An Ordinance providing for the construction of certain storm sewers
in.the City of Salina, Kansas, letting the contract therefor
and providing for the payment of the cost thereof.
WHEREAS, detailed plans and specifications have been prepared by
the City Engineer, filed in the office of the City Clerk and
approved by the Board of Commissioners for the building and con -
strutting of the following described storm sewers, and
a
WHEREAS, bid for the construction of such sewers have been hereto-
fore advertised for and received according to law and are now on file
with the City Clerk of said City, NOW THEREFORE,
BE IT ORDAINED by the Board of Commissionerso-
Section 1. That the Board of Commissioners deem it necessary
and hereby order that the following described storm sewers together
with the following described catch basins and manholes,be.-built and
constructed at and for the price and prices hereinafter mentioned for
each sewer to be built and constructed as follows:
A twelve inchIstorm sewer on Bond Street in the City of
Salina, commencin.g'at a point 200 feet west of Highland Avenue
in said City running thence west to Ninth Street at and
for the price of seventy (70) cents per lineal foot for
the number ofifeet of pipe actually laid and a t and for
the average price.,of not to exceed twenty (20) cents
per lineal foot for the excavating and backfilling act-
ually performed including one manhole at the end of the
sewer at and for the price of x¢45.00 together with two
catch basins in Ninth Street at and for the price of
$,50.00.
A twelve inch storm sewer on Republic Avenue in the ,
City of Salina, commencing at Highland Avenue in said
City running thence west to Ninth Street at and for the
price of 70 cents per lineal foot for the number of feet:
of pipe actually laid and at and for the average price
of 14 cents per lineal foot for the excavating and back-
filling actually performed including one manhole at the
end of said sewer at and for the price of $40.00 togeth-
er with four catch basins on Ninth Street at and for the
price of $100:00.
A twelve ineh�storm sewer on Otis Street'in the City of
Salina, commencing a. t. a point 110 feet west of Eighth
Street in said City, running thence in a northwesterly
direction to Ninth Street therein at and -for the price
of 70 cents per lineal foot for the number of feet of
pipe actually l laid and at and' for the average price of
not to exceedj14 cents per lineal foot for the excava-
ting and backfilling actually performed, together with
two manholes at and for the price of $80.00 together
with two catch basins -on said'Ninth Street at and for
the price of $50.00.
A ten inch storm sewer on Ninth Street in the City of
Salina commencing at an alley south of Beloit Avenue in
said City at and for the price of 55 cents per lineal
foot for the nutiiber of feet of pipe actually laid and
at and for the price of not to exceed 14 cents per lineal
foot for the excavating and backfilling actually performed
including one manhole at the ,end of said storm sewer at
and for the price of•$40.00'an d including three catch
basins on Ninih Street at' and for the price of $75.00.

Se.etion 2. The plans and specifications of the City
Engineer for the making of such sewers are -hereby adopted.and
approved as and for the making of such improvements and are
hereby made a part of this ordinance, and all of the work
herein specified and provided for shall be done in strict
accordance with such plans and specifications and under the
direction of the City Engineer or his duly authorized assis-
tants.
Section 3. The contract .is hereby let to' Amerman &
Snyder for the building and construction of the sewers and
manholes hereinbefore described, including the performance of
all work and labor and the supplying of allmaterial necessary
therefor, at and for the prices hereinbefore mentioned,, and
upon the condition that said work and labor shall be performed
and materials supplied and said sewers constructed strictly
in accordance with the plans and specifications of the said
City Engineer as hereinbefore referred to.
Section 4. It is hereby found and determined that the
prices hereby agreed to be paid forllleach of said sewers and
manholes is less than the estimatedidcost of such sewers and
manholes as shown by the estimates therefor made by the City
Engineer relating to the same and now on file with the City
Clerk of said City.
Section 5. Such contract is lawarded to the persons
above named upon the express condition that such persons shall
execute a written contract with thei!City of Salina, calling for
the building and construction of said sewers and manholes in
the manner And at the prices hereinbefore mentioned and strictly
in accordance with said plans and specifications of said City

Engineer, and upon further condition that the persons to whom
said contract is awarded shall furnish to the City of Salina
a good and sufficient Surety Company bond in the approximate
sum of the cost of said improvements guaranteeing the prompt

proper and workmanlike construction�iof all of the same, to-
gether with a good and�suffieient Surety Company bond in a sum
equal to 100 per cent of the approximate cost of said improve-
ments, guaranteeing such improvements against all defects
in.materials and workmanship for a period of one year from
the date of their completion and acceptance by said City,
together with a good and sufficient'il,surety Company bond ru.nn-

ing to the State of Kansas and satisfactory to the Clerk of the

District Court of Salim County, Kansas, in an amount approximate
to the cost of said improvements and conditioned that said persons
shall pay all indebtedness for labor and material furnished for
making the improvements provided for herein.
Section 6. The Board of Cormnissioners and proper officials
of the said City of Salina are hereby authorized to make and enter
into in behalf of said City all written agreements necessary to
be made -in order to secure the construction of the improvements here-
in provided for
Section 7. That complete payment of the sums due for the
improvements herein provided for shall not be made to Amerman &
Snyder until thirty days shall have elapsed from' and after the
filing by the said City Engineer of said City, in the office of the
City Clerk thereof, final estimate of the entire cost of said
improvements and of the sums due therefor, nor until the final
approval and acceptance of said improvements by the Board of Com-
missioners of the City of Salina, Kansas., by resolution therefor,
and all of said work shall be paid for according to the measure
and estimate of said City Engineer, PROVIDED, however, that a final
estimate may be filed by said City Engineer in regard to any
separate portion of said improvements when completed without re-
gard to the completion of other separate portions thereof and
that acceptance of any payment for separate portion of said improve-
ments may be made by said City upon completion without awaiting
the completion of all of the improvements herein provided for.
Section 8. The cost and expense of -constructing such
'-sewers and manholes shall be assessed against all lots and pieces of
ground contained in the City of Salina as a sewer district, as provided
by Ordinance No 613, passed and approved December 23rd, 1887,
and the Board of .Commissioners are hereby authorized to provide for
the cost of construction thereof by installments instead of levying
the entire amount due at one time, and for such installments they
may issue sewer improvement bonds of the City of Salina, payable
in installments of equal amounts in each year, none of which bonds
nor the installments shall run longer then ten years or bear
interest to exceed the rate of five per cent per annum and such
bonds may be delivered to the Contractor building such sewers
in payment thereof, or the Board of Commissioners may sell such
bonds. at not less than- their par value and out of the proceeds thereof

pay said Contractor., and for the purpose of paying.prinei-pal
and interest on said bonds,, as they severally become due
the Board of Commissioners each year during the life of such
bonds levy an assessment or special, tax against all taxable
real property in said City of Salina, at the assessed value
thereof for general revenue purposes., ins an amount sufficient
to pay the principal and interest on said bonds for that year;
and the City Clerk shall certify said assessments and special
assessments, as they are severally llniade and levied as afore-
said, to the County Clerk of Saline County, Kansas, at the same
time and in the, same manner as other City taxes are -certified.
Section 9. This ordinance shall take effect and be in
full force from and after its publLtion once .in the official
City paper.

An.Ordinance providing for the construction of certain storm sewers in
the City of Salina, Kansas.letting the contract therefor and
providing for payment of the cost thereof.
WHEREAS, detailed plans and specifications have been prepared by the

following described storm sewers, and
WHEREAS, bid for the construction of such sewers have been heretofore
advertised for and received according to law and are now on file with
the City Clerk of Salina, Kansas, NOW TEEREFORE9,
BE IT ORDAINED by the Board of Commissioners.
Section lo- That the Board of Commissioners deem it necess-
ary and hereby order that the following described storm sewers to-
gether with the following described catch basins and manholes be
built and constructed at and for the price and prices hereinafter
mentioned for each sewer to be built and constructed as follows:
A twelve inch storm sewer on Bond Street in the City of
Salina, commencing at a point 200 feet west of Highland
Avenue in said City running thence west to Ninth Street
at and for the price of seventy (70) cents per lineal foot
for the number of feet of pipe actually laid and at and
for the average`price of not to exceed twenty (20) cents
per lineal foot for the excavating and backfilling act-
ually performed, including one manhole at the end of the
sewer at and for the price of Forty-five Collars ($45.00)
together with two catch basins on Ninth Street at and for
the price of Fifty and no/100 Dollars ($50.00).
A twelve inch storm sewer on Republic Avenue in the City of
Salina, commencing at Highland Avenue in said Cit -y, running
thence west to Ninth Street at and for tY.,6-, price of seventy
(70) cents per lineal foot for the number of feet of pipe
actually laid and at and for the average price of fourteen
(14) cents per lineal foot for the excavating and backfill-
ing^actually performed, including one manhole at the end of
said sewer at and for the price of Forty and no/100 Dollars,
($40.00) together with four catch basins on Ninth Street at
and for the price of One Hundred and no/100 Dollars ($100.00).
A twelve inch storm sewer on Otis Street in the City of
Salina, commencing at a point 100 feet west of Eighth
Street in said City, running thence in a northwesterly
direction to Ninth Street therein at and for the price of
70 cents per lineal foot for the number of feet of pipe
actually laid and at and for the average price of not to
exceed fourteen (14) cents per lineal foot for the excava-
ting and backfilling actually performed together with two
manholes at and fo.r the price of Eighty and no/100 Dollars
($80.00) together with two catch basins on said Ninth
Street at and for. the price of Fifty and no/100 Dollars
(060.00).
.A ten inch storm sewer on Ninth Street in the City of Salina,
commencing at an alley south of Beloit Avenue in said City
at and for the price of fifty-five (55) cents per lineal
foot for the number of feet of pipe actually laid and.at and
for the average price of not to exceed fourteen (14) cents
per lineal foot for the excavating and backfilling actually
performed including one manhole at the end of said storm
sewer at and for the price of Forty and no/100 Dollars($40.00)
and including three catch basins on Ninth Street at and for
the price of Seventy-five and no/100 Dollars ($75.00).
Section 2. The plans and -:specifications of the City Eng-
ineer for the making of such sewers are hereby adopted and approved as
and for the making of such improvements and are hereby made a part
of this ordinance, and all of . the work, herein specified and provided
for shall be done in strict accordance with such plans and specifica-
tions and under the direction of the City Engineer or his duly aiathor-
ized assistants.
Section 3. The contract is hereby let to Amerman & Snyder
for the building and contruction of the sewers and manholes herein -
before described., including the performance of all work and labor
and the supplying of all material necessary therefor, at and for
the prices hereinbefore mentioned, and upon the condition that said
work and labor shall be performed and materials supplied and said
sewers constructed strictly in accordance with the plans and specifi-
cations of the said City Engineer as hereinbefore referred to.
Section 4. It is hereby found and determined that the
prices hereby agreed to be paid for each of said sewers and manholes
is less than the estimated cost of such sewers and manholes as shown
by the estimates therefor made by the City Engineer relating to the
same and now on file with the City Clerk of said City.
Section 5. Such contract is awarded to the persons above
named upon the express condition that such persons shall execute a
written contract with the City of Salina, calling for the building
and construction of said sewers and manholes in the manner and at the
prices hereinbefore mentioned and strictly in accordance with said
plans and specifications of .said City Engineer, and upon further con-
dition that the persons to whom said contract is awarded shall fur-
nish to the.City of Salina a good and sufficient Surety Company bond
in the approximate sum of the cost of said improvements, guaranteeing
the prompt, proper and workmanlike construction of all of the same,
together with a good and sufficient Surety Company bond in a scam
equal to one hundred per cent (100%) of the approximate cost of said
improvements guaranteeing such improvements against all defects in.
material and workmanshipefor a period of one year from the date of
their completion and acceptance by said City, together with a good
and sufficient Surety Company bond running to the State of Kansas and
satisfactory to the Clerk of the District Court of Saline County,
Kansas, in an amount approximate to the cost of said improvements and
conditioned that said persons shall pay all indebtedness for labor
and material furnished for making the improvements provided for herein.
Section 6. The Board of Commissioners and proper officials
of the said City of Salina are hereby authorized to make and enter

ments herein provided.for shall not be made to Amerman & Snyder until

assessed value, thereof for general revenue purposes, in an amount
sufficient to pay the principal and interest on said bonds for that
year; and the City Clerk shall certify said assessments and spec-
ial assessments, as they are severally made and levied as aforesaid,
to the County Clerk of Saline County, Kansas at the same time and in
the same manner as other city taxes are certified.
Section 9, This ordinance shall take effect and be in
full fprce from and after its publication once in the.official City
paper,
