is hereby determined and.found that the prices to be paid for the
improvements as aforesaid is less than the estimated prices of
each and all of said improvements as now on file waith the City

Section 4. Such contract is awarded upon the express
condition that such w;to'rrk and improvements s'na11 be done in strict
accordance with and in compliance with the plans and speci fica-

tions of the City Engineer therefor, which plans! and specifica-
tions are hereby made a part of this ordinance and of the contract
awarded, and upon further conditions among others that the persons
to whorm said contract is awarded shall furnish to the City of
Salina a surety company bond in the approximate sum of the cost
of such improvements guaranteeing; the prompt, proper and work-
manlike construction of all of the same together with a surety
company bond guaranteeing said curb and gutter against all defects
in material and �riorkmanship for a period of two (2) ,years from the
date of its completion and acceptance of such work by the City;
together with a good and sufficient surety company bond running
to the State of Kansas in an amount approximately equal to the
contract price of said improvements and conditioned that said
persons shall pay all indebtedness for labor and material furn-
ised in making the improvements provided for herein.
Section 5. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf of
said City all written agreements necessary in order to secure the
construction of the improvements herein provided for.
Section 6. This ordinance shall take effect and be ' in
full force from and of ter its publication once in the official
City paper.

ing of certain streets in the City of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: -
Section 1. That it is' hereby determined that JOHNSTOWN AVENUE in the
City of Salina,.Kansas from.the east line,of Front Street to the west
line of Oakdale Avenue in said City, shall be curbed and guttered with
one piece combination cement curb and gutter. Said combined curb and gut-

ter shall be comprised of a curbD six (6) inches thick at the top and six
and one-half (62) inches thick at the throat, with gutter twenty-four (24)
inches wide, six (6) inches thick at the throat and seven (7) inches -
thick next to the pavement.
Section 2. All excavating, filling and rolling necessary for the
proper construction of such improvements shall be done and all of such
improvements shall be made and done in strict conformity to and in com-
pliance with the plans and specifications heretofore made by the City
Engineer -of Salina, Kansas and now on file with the City Clerk of said
City, which said plans and specifications are hereby incorporated in and
made a part hereof in all respects as fully and completely as though
written out at length herein; which said plans and specifications are
hereby adopted as and for the plans and specifications of such work and
im-orov ements .
Section 3. That a contract is hereby awarded t o G. M. Smith and
Mat Graham, Jr., co-partners doing business under the firm name and style
of The Smith -Graham Construction Company, for the curbing, guttering,
excavating and filling the. above mentioned street in the limits afore-
said with the materials hereinbefore spe ci*fied, for' the labor actually
performed and the materials actually furnished at the following prices,:
