2573 Improving Elm Street1 1 C 1 1 - —-ORDIVA-ICE-NO-.-2573-.---- - -------- --;a1_Jna__RyerJng Journal Ligiist An ordinance providing for the excavating, grading and paving of Elm Street in the City of Salina, Kansas from the east line of T .ihirc? :street to the west line of Front Street, and pro- viding for the cost thereof, how the same shall be assessed and the manner of payment therefor. 11,HEREAS, by resolution duly adopted the 8th day of May, 1922 -the Board of Commissioners of the City of Salina, Kansas have declared that they deem it necessary to excavate, grade and pave Elm Street in the City of Salina, Kansas from the east line of Third Street to the west line of Front Street in said City, and v{dHEREAS, said resolution was published for six days in The Salina Evening Journal, a daily newspaper published in the City of Salina, the official City paper of said City, and WHLREAS, the majority of the resident property owners, owning a majority in square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date of the last publication of such resolution file with the City Clerk of said City their protest in writing against such, improvements or the making thereof, therefor, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that Elm Street'in the City of Salina, Kansas from the east line of Third Street to the west line of Front Street in said City be excavated and graded to the established grade thereof as estab- lished by ordinance of the City of Salina, Kansas, provided, that at the intersections of streets and alleys, said excavation and .grading shall be carried to the lot line of the street so im- -proved and that at such lot line the grade be made to conform to the established grade of such street or alley if the same has been established. Section 2. That it is necessary and it is hereby ordered that Elm Street in the .City of Salina, Kansas from the east line of Third Street to the west line of Front Street in said City be paved with such material as the Board of Commissioners may here- after designate and select as hereinafter provided for according to the specifications of the City Engineer of said. City herein - provided for, and that at the intersections of streets and alleys said paving be carried back to the lot line of the street so im- proved. Said street shall be paved for a width of forty-one (41) feet, excluding curb and gutter. Section 3. For the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 28th day of August 1922 complete pians and specific - ations for the paving of said street with the following materials: 1. 3 inch vertical fiber plain wire cut brick® 5 inch concrete base. Asphalt filler. 2. 2 inch asphaltic concrete. 5 inch concrete base' and that on or before the last said named date said City Engineer shall submit to the Board of Commissioners, under oath, detailed estimates of the cost of such paving of said street with the different kinds of material herein mentioned and of the excavation and grading of said street. Section 4. 'That after such plans and specification shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may ad- vertise by advertiserient published in the official City paper of the City of Salina for six consecutive days for the receipt of sealed proposals for the paving of said street with the different kinds of' paving material named and specified in the preceding section hereof, and for the excavating and grading of said street to the established, grade thereof as herein provided for; and after the receipt of such proposals the Board of Commissioners shall select .from the different kinds of street paving material, the kind with which said street ought, in their judgment be paved and said Board of Commissioners may and are hereby authorized to let contracts for the grading and excavating of said street to the lowest responsible bidder therefor, and for the paving of said street with the materials so selected to the lowest responsible bidder therefor, as determined by said Board of Commissioners for the kind and character of paving which shall.be determined upon by said -Board -of Commissioners and for such excavating and grad- ing; said Board of Commissioners reserve the right to reject any and all bids. Section_ 5. That for such paving special assessments shall be made for the full cost thereof on each block separately, on all lots or pieces of land to the center of the block on either side of the street, according to the appraised value thereof, without regard to the buildings or improvements thereon for the distance to be improved; the entire distance to be graded shall constitute one grading dpi_strict. 1 1 1 1 Section 6. That after the passage and publication of this ordinance the Board of CocTuissioners shall appoint three dis- interested appraisers, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improvements herein provided for shall within five days after having been notified of their appointment proceed to ap- praise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said City, without regard to.the buildings or improvements thereon, and after making such appraisement shall return same to the Board.of Commissioners at the first meeting of said Board after such appraisement shall have been completed, and after said appraisement is returned to the Board of Comm- issioners said Board of Commissioners.shall designate a time for the holding of a special session of such. Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which. special session due notice shall be given in the official City paper, at T,ahich special session the Board of Commissioners may alter the valuation of any lot or piece of land if in their opinion the same has been appraised too high or too low. Section 7. For the purpose of paying for the work the im- provements in this ordinance provided for,'the Board of Commiss- ioners are hereby authorized and directed to issue internal im- provement bonds of the City of Salina in an amount not to exceed .the contract price of such improvements and to run for a period of ten years and be payable in ten (10). equal installments, to- gether with the interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and,assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such im- provements and the apportionment therein contained shall hold good for all the installments that are to be -collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of 1 1 1 1 1 Section 10. For. the purpose of paying for the work and improve- ments in this ordinance provided for, the Board of Commissioners are hereby authorized and dim cted to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price of such improvements and to run for a pe riod 'of ten years and be payable in ten (10) equal installments, together with the interest not to exceed five (5) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as thby :severally become due and payable the Board of Commissioners shall apportion and ,assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all the. installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax appor- tioned to each tract, piece -and parcel of land within the taxing dis- trict and shall state the . number of annual installments .in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time taxes are to . be• certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on eaeh of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of six per cent per annum and such amounts so certified shall be collected as other taxes are collected; Provided, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys as well as trhere -5- the 5r the improv ement is through or adjacent to the property of the City for which the City would be liable, the assessment Ahall be made against all taxable property of the City and paid by the City at large.
