An ordinance specifying and selecting the paving material to be
used and lettings a contract for the excavating, grading,
and paving of certain streets in the City of Salina,
Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that ASH
STREET in the City of Salina, Kansas, from the east line of the
Ash Street Bridge to the east line of Oakdale Avenue in said
City, shall be paved with one course vitrified vertical fiber
side wire cut brick paving blocks not less than three (3) inches
deep with asphalt filler, laid on a foundation five (5) inches
in depth of Portland Cement Concrete base with one (1) inch sand
cushion, such pavement within the limits above defined to be
.forty-one (41) feet in width froin gutter to gutter.
Section 2. All excavating, filling and rolling necessary
for the property construction of such improvements shall be done
and all of such improvements shall be made and done in strict -con-
formity to and in compli_ance,with the plans and specifications
heretofore made by the City Engineer of Salina, Kansas and now on
file with the City Clerk of said City, which said plans and spe-
cifications are hereby incorporated in and made a part hereof in
all respects as fully and completely as though written out at
length herein; which plans and specifications are hereby adopted
as and for the plans and specifications of such work and improve-
ments.
Section 3. That a
contract is
hereby
awarded
to G.
M.
Smith and Mat Graham, Jr.,
co-partners
doing
business
under
the
firm name and style of The Smith -Graham Construction Company, for
,the paving, excavating and filling the above mentioned streets in
the limits aforesaid with the materials hereinbefore specified,
for the paving actually laid and put in place, for the labor
actually performed and the material actually furnished at the
following prices: For excavating and grading eighty (80) cents
per cubic ,yard; for paving actually laid and put in place Three
and 22/100 ($3.22) per square yard. All of said work shall be
paid for according to the measurement made by the City Engineer
of the City of Salina. It is hereby determined and found that
the prices to be paid for the improvements as aforesaid is less
than the estimated prices of each and all of , said improvements
as now on file with the City Clerk of the City of ,Salina, Kansas.
Section 4. Such contract is awarded upon the express
condition that such work and impx°ovements shall be done in strict

accordance with and in compliance with the plans and specifica-
tions of the City Engineer therefor, which plans and specifica-
tions are hereby made a part of this ordinance and of the contract
awarded, and upon further conditions among otlleis that the persons
to whom said contract is awarded shall furnish to the City of
Salina a surety bond in the approximate sum of the cost of such
improvements guaranteeing the prompt, proper and workmanlike con=
struction of all the same together with a surety company bond
guaranteeing such pavement against all defects in material and
workmanship for a period of five (5) years from the date of its
completion and acceptance by said City and said contract is award-
ed,upon a further condition that said persons shall furnish a good
and -sufficient surety company bond running tojthe State of Kansas
in an amount approximately equal to the con#ract price of said
improvements and conditioned that said persons shall pay all in-
debtedness for labor and material furnished in making the improve-
ments provided for herein.
Section. 5. The .Board of Commissioners of the City of
Salina are hereby authorized to make and en e

ments

Section. The Board of Commissioners of the City of Saling
are hereby authorized to make and enter into on behalf of. said City
all written agreements necessary in order to secure the construction
of the improvements jaerein' provided for.
Section '�� This ordinance shall take effect and be in full force
from and after its publication once in the official City paper.
