2496 Construction of SewersORDINANCE NUMBER 2496_. An Ordinance providing for the/construction of certain sewers in the City of Salina, Kans;.s,.letting the contract therefore, and providing for the payment of the cos t of the same . WHEREAS by certain resolutions duly adopted on the 27 th day of February, 1922, the Board of Comis sioners of the City of Salina, Kansas, have declared that the construction of certain lateral sewers, to be situate within the City of Salina, Kansas, and within certain l t eral sewer districts of said City, hereto- fore defined and created, all as hereinafter more particularly de- scribed, are improvements necessary to be rrrade and done, and WHEREAS said resolutions were, in each instance, published for six (6) consecutive days in The Salina Evening Journal, the official paper of the said City, and WHEREAS a majority of the resident owners of property, 'own- ing a majority in square feet of the lots of real estate liable to taxation for the cost of said meveral improvements, did not, withr}n twenty (20) days from the date of the last publication of said re- solutions, file with the City Clerk of said City, their protest in writing, against such improvements or the making thereof, and WHEREAS by Ordinance Number 2487 of said City, it has been provided that the sewers hereinafter describedshall be built and constructed and the cost thereof provided for as in said Ordinance set forth, and WHEREAS plans and specifications for said described sewers have been heretofore made and prepared by the City Engineer of the said City and filed with the City Clerk thereof and were by the Board of Commissioners of said City adopted on the 10th of April, 1922, as and for the plans and specifications under which said sewers shall be constructed and, :WHEREAS an estimate of the cost of the construction of said sewers has been heretofore made under oath by the City Engineer of said City, submitted to the Board of Commissioners thereof and filed in the office of said City Clerk, aid WHEREAS sealed proposals for the building and construction of said sewers, have been heretofore invited by advertisement in daily publication for the time required by law in the official City paper of said City, and WHEREAS Amerman & Snyder for and in consideration of the payment of the sums hereinafter mentioned have agreed to con- struct said sewers strictly in accordance with said plans and 1 1 1 1 1 1 specifications of said City Engineer, which plans and specifications are by reference hereby made a part of _this Ordinance, Now Therefore, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the Board of Corrmissioners of said City deem it necessary and therefore order that the follow- ing described sewers, including the manholes hereinafter mentioned, be built and constructed and at and for the price and prices hereinafter mentioned for each sewer so to be built and constructed as follows, to -wit: Seven hundred seventy-five (775) feet of ten (10) inch lateral sanitary sewer in lateral sewer district #1-A, coninencing at the present manhole at the intersection of Lincoln Avenue and Eighth Street in said City, run- ning thence easterly -to alley, one .hundred seventy (170) Beet, thence north in alley about six hundred (600) feet at arra for the price of fifty-five ($0..55) cents per lineal foot for the number of feet of pipe actually laid, and at and for the average price of not to exceed eighteen and one-half ($0.185) cents per lin- eal foot for to excavating and backfilling actually performed, including two manholes at and for the price of Forty ($40.00) dollars each and one manhole at and for th e pr ice of Forty -five ($45.00) dollars . Section 2. The plans and specifications of the City Engineer of the said City of Salina, Kansas, for the sewers in section one hereof described, dated the 10th day of April, 1922., and now on file with the City Clerk of said City, are hereby adopted and ap- proved as and for the plans and specifications\for'said sewers and are hereby made a part of this ordinance, az d all work, labor m d materials herein specified and described shall be done, performed and furnished strictly in accordance with said plans and specifi- cations and in no other manner and under the direction of the City Engineer. Section 3. The contract is hereby let to Amerman & Snyder for the building add construction of the sewers and manholes here- inbefore described, including the performance of all work and labor and the supplying of all material necessary therefor., at and for the prices hereinbefore mentioned, and upon the condition that said work and labor shall be performed and materials .supplied and said sewers.,, donstruct:ed.J.strictly}'inY. acco.r..dan:- b-ewitl sthe.c-plans and specifications of the said City Engineer as hereinbefore referred to. Section 4. It is hereby found and. determined that the prices 1 1 hereby agreed to be paid for each of said sewers and manholes is less than the. estimated cost of such sewers and manholes as shown by the estimates therefor made by the City Engineer relating to I the same now on file with the City Clerk of said City. Section 5. Such contract is awarded to the persons above named upon the express condition that such persons shall execute a written contract with the City of Salina, calling for the building and -construction of said'sewers and manholes in the manner and at the prices hereinbefore mentioned and strictly in accordance with said plans and. specifications of said City Engineer, and upon r 1 1 1 further condition that the persons to whom said contract is awarded shall furnish to the City of Salina a good and sufficient Surety Company bond in the approximate sum of the cost of said improvements guaranteeing the prempt, proper and workmanlike construction.of all of the same, together with a good and. sufficient Surety Company bond in a sum equal to 100 per cent of the approximate cost of said improvements guaranteeing such improvements against all defects in material and workmanship for a period of one year from the date of their completion and acceptance by said City, together with a good and sufficient Surety Company bond running to the State of Kansas and satisfactory to .the Clerk of the District Court of Saline County, Kansas, in an amount approximate to the cost of said iaaproverrnents and conditioned that said persons shall pay all indebtedness for labor and material furnished for making the improvements provided for herein. Section 6. The Board of Commissioners and proper officials of the said City of Salina are hereby authorized to make and enter into in behalf of said City all written agreements necessary to be made in order to secure the con- struction of the improvements herein provided for. Section 7. That payments of the sums due for the im- provements herein provided for shall. not be made to Amerman & Snyder until thirty days shallhave elapsed from and after the filing by the said City. Engineer of said City, in the office of the City Clerk thereof, of a final estimate of the entire cost of said improvements and of the sums due therefor, nor until the final approval and acceptance of said improve - ments by the Board of Commissioners of the City of Salina, Kansas, by resolution therefor, and .all of said work shall be paid .for according to the measure and estimate of said City Engineer, PROVIDED, However, that a final estimate may be filed by said City Engineer in regard to any separate portion of said improvements when completed without regard to the com- pletion of other separate portions thereof and that acceptance of any payment for separate portion of said improvements may be made by said Citu upon completion without awaiting the com- pletion of all of the improvements herein provided for. Section B. That the cost of the improvements to be Trade under the contract, hereby let shall be paid as provided .in Section Six (6) of Ordinance Number 2487 of the City of Salina, Kans as. Seven hundred (700) feet of ten inch lateral sanitary sewer in lateral sewer district #3-kz, commencing at the present manhole at the interseeticn'of South Street and Putnam Avenue in said. City, running thence south on Put- nam Avenue, to Morrison Avenue, therein, at and for the price of,fifty-five ($0.55) cents per lineal foot for the number of feet of pipe actually laid, and at and for the average price of forty-three 00.43) cents per lineal foot for all excavating and backfilling actually performed, with two manholes at and for the price of Seventy ($70.001 each. Six hundred ( 600) feet of ten (10) inch lateral sanitary sewer in lateral sewer district #1-G, commencing at the present manhole in alley between Beloit Avenue and Minnea- polis Avenue, in said City on the west side of Fourth Street, running thence east in alley to Gsborne Street therein, at and for the price of sixty-two ($0.62) cents per lineal foot for the number of feet of pipe actually laid, and at and for the average price of fourteen ($0.14) cents per lineal foot for the excavating and backfilling actually performed, with two manholes at and for the price of Forty ($40.00) dollars, each. Eight hundred (800) feet of ten (101inch lateral sanitary sewer in lateral sewer district #2-�-r, commencing at the present manhole at the intersection of Highland Avenue and Claflin Avenue in said City, running thence westerly to alley two hundred (200) feet, thence south in alley six hundred ( 600) feet, at and for the price of fifty-five ($0.55) cents per lineal foot for the number of feet of pipe actually laid, and at and for the average price of fourteen ($0.14) cents per lineal foot for an excavating and backfilling actually performed, with three manholes at and for the price of Forty ($;140.00) dollars, each. Section 2. The plans and specifications of the City Engineer of the said city of Salina, Kansas, for the sewers in section one hereof described dated the ^, / `M day of _,1922, and now on file with the City Clerk of said City, are hereby adopted and approved as A and for the plans and specifications for said sewers and are hereby made a part of this ordinance, and all work, labor and materials herein specified,and described shall be done, performed and furnish- ed strictly in' ac Gordan ee with said plans and specifications and in no other manner and under the direction of said City Engineer. Section 3. The contract is hereby let to Amerman' & Snyder for the . building and construction of the sewers ;and manholes here.inbe- fore described, including the performance of all work and labor and the supplying of all material necessary therefor, at and for the prices hereinbefore mentioned, and upon the condition that said work and labor shall be performed and materials supplied and said sewers constructed strictly in accordance with the plans and speci- fications of the said City Engineer as hereinbefore referred to. Section 4. It is hereby found and determined that the prises hereby agreed to be paid for each of said sewers and manholes is less than the estimated cost of such sewers and manholes as shown by the estimates therefor made by the City Engineer relating to the same and now on file with the City Clerk of said City. Section 5. Such contract is awarded to the persons above named upon the express condition that such persons shall execute a written contract with the City of Salina, calling for the building and con- struction of said sewers and manholes in the manner and at the prices hereinbefore mentioned and strictly in accordance with said plans and specifications of said City Engineer, and upon further condition that -- the persons to whom said contract is awarded shall furnish to the City of Salina a good and sufficient Surety Company bond in the approximate sump of the cost of said improvements guaranteeing the prompt, proper and workmanlike construction of all of the same, together with a good .&46 - and sufficient Surety Company bond in a sum equal to /4OoDNper cent of the approximate cost of said improvements guaranteeing such improve- ments against all defects in material and workmanship for a period of ti one year from the date,of their completion and acceptance by said City, together, .with a good and sufficient Surety Company bond running ,to the State of Kansas and satisfactory to the C1erk.of the.District Court of Saline County, Kansas, in an amount approximate to the cost of said improvements and conditioned that said persons.shall pay all indebtedness for labor and material furnished for making the improve- ments,provided for herein. Sectlon,6. The Board of Commissioners and proper officials of the said Oity of Salina are hereby authorized to make and enter into in behalf.of said City all written agreements necessary to be made in order to secure"the construction of the improvements, herein provided. for. Section 7. That payments of the -sums due for the improvements herein provided for shall not be made to Amerman & Snyder until 'thirty days shall have elapsed from and after the filing by the said.City Engineer of said City., in the office of the City.Clerk there- of, of a final estimate of the entire cost of said improvements and of the scans duer therefor., nor until the final approval and acceptance of said improvements by the Board of Commissioners of the City of Salina, Kansas, b; resolution,therefor, and all of said.work shall be paid for according to the measure and estimate of said City Engineer, PROVIDED; However, that a final estimate may be filed by.said City Engineer in regard to any separateportion of said improvements when completed without regard to the completion of other separate por- tions thereof and that acceptance of any payment for separate portion of said improvements may be made by said City upon completion without awaiting the completion of all_ of the improvements herein provided .for. Section 8. That the cost of the improvements to be made under the contract hereby let shall be paidds provided for in Section Six (6) of Ordinance Number.2487 of the City of Salina, Kansas. Section 9.
