WHER AS, in pursuance of proceedings duly had according to law, contracts have been let and performed for the building and construction of the following described lateral sanitarry sewers and manholes together with .excavating and backfilling in the City of Salina, Kansas, to -wit: A lateral sanitary sewer in lateral sewer district # 1-A commencing,at a manhole at the intersection of Lincoln Avenue and'Eighth Street in said City, running thence easterly to an alley one hundred. seventy (170) feet, thence north in alley about six hundred (600) feet including two manholes and the necessary excavating and backfilling; A lateral sanitary sewer in lateral sewer District # 3-A commencing at a certain manhole on Harsh Street in alley between 11inth Street and Tenth Street in said City, running thence north in an alley to the center line of Hamilton Street therein, including one manhole and the necessary excavating and backfilling; A lateral sanitary sewer in lateral sewer District #' 1-C commencing at a certain manhole at the 'intersection of Spruce Street and College Avenue in said City running thence West on Spruce Street about three hundred fifty (350) feet including one manhole and the necessary excavating and backfilling; A lateral sanitary sewer in lateral sewer District #2-C commencing at a certain manhole on University Place east of the Missouri Pacific Right-of-way in said City running thence west on University Place to an alley west of Chicago Street therein including two manholes and the necessary excavating and backfilling; A lateral sanitary sewer in lateral. sewer District #3-C commencing at a manhole on University Flace in an alley be- tween Clark Street and Chicago Street in said City, one branch extending south in alley three, hundred seventy-five (375) feet t and another branch extending north in said alley eight hundred (800) feet including three manholes and the necessary excavating and backfilling; A lateral sanitary sewer in lateral severe district #4-C commencing at a certin manhole in the alley between Ash Street and State Street east of the Piissouri Pacific Railway in said City running thence west in an alley eleven hundred eighty (1180) feet including three manholes and the necessary excavating and backfilling; A lateral sanitary setter in lateral sewer district NF1 -E commencing at a certain sewer at the intersection of two alleys south of Park Place between Front Street and Oakdale Avenue in said City, running thence south two hundred fifty (250) feet, including one manhole and the necessary excavat- ing and backfilling; A lateral sanitary sewer in -lateral sewer district #2-E commencing at a certain sewer at the intersection of alleys - south of Gypsum Avenue between Penn Avenue and Columbia Avenue in said City and running thence south two hundred tin7enty-five (225) feet including one manhole and the necessary excavating and bad.kfilling; A lateral sanitary sewer in lateral sewer district 1-1'13-E commencing, at the existing; stub of sewer at the end of raving on Kansas A enue and iron Avenue running thence south on Kan- sas Avenue Five hundred (500) feet together with one manhole and the necessary excavating and backfilling; 5. A lateral sanitary sewer in lateral sewer District i4 -E eomm.eneing at the existing stub of sewer at the end of paving on Ohio Avenue and iron Avenue in said City run- ning thence north on Ohio Avenue to the center line of Johnstotivn Avenue therein including one manhole and the necessary excavating and backfilling; A _lateral sanitary sewer in lateral sewer district 7#1-F commencing at the esisitng end of sewer on Eleventh Street, two hundred twnety-five (225) feet south of Charles Street in said City, running thence south on Eleventh Street therein for the distance of two hundred (200) feet to- gether with one manhole and the necessary excavating and backfilling; A Lateral sanitary sewer in lateral sewer district #2-F conrnencing at a certain manhole at the intersection of Highland Avenue and Republic Avenue in said City, running thence west on Republic Avenue to the center line of Ninth Street.therein including one manhole and the necessary excavating and backfilling; A lateral sanitary sewer in lateral sewer district r�`r3-F commencing at a certain manhole at the intersection of South Street and Putnam Avenue in said City, running thence -south on Putnam Avenue to Morrison Avenue therein, together with two manholes and the necessary excavating and back- filling; A lateral sanitary sewer in lateral sewer District f1 -G commencing at the present manhole- in an alley between Beloit Avenue and Minneapolis Avenue in said City on the west side of Fourth Street running thence east in the alley to Osborne Street therein, including two manholes and the necessary excavating and backfilling; A lateral sanitary server in lateral sewer district #2-G coim?-encing at the present manhole at the intersection of Highland Avenue and Claflin Avenue in said City and running thence westerly to an alley two hundred (200) feet, thence south in said alley six hundred -(600) feet-, including three manholes and the necessary excavating and -backfilling; and WHEREAS, the cost of said improvements shall be paid by special assessments levied upon thelots and pieces of ground liable therefor and the-anount thereof has been ascertained and is hereby found and determined -to be the sum of 489161.99 which said -last amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground in the lateral sewer dis- tricts in said City liable'therefor,'payable in ten equal annual installments according to law and as provided in ordinances of the City of Salina heretofore duly passed and approved, and -11--IEREAS, the amount of said special assessments for which bonds are to be issued as herein provided in anticipation of said special assessments which remain unpaid has been ascertained and is hereby determined and found to be the sum of 67,102.65, the dif- ference between said last two named amounts having been paid by the property owners in said above named lateral sewer district whose property has been discharged from any furhter assessments for the cost bf said improvements in the amount paid, NO -VAI THEREFORE, 1 I.. 1 1 BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:. Section 1. That the cost of such said improvements, after deducting therefrom the assessments heretofore paid thereon as aforesaid, shall be paid in ten equal annual installments instead of levying the entire cost at one time; the first installment of which is to be Tnid with the taxes for the year 1922 and one in- stallment with the taxes for each succeeding year thereafter until the whole amount thereof shall have been paid and that for such installments there shall be,and are hereby issued improvement bonds of the City of Salina, Kansas in the aggregate sum of 47102.65 as hereinafter provided. Section 2. Said issue of bonds shall consist of one (1) -bond of the denomination of ;302.65 and nine (9 ) bonds 'of the denomination of X200.00 each and ten (10) bonds of the. denomination of $500.00 each, said bonds to be numbered from one to twenty (20) inclusive, all bearing interest at the rate of five per centum per annum, interest payable semi-annually upon the first day of April and upon the first day of October each year after the date of said bonds, which bonds shall be dated April lst,'1922, except the first interest payment on said bonds which shall be due and payable on the 1st day of April, 1923. Said bonds shall have interest coupons attzched thereto and said bonds shall be- come due and payable as follows: 8802.66 on the lst day of April 1923, ;700.00 on the lst day of April, in each succeeding year thereafter for a period of nine (9) years. Section 3. Said bonds shall be signed by the Mayor and shall be attested by the Clerk of the City of Salina, Kansas, and shall have the corporate seal of said City attached thereto. In- terest coupons to said bonds shall be signed by said Clerk and both bonds and coupons shall be paid at the fiscal agency of the State of Kansas in the City of Topeka, Kansas. Section 4. Said bonds shall be executed in the form and shall contain recitals substantially as follotRirs: UNITED STATES OF AP,TEFICA STATE OF KANSAS. CITY OF SALINA. NO. IM'd ALL MJR41 BY THESE PRESENTS, That the City of Salina in the County of Saline and State of Kansas, for value received hereby acknowledges itself to be indebted and promises to pay the sum of 0 in lawful money of the United States of America on the Ist day of April A. D. 19, with interest at the rate of five (5 ) per cent per annum, �e 41rst installment of .which shall be payable April lst, 1923, and interest payable semi-annually there• after until the principal sum shall have been paid upon the pre- sentation and surrender of -the proper interest coupon hereto attached, bearing the signature of the Clerk of said City, as they severally become due and payable. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond, have been properly drone and performed and do exist in regular form as required by the con- stitution and laws of the State'of Kansas, and that toatal in- debtedness of said. City including this series of bond, does not exceed any constitutional or statutory limit. The Mayor and Clerk are hereby authorized, directed and empowered without unnecessary delay to prepare and execute said bonds and coupons as in this ordinance providied and when executed, said bonds shall be registered with the Clerk of the City of Salina, Kansas and with the Auditor of the State of Kanszas, as required by law, and shall be by the Mayor of said City delivered to the contractor or contractors constructing such improvements in the proportions due such contractor or contractors in payment cf the amount due them fro such improve- ments or work; PROVIDED, however, that such bonds shall not be sold or delivered to such contractor or'contractors at less than par value thereof nor in a greater sum or amount than the whoele amount due to said contractor or contractors under their re- spective contracts with said city, or the Board of Commissioners may sell said bonds at not less than their par value and out of the proceeds thereof pay said contractor/or contractors for aaid work and improvements. Section: 7. Said Board of Commissioners shall make pro- visions for the payment of the principal and interest on said bonds as the same become due and payable by levying a tax on the property liable therefor. Section 8. This ordinance shall take effect and be of full force from and after its publication once in the official City paper. Introduced for first reading August 14th, 1922.
