2544 Levy Assessments1 Ll 1 u 1 _ ORDINANCE_N0. 2544.___ An Ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in t-j.e City of Salina, Kansas to pay the cost of curbing, guttering, excavating, grading and pavin Baker Street in said City from the South line of Walnut street 4. to the north line of South Street in said City, and relating to and providing for the collection and pay- ment of such assessments, BE IT ORDAINED by the Board of Commissioners of the City of Salina Section 1. For the purpose of paying the cost of curbirg guttering, excavating, grading and paving Baker. Street in the City of Salina, Kansas from the south line of Walnut Street to the north line of South Street in said City, there are here- by levied and assessecl on the property liable therefor, being all the lots and pieces of ground lying on either side of said Baker Street for the distance • im.proved as aforesaid to the center of the block on either side tYioreof, according to the appraised value of such lots and pieces of ground, without re - gard to the buildings or improvements thereon, special assess- ments covering the cost of such work and improvements; said special assessments being based on the special valuation and appraisement of s:,i d lots and pieces of ground heretofore made by three •disinter-ested appraisers, a ppointed 'by the Board of Comrf!issioners of the City of Salina, Kansas, which said appraise- went'is :hereby referred _to and rnade a part of this ordinance, and the several amounts levied, apportioned and assessed against each of said lots and pieces of ground for the pur- pose aforesaid are. hereby found and determined to be as follows; EA ;T SIDE OF BAKER STREET FROM WALNUT STREEIT TO SOUTH ST. Said amounts levied, apportioned and assessed aforesaid, shall be due and collectible in ten (10) equal in- stallments, the first becoming due with the taxes levied for the .. year 1922, and. one .of said installments falling due each and every year thereafter until all are paid, and all to be collected with. -interest as in this ordinance provided; PROVIDED,. that the owner of any piece of property liable for any such special assess- ment may redeem his property from such liability by paying into the City Treasury the entire amount 'chargeable against the same as in tliis ordinance designated, at `Rny tiEe within thirty (30) days after the publication of this ordinance end before the issu- ance -of the bonds of said City in payment of the balance of the cost of said -improvements, and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improvement -s•; 'nor for any part of said bonds. There is hereby further levied and assessed againateach lot -and niece of ground described in this ordinance six (6) per cent interest per annum on ill of said installments 1 1 1 1 1 1 1 1 therein mentioned from the date of the bonds which may be issued at the end of thirty days as specified in the pre- ceding section hereof, as by law provided, to the time of collection of the last of said installments as provided by lave, which said interest shall be collected annually at the same time and in the same manner as said installments are collected; and after tie taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually, at the same time other taxes are certified, and until all of said assessments so apportioned and levied K herein ha°.,e been certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property l.ia.- ble to assessment and taxation for such work and improvement except such, property on which the special assessments afore- said have been paid in full, as hereinbefore provided, to- gether with the respective amounts due on each of such lots and pieces of ground, which €mounts shall include the annual installments of such special assessments together with the int- erest for one year at the rate of six (6) per cent per annum, on all unpaid balances of such assessments at the begin _',ng of each such year as aforesaid, and such arnounts so certified as herein prodded shall be placed upon the tax roll by the County Clerk of Saline County, Kansas and collected as all other taxes are collected. Section 4. Said amounts levied, apportioned and assessed aforesaid, shall be due and collectible in ten (10) equal in- stallments, the first becoming due with the taxes levied for the year 1922, and one of said installment's falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance provided; PROVIDED, that the owner of any piece of property liable for any such special assess- ment may redeem his property from such liability by paying into- the ntothe City Treasury the entire amount chargeable against the same as in this -ordinance designated, at any time within thirty (30) days after the publication of this ordinance and before the issu- ance of the bonds of said City in payment of the balance of the cost of said improvements, and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements, nor for any part of said bonds, Section 3. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance six (6) per cent interest per annum on all of said installments therein mentioned from the Gate of the bonds which may be issued at the end of thirty,days as specified in the preceding section hereof, as by law provided, to the time of collection of the last of said installments as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected; and after tele taking efff�et of this ordinance it shall be the duty of the City C1eflk of said City to annually, at the game time other taxes are certified, and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of Saline County, Kansas, a.full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full., as hereinbefore provided, together with the respective amounts due on each .of such lots and pieces of ground, Waich amounts shall include the annual installments of such special assessments togeth- er with the interest for one year at the rate of six (6) per cent per annum, on all unpaid balances of such assessments at the beginning of each such year as aforesaid, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected. Section 4. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading July 3rd, 1922.'
