2495 Selecting Paving Material1 1 1 _. ORDINANCE NUMBER 2495. An Ordinance specifying and selecting the paving material to be used and le tt ing a contract for the paving, excavating, curbing and guttering of certain streets in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby, determined that Bond Street in the City of Salina, Kans-_s, from the west line of Fifth Street to, the east line of Santa Fe Avenue in said City, shall be paved with one course vitirfied vertical fibre side wire cut brick paving blocks not less than three (3 ) inches deep, with a Texaco Asphalt Filler or fillerequally as good, laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch Sand Cush- ion., such pavement within the limits above defined to - be twenty -taro (22) feet in width from gutter to gutter. Section 2. That it is hereby detennined that Bond Street in the City of .Salina, Kansas, from the west line of Fifth Street to the east line of Santa Fe Avenue in said City shall be curbed and guttered with one piece combina- tion cement curb and gutter. Said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half (6j') inche's thick at the ; thr.oa,t;' with:'•_gutter twenty-four (24) inches wide; six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All excavating, filling and rolling neces- sary for the proper construction of such improvements shall be done and all of such improvements shall be made and done .in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which said plans and specifications are hereby incor- porated in and rmde a per° t hereof in all respects as fully and completely as though written out at length herein; which plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 44 That a contract is hereby awarded to U.M. Smith and Mat Graham Jr., co-partners doing business under the firm name arri style of The Smith -Graham Construction Company, for the paving, curbing, guttering, excavating and filling of the above mentioned streets in the limits afore- said with the materials hereinbefore specified, for the pav- ing actually laid and put in place and for the labor actually performed and the materials actually furnished at the follow- ing prices: for excavating and grading seventy-two cents (72�-) per cubic yard; for Portland Cement Concrete conbined curb and gutter eighty-two cents(820) per lineal foot; for paving ac- tually laid and put in place Three and 23/100 Dollars ($3.23) per square yard. All of said work shall be paid for. accord- ing to the measurement made by the City Engineer of the City of Salina. It is hereby determined aril found that the prices to be paid for the improvements as aforesaid is less than the es- timated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awarded.upon the express con- dition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifica- tions of the City Engineer therefor, which plans and specifica- tions are hereby made a part of this ordinance end of the con- tract awarded, and upon further conditions among others that the persons to whom said.contract is awarded- shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt.. proper and workmanlike construction of all the same together with a surety company bond guaranteeing such pavement against all de- fects in material aid workmanship for a period of five (5) years from the date of its completion and acceptance by said City; end said contract is awarded upon a further condition that said persons shall furnish the City of Salina a good and suffi- cient surety company bond guaranteeing said curb and gutter against all defects in material acrd workmanship for a period of two (2) years from the date of its completion and acceptance of such work by said City; together with a good and sufficient surety company bond running to the state of Kansas in an amount approximately equal to the contract price of said improvements and conditions that said parsons shall pay all indebtedness for labor and material furnished in making the improvements provided for herein. 1 1 1 Section 6. The Board of Conmmissioners of the City of Salina are hereby authorized to make and enter into on be- half of said City all written agreements necessary in order to secure the construction of the improvements herein, provided for. Section 7. This ordinance shall take effect and be in full force from and after it s publication once in the official City paper. Introduced for first reading April 24th, 1922.
