BE _IT ORDAINED by the Board of Commissioners of the City of Salina Kansas: Section 1. The office of Electrical Inspector in and for the City of Salina, Kansas is hereby created and. said office shall k - be filled by appointment of the City' lvlanager, within thirty days after the passage and publication of'this ordinance. Said Elec- trical Inspector shall be a competent electrician and well versed in the rules and requirements of the,National Electrical Code. Before assuming authority conferred by this ordinance the Elec- trical Inspector shall take oath usually administered to other City Officials and shall give -a bond of the City of Salina in the penal sum of One.Thousand.($-1,000'.00) Dollars, conditioned upon .the faithful performance of his duties. Provided however that the Chief of the Fire Department if qualified may.. at the discretion of the City Ma Hager be appointed as such Electrical Inspector, in which event however said, official shall receive no further or other salary or remuneration than that duehim as said Fire Dep artment IT -Chief. Section 2. Every corporation; co -partnership, association or individual owning or operating a line of wires over streets, alleys or buildings in this City shall use only wires that are suitable and strong; shall suitably and safely attach them to strong - and sufficient supports and insu.latel'them at all points of at- tachment; shall remove all wires abandoned.for use; shall suit- ably insulate every wire where it enters a building and if such wire is other than wire designed to carry an electric light or power current, shallattach to it at suitable and convenient points in the circuit, a calculated to prevent danger from. fire and near the place of entering the building, an appliance calculated to prevent at all times a current of electricity of such intensity or volume as to be capable of injuring electrical instruments or causing fire from entering by means of such wire, beyond the point at which such appliance is attached.'' Section 3. No corporation, co -partnership, association of individuals or individual shall engage in the business or hold himself out to the public as engaged in the business of installing electrical wiring and apparatus to be used in connection with electrical lighting, heat or power within any building in the City of Salina without first appearing in person or by a duly author- ized representative at the office of the City Clerk and registering his name and address or the name and address of the corporation, co -partnership, association or individual represented, which act shall entitle the corporation, co-partnership,'Iassociation or individual so registered to receive a Certificate of Registration, Said Certificate of Registration shall entitle'the holder thereof to engage in the business of installing electrical wiring and apparatus within the limits of the City of Salina, provided how- ever, that no Certificate of Registration shall be issued until the corporation, co -partnership, association or individual regist- ered shall have filed with the City Clerk a good and sufficient Surety Company Bond in the penal sum of Five Hundred ($500.00) Dollars, conditioned upon the faithful performance of all con- tracts entered into for the installing of electrical wiring and apparatus and accompanied by an annual registration fee of Twenty - Five 025.00) Dollars.. Said Certificate of Registration shall be forfeited if the holder thereof shall fail or -refuse to com- ply with the provisions of any ordinance of this City covering the installation or maintenance of any electric wires or appara- tus. Section 4. The installation or*electrie'alwiring and appa- ratus for the utilization of electrical current shall be made in accordance with the then current issue of the National Electrical Code of the National Board of Fire Underwriters with the follow- ing modifications and improvements: (a) The installation of all entrance wiring used for lighting'°'purposes in commercial and business houses, shall be of the balanced three (3) wire type from outside of building to center of distribution. (b) A:11 service entrances shall be made in rigid metallic conduit, terminating on the outside in an approved weather proof fitting, and on the inside in an approved metallic externally operated safety entrance switch box. The service entrance wire shall be not less than Number ten (10) B & S guage copper with a suitable rubber or equivalent insulation for ,,the voltage of that class of service. i 1 1 1 1 1 (c) Approved metallic, conduit shall be used for inclosing all electric light and power wiring in new buildings, the re- wiring of old buildings and in any installation in old buildings or additions thereto located within the district known as the fire limits. (d) All wiring for electric light and power hereafter installed in churches, theatres, and other places used for pub- lic gatherings, garages designed for the occupancy of more than two cars, commercial houses and store buildings, manufacturing plants of all descriptions and apartment houses designed for the occupancy of more than three families, and all office buildings in the City of Salina shall be installed in metallic conduit or armoured cable approved by the National Board of Fire Under- writers. (e) All wiring for electrical power, electric ranges and rectifiers, in whatsoever location shall be installed in metallic conduit or approved armoured cable. (f) All safety metallic switch boxes referred to in Section (b) shall_ be of the safety inclosed type operated from the outside of the inclosure so marked as to indicate plainly without opening the enclosure whether the switch contained with- in is in the "on" or "off" position, and shall contain an approved service entrance switch and fuses. This box must be so arranged that it can be sealed. The main service fuse must be in place when the City Electrical Inspector makes his final inspection. He will then seal this main service box,,,' -Only the City Electrician or authorized employees of the Salina Light, Power .& Gas Company, or employees of the City Fire Department shall have the authority to break this seal for renewal of fuses or inspection. The seal must be replaced by the party breaking it. in case of emergency an electrical contract holding an active Certificate of Registra- tion or his employee may break the'seal to replace the fuse, but in such case, the City Electrician or the Salina Light, Power and Gas Company must be notified. In all cases the party so notified must make an inspection of the newly installed fuse and seal the entrance switch box. (g) Circuit or branch fuses must be installed on all wiring installations, in addition to the fuses called for in Section (f) and must be accessible to the customer, and of such size that they will protect the circuits connected'thei°eto. 13 (h) All wires running to out -buildings shall not.be less than Number 'Twelve (12) B & S Guage weather proof wire. (i) All circuits for operating motors below five (5) Horse Power and above 150 volts shall have starting and running fuses, shall be equipped with a saffety starting switch inclosed in a metal cabinet and exteranally operated and shall be equipped with cartridge fuses or approved Thermal cut-outs. (j) All circuits for operating motors above five (5) Horse Power capacity shall be equipped with a safetyswitch en- closed in a metallic cabinet and externally operated, equipped with cartridge fuses and a starting device approved by the Company to whose distribution system said installation is to,be connect- ed. (k) The requirements of the Company to whose system all installations or electrical wiring and apparatus are to be made relative to service entrance location, meter location, size of motor, kind of service available; etc. as long as they -do not conflict with any section of this ordinance or the National Elec- tric Code, shall be complied with by,the installation. Section 5. No corporations, co -partnerships, associations or individuals shall make any installation of wiring for the transmitting of electrical current for light, heat or power, or make any changes or additions to any wiring that has already been installed, in or upon any buildings in the City of Salina-with- out alina with -out the owner first obtaining a permit covering such work. A complete record shall be kept by the Electrical inspector of all such permits issued and he shall make, upon request, a thor- ough inspection of all work covered by such permits. Such in- spections shall be made in accordance with the rules of the - National Board of Fire Underwriters and Ordinances of the City of Salina that have been enacted or may hereafter be enacted and collect the following fees from the property owner requesting such inspection at the following rates: For the first 8 outlets for incandescent lamps or small portable appliances, ten cents (10�) per outlet; for the next thirty-two (32) outlets or small appliances, five cents (5�) each;,,and all over forty (40) outlets two cents (2d) each; for motors ten cents (10�) per Horsepower of manufacturers rating; for installing switches or additional ,outlets in old wiring, ten cents (10¢x) per outlet for the first eight (S) additional outlets, and five cents (5�.)-for each additional outlet; for electric signs of thirty ( 30 ) outlets or less ,seventy-five cents (75/) and for each additional light rl 1 1 1 1 i 1 1 1 1 39- I 9 - one cent (1�). All fees billed under the above 'schedule shall become due and payable to the City of Salina immediately upon the completion of the inspection and shall upon collection be paid into the general fund of the City of Salina by the Electric- al Inspector who shall take the receipt of the City Treasurer therefor. Section 6. No electrical company shall connect any wires to any buildings for electric service or current until there is presented to said company a certification of permission to make such connections in writing and signed by the Electrical Inspect- or. The Electrical Inspector upon completing the inspection of any installation of electric wiring shall place on the outside of the safety entrance,switch box a tag signifying that the in- stallation is ready for electrical service. If the Inspector finds any portion -of this entire installation contrary to any section of this ordinance or the--r3.les of the National Board of Fire Underwirters, he shall not place his tag of approval on the installation until the same is changed to meet such requirements. This requirement also applies to an old installation if building containing same has been moved from one location to another. Section 7. No wire or wires shall be installed, operated or maintained over any street, alley, sideswalk or building in this City which shall be liable to seriously interfere with the work of the Fire Department in the use of ladders or other apparatLE or which shall obstruct or render hazardous the use of fire escapes or which shall render any street, alley or sidewalk dangerous ar hzardous to any person traveling thereupon and on complaint of the Chief of Fire Department said obstructing, interfering or ha<;ardous wire shall be removed or properly re -arranged. Section 8. VTherever possible and expedient signal wires shall not be carried on the same pole or in dangerous proximity to high potential electric light or power wires and where a joint occupancy pole line composed of these two classes of systems cross each other, the high potential electric light or power wires shall be placed and maintaned not less than four',(4) feet above every signal wire, and where it is impossible to provide for such a separation, it shall.be the duty of the Electrical Inspector to arrange and enforce an equitable and safe alternative plan. Section Q. The said Electrical Inspector shall make a thor- ough inspection of all. electrically wired buildings within the City at least once in each year and where wires or appliances used therein are in dangerous or unsafe condition so as to endanger life or property or are deemed to be in interference with the work of the Fire Department, he shall notify in writing, the person firm or Company owning, using or operating them, giving them a suitable period of time in which to,place said defective wires or appliances in a safe, secure and non -interfering condition. Any person,,firm or company owning, using or operating said de- feerive wires or appliances, 'neglecting or refusing within said time to make the necessary repairs or changes and have the neces- sary work completed within the specified.time shall be deemed guilty of a violation of this ordinance. The Electrical Inspect- or shall then have authority to order the supplying Company to discontinue electric service to said defective wires or appli- ances until such defects shall be repaired in accordance with the requirements of this ordinance. Section 10. The Electrical inspector by and with the con- sent of the Board of Commissioners, shall have the power to deputize one or more assistants and each one of said assistants . shall in every case be known to be competent to discharge the duties of Electrical Inspector and the rights and privileges con- ferred upon the Electrical Inspector are hereby conferred upon each assistant to the Electrical Inspector when properly appoint- ed. Section 11.. The said Electrical Inspector or competent assistant appointed by him shall have the right during reasonable' hours to enter any building, manhole or sub -way in the discharge of his official duties, or for the purpose of making any test of the electrical apparatus or appliances therein contained, and for that purpose_he shall I?e given prompt access to all buildings private,or public and tl all manholes and sub -ways, on application to the company or individual owning or in charge or control of the same. Section 12. The Chief Engineer of the Fire Department or said Electrical Inspector, or a competent person delegated by them or either of them shall have the power to at once cause the removal of all wires, or the turning off of all electrical currents where the circuits interfere with the work of the Fire Department during the progress of a fire. The said Electrical Inspector is hereby authorized and empowered to cause the turning off of electric 1 1 ,q 1 1 1 current from all conductors or apparatus which are deemed by him to be in an unsafe condition or which have-not been installed in conformity with the provisions of this ordinance as provided in Section Nine (9). No corporation, eo-,partnership, association or individual or agent thereof, shall supply, or cause to be supplied any electric current to conductors or apparatus which has been deemed by said Electrical Inspector to be in an unsafe condition or which have not been installed in conformity with the provisions of this ordinance and. from which the said Elec- trical Inspector has caused the electric current to be turned off. Section 13. Any corporation, co -partnership, association or individual or agent thereof, desiring to place any pipe, sheet metal or other material within six inches of any electrical wire or wires installed for use in connection with electric light, het. or power shall, before proceeding with the execution of the work, obtain from the Electrical Inspector a permit therefor, and on completion of said work the said corporation, co -partnership, association or individual or agent thereof shall notify said Electrical Inspector who shall inspect the same and cause all wires to be placed in a safe and secure condition, porvided, how- ever, that nothing in this section shall be construed to refer to wires installed in approved iron conduit. Section 14. No corporation, co -partnership, association or individual shall install any wires for the carrying or the utilization of any electricity for light and power purposes in, any building in the process of construction until after all plumbing and heating connections have been installed. This shall not prevent the installation conduits or lead covered cable when same is embedded in concrete and must be installed prior to the pouring of the concrete. Section 15. No corporation, co -partnership, association or individual or agent thereof shall interfere with the Electric a1 Inspector or any competent person or persons lawfully deputiz- ed to assist him as hereinbefore provided, while in the perform- ance of duty and each such interference shall be deemed to consti- tute a separate offense within the intent and meaning of this ordinance. 39 1 Section 16. Any corporation, co -partnership, association, individual or agent thereof found guilty of violating any of the provisions of this ordinance or neglecting or refusing to comply with any orders or notice of the Electrical Inspector made pur- suant to the provisions of this ordinance shall be fined not less than Five ($5.00) Dollars nor more than Fifty ($50.,00) Dollars and the costs of prosecution for each and every offense. Section 17. That Ordinance Number 1300, Ordinance Number 1313 and Ordinance Number 1937, all ordinances of the City of Salina, Kansas together with all ordinances and parts of ordi- nances in conflict herewith be and the same are hereby repealed. Section 18. In event any portion of this ordinance shall for any reason be held to be void or invalid the same shall not effect or render imperative any other portion hereof. Section 19. This ordinance shall .take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, May 15th, 1922. Passed and approved .......... (d) All wiring for electric light and power hereafter installed in churches, theatres, and other places used for public gatherings, garages designed for the occupancy of more than two cars, commercial houses and store buildings, manufactur- ing plants of all descriptions and apartment houses designed for the occupancy of more than three families, and all office build- ings in the City of Salina shall be installed in metallic con- duit or armoured cable approved by the National Board of Fire Underwriters. • -4- (e) All wiring for electric power, electric ranges and rectifiers, in whatsoever location shall be installed in metallic conduit or approved armoured cable. (f) All safety metallic switch boxes referred to in Section (b) shall be of the safety inclosed type operated from the outside of the inclosure so marked as to indicate plainly without opening the enclosure whether the switch contained with- in is in the "on'' or "off" position, and shall contain an.iapproved service entrance switch and fuses. This box must be so arranged that it can be sealed. The main service fuse must be in place when the City Electrical Inspector makes his final inspection. He will then seal this main service box. Only the City Electrician or authorized employees of the Salina Tight, Pownr and Gas Company, or, employees of the City sire Department shall have the authority to break this seal for renewal of fuses or inspection. The seal must be replaced by the party breaking it. In case.of emergency an electrical contractor holding an active Certificate of Registra- tion or his employee may break the seal to replace the fuse, bu.t. in such case, the City Electrician or the Salina Light, Power and Gas Company must be notified.. In all cases the party so notified must make an inspection of the newly installed fuse and,seal the entrance switch box. (g) Circuit or branch fuses must be installed on all wiring installations, in addition to the fuses called for in Section (f) and must be accessible to the customers and of such size that they will protect the circuits connected thereto. (i) All circuits for operating motors below five (5) Horse Power and above 150 Volts shall have starting and. running fuses, shall be equipped with a safety starting switch inclosed in a metal cabinet and externally operated and shall be equipped with cartridge fuses or approved Thernal cut-outs. -5- (j)0 All.circuits for operating motors above five (5) Horse Power capacity shall be equipped with a safety switch-en- closed witchen- closed in a metallic cabinet and externally operated, equipped with cartridge fuses and a starting device approved by the Company to whose distribution system said installation is to be connected. (k) The requirements of the Company to whose system all installations of electrical wiring and apparatus are to be made relative to service entrance location, meter location, size of motor, kind of service available, etc. as long as they do not con- flict with any section of this Ordinance or the National Electric Code, shall be complied with by the installation. Section 5. No corporations, co -partnerships, associations or individuals shall make any installation '�,of wiring for the trans - witting of electrical current for light, heat or power, or make any changes or additions to any wiring that has already been installed, in or upon any buildings in the City of Salina without the owner first obtaining a permit covering such work. A complete record shall be kept by the Electrical Inspector of all such permits issued and he shall make, upon request, a thorough inspection of all work covered by such permits. Such inspections shall be made in accord- ance with the rules of the National Board of Fire Underwriters and Ordinances of the City of Salina that'have been enacted or may hereafter be enacted and collect the following fees from the proper- ty owner requesting such inspection at the following rates: For the first 8 outlets for incandescent lamps or small portable appli- ances, ten cents (10¢x) per outlet; for the next thirty-two (32) outlets or small appliances, five cents (5�) each; and all over forty (40) outlets, two cents (2¢) each; for motors ten cents (10¢x) per Horse: Povier of manufacturers rating; for installing switches or additional outlets in old wiring, ten cents (10¢) per outlet for the first eight (8) additional outlets, and five cents (5¢) 41 for.each additional outlet; for electric signs of thirty (30) out- lets or less seventy-five cents (75�) andfor each additional light one cent (IV,). All fees billed under the above schedule shall become due and payable to the City of Salina immediately upon the completion of the inspection and shall upon collection be paid into the general fund of the City of Salina by the Electric- al Inspector. who shall take the receipt of the City `treasurer therefor. Section 6. No electrical company shall connect any wires to any building; for electric service or current until there is presented to said company a certification of permission to make such connections in writing and signed by the Electrical Inspect- or. The Electrical Inspector upon completing the inspection of any installation of electric wiring shall place on the outside of the safety entrance switch box a tag signifying that the in- stallation is ready for electrical service. If the Inspector finds any portion of this entire installation contrary to any, section of this ordira nce or the rules of the National Board of Fire Underwriters, he shall not place his tag of approval on the installation until the same is changed to meet such requirements. This requirement also applies to an old installation if building containing same has been moved from one location to another. Section 7. No wire or wires shall be installed, operated or maintained over any street, alley, sidewalk or building in this City which shall be liable to seriously interfere with the work of the Fire Department in the use of ladders or other apparatus, or which shall obstruct or render hazardous the use of fire escapes, or which shall render any street, alley or sidewalk dangerous or hazardous to any person traveling thereupon and on complaint of the Chief of the Fire Department said obstructing, interfering or hazardous wire shall be removed or properly re -arranged. Section 8. TiVherever possible -and expedient signal wires shall not be carried on the same pole or in dangerous proximity to high potential electric light or power wires and where a joint occupancy pole line composed of these two classes of systems cross each other, the high potential electric light or pourer wires shall • -'7- 0 be placed and maintained not less than four (4) feet above every signal wire, and where it is impossible to provide for such a separation, it shall be the duty of the Electrical Inspect- or to arrange: and enforce an equitable and safe alternative plan. Section 9. The said Electrical Inspector shall make a thor- ough inspection of all electrically wired buildings within the City at least once in each year and where wires or appliances used therein are in dangerous or unsafe condition so as to endanger life or property or are deemed to be in interference with the work of the Fire Department, he shall notify in writing, the person, firm or Company owning, using or• operating them,-givi,ng them a suitable period of time in which to place said defective wires or appliances in a safe, secure and non -interfering condition. Any person, firm or Company owning. using or operating said de- fective wires or appliances, neglecting or refusing within said time to make the necessary repairs or changes and have the neces- sary work completed within the specified time shall be deemed guilty of a violation of this ordinance. The -Electrical Inspect- or shall then have authority to order the supplying Company to discontinue electric service to said defective wires or appliances until such defects shall be repaired in accordance with the re- quirements of this ordinance. Section 10. The -Electrical Inspector, by and with the con- sent of the Board of Commissioners, shall have the power to deputize one or more assistants and each one of said assistants shall in every case be known to be competent to discharge the duties of Electrical Inspector and the rights and privileges con- ferred upon the Electrical Inspector are hereby conferred upon each assistant to the Electrical Inspector when properly appoint- ed. Section 11. The said Electrical Inspector or competent assistant appointed by him shall have the right during reasonable hours to'enter any building, manhole or sub -way in the discharge of his officialduties, or for the purpose of making any test of the electrical apparatus or appliances therein contained, and for that purpose he shall be given prompt access to all buildings private or public and to all manholes and sub -ways, on application to the company or individual owning or in charge or control of the same . Section 12. The,Chief Engineer of the Fire Department or said Electrical Inspector, or a competent person delegated by them or either of them shall have the power to at once cause the removal of all wires, or the turning off of all electrical currents where the circuits interfere with the work of the mire Department during the progress of a fire. The said Electrical Inspector is hereby authorized and empowered to cause the turning off of electric current from all conductors or apparatus which are deemed by him to be in an unsafe condition or.which have not been installed in conformity with the provisions of this ordinance as provided in Section Nine (9). No corporation, co -partnership, association or individual or agent thereof, shall supply, or cause to be supplied any electric current to conductors or apparatus which has been deemed by said Electrical Inspector to be in an unsafe condition or which have not been installed in conformity with the provisions of this ordinance and from which the said Elec- trical Inspector has caused the electric current to be turned off . Section 13. Any corporation, co -partnership, association or individual or agent thereof, desiring tb. place any pipe, sheet - metal or other material within six inches of any electrical wire or wires installed for use in connection with electric light, heat or power shall, before proceeding with the execution of the work, obtain from the Electrical Inspector a permit therefor, and on completion of said work the said corporation, co -partnership, association or individual or agent thereof shall notify said Electrical Inspector who shall inspect the same and cause all wires to be placed in a safe and secure condition, provided, how- ever, that nothing in this section shall be construed to refer to wires installed in approved iron conduit. Section 14. No corporation, co -partnership, association or individual shall install any wires for the carrying or the utilization of any electricity for light and power purposes in any building in the process of construction until after all plumb- ing and heating connections have been installed. This shall not prevent the installation conduits or lead covered cable when same is embedded in concrete and must be installed prior to the pour- ing of the. concrete. Section 15. No corporation, co -partnership, association or individual or agent thereof shall interfere with the Electric- al Inspector or any competent person or persons lawfully deputized to assist him as hereinbefore provided, while in the performance of duty and each such interference shall be. deemed to consti- tute a separate offense within the intent and meaning of this ordinance. Section 16. Any corporation, co -partnership, association, individual or agent thereof found guilty of violating any of the provisions of this ordinance or neglecting or refusing to comply with any orders or notice of the Electrical Inspector made pur- suant to the provisions of this ordinance shall be fined not less than Five ($5.00) Dollars nor more than Fifty (`50.00) Dollars and the costs of prosecution for each and every offense. Section 17. That Ordinance Number 1300, Ordinance Number 1313 and Ordinance Number 1937, all ordinances of the City of Salina, Kansas together with all ordinances and parts of ordi- nances in conflict herewith be and the same are hereby repealed. • .-1U- �. Section 18.' In event any portion of this ordinance shall for any reason be held to be void or invalid the same shall not effect or render imperative any other portion hereof. Section 19.
