An ordinance specifying and selecting the -paving material to be
used and letting a contract for the excavating, grading
and paving of certain streets in the City of Salina,
Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that all of the
unpaved portion of Santa Fe Avenue in the City of Salina, Kansas
in the center of said Santa Fe Avenue as nol;i occupied by the
tracks of the Salina Street Railway Company, from the south line
of Vlalnut Street in said City to a point two hundred feet south
of South Street therein, shall be paved with one course vitrified
vertical fiber side wire cut brick paving; blocks not less than
three (3) inches deept with asphalt filler, laid on a foundation
five (5) inches in depth of Portland Cement Concrete base with
one (1) inch sand cushion, such pavement within the limits above
defined to be thirteen (13) feet in width, except at that portion
of said Santa Fe Avenue lying south of South Street in said City
and occupied by both the track and a switch track of said Salina
Street Railway Company, where said. Santa Fe Avenue at said switch
shall be paved for a width not exceeding eighteen (18) feet.
Section 2. All excavating, filling; and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict con -
fortuity to and in compliance with the plans and specifications
heretofore made by the City Engineer of Salina, Kansas and noir on
file with the City Cleric of said City, which said -plans and spe-
cif ications are hereby incorporated in and made a part hereof in
all respects as fully and completely as though written out at
length herein; which plans and specifications are hereby adopted
as and for the plans and specifications of such work and. improve-
ments.
Section 3. That a contract is hereby awarded to G. Mo
Smith and Mat Graham, Ji'., co-partners doing business under the
firm name and style of The Smith -Graham Construction Company,
for the paving, excavating and filling the above mentioned streets
in the limits aforesaid trrith the materials hereinbef ore specified,
for the paving actually laid and put in place, for the labor

actually.performed and the material -actually furnished at the
following prices: For excavating and grading .eighty (80) cents
per cubic yard; for paving actually laid and put in place Three
and 22/100 Dollars (' 3.22) per square yard. All of said work
shall be paid for according to the measurement made by the City

Engineer of the City of Salina. It is hereby determined and
found that the prices to be paid for the improvements as
aforesaid is less than the estimated prices of each and all. of
said improverents as now, on file with the City Clerk of the City
of Salina, Kansas.
Section 4. Such. contract is awarded upon the express
condition that such work and improvements shall be done in strict
accordance with and in compliance with the plans and specifics=
tions of the City Engineer therefor, �rhi ch 'plans and specifica-
tions are hereby made a part of this ordinance and. the contract
awarded, and upon further conditions among others that the
persons to whom said contract is awarded. shall furnish to the
City of Salina a surety company bond in the approximate sum of
the cost of such improve,r_ents, guaranteeing the prompt, proper
and wrorkmianlike construction of all the same together with a
surety company bond, guaranteeing such pavement against all
defects in material and wrork,nanship for a period of five (5 )
years from the date of its completion and acceptance by said
City and said contract is awarded upon a further condition that
said persons shall furnish a good and sufficient surety company
bondrunning to the State of Kansas in an amount approximately
equal to the contract price of said improvements and conditioned
that said .persons shall pay all indebtedness for labor and material
furnished in making the improveiments provided for herein.
Section 5. The Board of Cornmissioners of the City of
Salina, Kansas, are hereby authorized to make and enter into in
behalf of said City all written agreements necessary in order to
secure the construction of the improve ;lents herein provided for.
Section G. This ordinance shall take effect and be in
full force from and after its publication. once in the official
City paper.

sons shall furnish a good and sufficient surety company bond running;
to the State of Kansas in an amount approximately equal to the contract price
of said improvements and conditioned that said persons shall paye all
indebtedness for labor and material furnished in making the improvements
provided for herein.
Section VC The. Board of Commissioners of the City of Salina,
Kansas, are hereby authorized to make and enter 'into in behalf of said
City all mitten agreements necess -pry in order to secure the construction
of the improvements herein provided for.

from, and after its publication once in the official City paper.
