City paper. Introduced for first reading, September 5th, 1922.
