(_P_ubl.ishe_d_in the ' S_al.ina_Evening_J_our_nal_June l_0_,_192Z ®_) An Ordinance providing for the erection, construction and com- pletion of the Military Memorial Building for and in the City of Salina, Kansas and letting the contracts therefore THAT, WHEREAS, all acts, matters, things and conditions precedent to the letting of the several contracts necessary to be let for the building of the Military Memorial Building in the City of Salina, Kansas have been made, done and performed and WHEREAS, it is necessary that such building be built and constructed and that contracts be let and awarded therefore Now Therefore, BE IT ORDAINED by -the Board of -Commissioners of the City of Salina: Section 1. That such Military Memorial Building shall be built and located on the land and premises in the„City of'Salina, Kansas heretofore acquired by said City for such purposes in ac- cordance with the election and condemnation proceedings for said purpose heretofore held® Section 2. That such building as to its general construction be built and constructed in strict conformity to and in with the original plans, drawings and specifications (including the changes and amendments thereto and revisions thereof) adopted by the Board of Commissioners• of the City of.Sal ina, Kansas on the 1st day of May, 1922s all as made and prepared by Chas. Shaver, Architect of the City of Salina, Kansas, and in accordance with the exercise of such options and -privileges of adopting alternate types.of construction as may be exercised by said City in accordance with the provisions of said specifications and of the proposal and bid of the person to whom said contract is herein awarded, -and in conformity to and compliance with such.directions and instructions as may be given from time to time by such Architect as the Super- intendent of said building for and on behalf of said City, and such original plans, drawings and specifications, including the said amendments thereto and revisions thereof and including said options are hereby specially referred to and made a part of this ordinance in all respects and particulars as.if the same were written out in full herein. Section 3. That a contract be and is hereby let and awarded to,:.:OTTO PETERSON, LAWRENCE PETERSON and R. W. BURROWES co-partners doing business at Salina, Kansas under the firm name and style of The Peterson Construction Company for the furnishing of all labor and materials for and for the erection, construction and completion of the general construction of said Military Memorial 1 1 1 1 401 Building (excluding however the electrical wirings electrical apparatus, ventilation, plumbing and heating of said building) according to the plans., drawings and specifications mentioned and described in Section Two (2) hereof., at and for the. total contract sum or price of one Hundred Ninety -Nine Thousand Two Hundred Sixty - Five and 50/100 Dollars, ($199,265.50)9 which such contract sum or price so proposed to be paid therefor herein is the sum or price at which said Peterson Construction Company have by their written proposal of date of June 2nd, 1922 and now.on file in the office of the City Clerk of said City, agreed to acceptforthe erection, construction and completion of thegeneralconstruction of said Military Memorial Building.. and which sum is hereby found to be a fair and reasonable sum or price for the erections construction and completion of thegeneral construction of said building and less than the estimated cost or price thereof under the drawings and specifications aforesaid as made and shown by the written estimate thereof made by Chas. Shaver, Architect for said City,and now on file with the City Clerk thereof. Section -4. That the installation, placing, construction and completion of the electrical wiring and electrical apparatus in said Military Memorial Building be installed, placed, constructed and completed in strict conformity to and in compliance with the original plans, drawings and specifications, (including the changes and amendments thereto and revisions thereof) all as adopted by the Board of Commissioners of the City of Salinas Kansas on the lst day of May, 1922, all as made and prepared by Chas. Shavers Architect of the City of Salina, Kansas, ansas2 and in conformity to and compliance with such directions and instructions that may be, given from time to time by such architect as the superintendent of said building for and on behalf.of said City;. and such original plans,. drawings and specifications the with amendments thereto and revisions thereof aforesaid are hereby'apdoially'referred to and made a part of this ordinance in all respects and particulars as if the same were written out at length herein.' Section 5, That a contract be and the same is hereby let and awarded to R.. A. CASSELL., doing business at Salinas Kansas under the name and style of the R. A. Cassell Electric Company for the furnishing of all labor and materials for and for the installation, placing, erection and completion of all the electric- 02 al wiring and electrical apparatus in said Military Memorial Building according to the plans, drawings and specifications mentioned and . described in Section Four (4) hereof including the revisions there- of and amendments thereto, at and for the total -contract sum or price of Seven Thousand Eight Hundred Twenty -One and 13.-100 Dollars ($7,821.13) which such contract sum or price so proposed to be paid therefor herein is the sum or price at which said R. A. Cassell Electric Company have by their written proposal of date of June 2nd, 1922 -and now on file in the office of the City Clerk of City, agreed to accept for the furnishing of said labor and mater-, ials and for the installation, placing, erection and completion of said electrical wiring and electrical apparatus in said Military Memorial Building according to said plane drawings and speci- fications including the revisions thereof and amendments thereto,. and which contract price'is hereby found to be a fair and reason- able sum or price to be paid for the contract herein let, and less than the estimated cost or price of such installation, placing, erection and completion under the drawings and specifications afore- said as made and shown by the written estimate thereof made by Chas. Shaver, Architect for the City of Salina, Kansas and now on file with the City Clerk thereof. Section 6. That the heating, ventilation and plumbing systems of such Military Memorial Building shall be built and eon- structed in strict conformity to and in compliance with the origin- al plans, drawings and specifications (including the changes, eliminations and amendments thereto and revisions thereof) adopted by the Board of -Commissioners of the City of Salina, Kansas on the 1st day of May, 1922 as made and prepared by Chas. Shaver, Architect of the City of Salina, Kansas, and in conformity to and compliance with such directions and instructions that may be given from time to time by such Architect as the Superintendent of such building for and on behalf of said city; and such original plans, drawings and specifications with the changes, eliminations and amendments thereto and revisions thereof -aforesaid are hereby specially referred to and made a part of this ordinance in all respects and particulars as if the same were written out at length herein. Section 7® That a contract be and the same is hereby let and awarded to F. D. KASTNER doing business at Salina.. Kansas under the name and style of The City Plumbing Company of Salina, Kansas for the furnishing of all.labor and materials for and for 0 11 1 1 1 1 1 the installation, placing, erection and completion of the heating ventilation, and plumbing systems in said Military Memorial Build- ing according to the plans, drawings and s,pecifieations mentioned and described in Section Six (6) hereof (including the said changes eliminations and amentments thereto and revisions thereof) at and for the total contract sum or price of Nineteen Thousand Five Hundred and 14/100 Dollars ($19'500.14) which said contract sum or price so proposed to be paid '.therefor herein is the sum or price at which such City Plumbing Company have by their written proposal of date of June 2nd, 1922 and now on file with the City Clerk of said City, agreed to accept for the installation, plac- ing erection and completion of said heating, ventilation and plumbing systems aforesaid, and which sum is hereby found to be a fair and reasonable sum or price for th e.contract herein let,' and is hereby found to be less than the estimated cost or price therefor .under the drawings, and specifications aforesaid, includ- ing said changes and amendments thereto and revisions thereof, as made and shown by the written estimate thereof made by Chas. Shaver, Architect for the City of Salina, Kansas and now on file with the City Clerk thereof. Section 8. That in each and all of the several contracts herein let and awarded that the City of Salina, Kansas shall have and possess the right, option and privilege of exercising the several options as shown in the original plans and specifications at and for the sum and amount as shown in the bid.or proposal of the Contractor to whom said contract,is so awarded herein; and that said City shall have the right and privilege, wherever a change has been made.in the original plans and specifications as provided for by the changes, eliminations and amendments and revisions hereinbefore mentioned, to reinstate the construction as shown on the original plans and specifications at the price and sums shown by the Contractors bid therefor. Provided, however, tht that said City shall not exercise any such optionor reinstate any such original construction.at a time which will occasion the Contractor penuniary loss or cause delay in the work nor unless it shall at the time thereof a.etually have and possess requisite funds lawfully available for the payment of the additional cost therefor, s Section 9. That each of the several Contractors to whom the various contracts are herein awarded shall furnish to the City of Salina, Kansas on or before and not later than fifteen.days from and after the date of the taking effect of this ordinance a good and sufficient Surety Company Bond running to the City of Salina in the full amount of the contract price of such contractors work herein severally provided for, subject to the approval of the Board of Commissioners of said City and conditioned upon the faithful performance by the Contractor furnishing said bond of all the terms of his contract awarded herein; and that each of said contractors shall on"or before and not later than said date furnish and file in the office of the Clerk of the District Court of Saline County, Kansas a good and sufficient Surety Company Bond running to the State of Kansas in the full amount of the contract price of said Contractors work herein severally provided for, subject to the approval of said official and'of the Board of Com- missioners of said City and conditioned upon the full 'payment by - the Contractor furnishing such bond of the cost of labor and materials used in the work for Which the contract is herein awarded him. That the furnishing of said bonds by the several parties to whom such contracts are herein awarded and within the time aforesaid shall be and is hereby made a condition precedent to the liability of said City under the several contracts herein awarded. Section 10. It is hereby ordered and directed that con- tracts betweenthe City of Salina,, Kansas and the Contractors hereinbefore named be prepared in accordance with the provisions of the several sections of this ordinance and the plans, drawings and specifications aforesaid and that such several contracts when so prepared shall be executed for and on behalf of said City by the mayor and City Clerk thereof. Section 11. This ordinance shall take effect and be in full force from and after its publication once in the Salina. That in each and all of the several contracts herein let and awarded that the City of Salina, Kansas shall have and possess the right, option and privilege of exercising the several options as.shown in the original plans and specifications at and_for the sum.and amount as shown in the bid or proposal of the contractor to whom said contract is so awarded herein; and that said City shall have the right and privilege, wherever a change has been made in the original plans and specifications as provided for by the changes, eliminations and amendments and revisions hereinbefore mentioned, to reinstate the construction as shown on the original plans and specifications at the prices and sums shown by the contractors bid therefor. Provided, however, that said City shall not exercise any such option or reinstate any such original construction at a time which will occasion the contractor pecuniary loss or cause delay in the work nor unless it shall at the time thereof actually have and possess requisite funds lawfully avail- able for the payment of the additional cost therefor. Seetion.9.
