ORDINANCE NUMBER 2493.
An Ordinance specifying and selecting the paving material to
be used and letting a contract for the paving, excavat-
ing, curbing and guttering of certain streets in the City of
Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas: S
Section 1. That it is hereby determined that Republic
Avenue in the City of Salina, Kansas, from the east line of
Fifth Street to the east line of Santa Fe Avenue in said City,
shall be paved with one course vitrified vertical fiber side
wire cut brick paving blocks not less than three (3) inches
deep, with a Texaco Asphalt Filler or filler equally as good,
laid on
a foundation
five
(5)
inches in
depth of Portland
Cement
Concrete base
with
one
(1) inch
Sand Cushion,.such pave-
ment within the limits above defined to be thirty-three (33)
feet in width from gutter to gutter.
Section 2. That it is hereby determined that "Republic
Avenue in the City of Salina,. Kansas, from the east line of
Fifth Street to the east line of Santa Fe Avenue in said City,
shall be curbed and guttered with one piece combination cement
curb and gutter. Said combined curb and gutter shall be com-
prised of a curb six (6) inches thick at the top and six and one-
half (62) inches thick at the throat, with gutter twenty-four
4 24) inches wide, six (6) inches thick aia the throat and seven (7)
inches thick next to the pavement.
Section 3. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict con-
formity to and in compliance with the plans and specifications
heretofore made by the City Engineer of Salina, Kansas, and now
on file with the City Clerk of said City, which said plans and
specifications are hereby incorporated in and made a part hereof
in all respects as fully and completely as though written out at
length herein; which plans and specifications are hereby adopted
as and for the plans and specificAti,ons of such work and im-
provements.
Section 4. That a contract is hereby awarded to G.M. Smith
and Mat Graham, Jr . , co-partners doing business under the firm
name and style of The Smith -Graham Construction Company, for
the paving, curbing,. guttering, excavating and filling of the
above mentioned streets in the limits aforesaid with the mater-
ials hereinbefore specified, for the paving actually laid and
put in place and for the labor actually petformed m d the
materials actually furnished at the following price: for exca-
vating and grading seventy-two cents (72�) per cubic yard; for
Portland Cement Concrete combined curb and gutter eighty-two
(820) per lineal foot; for paving actually laid and put in
place Three and 23/100 Dollars ($3.23) per square yard. All
of said work shall be paid according to the measurement madeby
the City Engineer of the City of Salina. It is hereby deter-
mined and found that the prices to be paid for the improvements
as aforesaid is less than the estimated prices of each and all
of said improvements as now on file with the City Clerk of the
City of Salina, Kansas.
Section 5. Such contract is awarded upon the express con-
dition that sueh,work and improvements shall be done in strict
accordance with and in compliance with the

specific-
tions of the City Engineer therefor, which
plans
and
specifica-
tions are hereby made a part of this ordinance and of the con-
tract awarded, and upon further conditions among others that the
persons to whom said .contract is awarded shall furnish to the
City of Salina a surety company bond in the approximate sum of the
cost of such improvements guaranteeing the prompt, proper and
workmanlike construction of all the same together with a surety
company bond guaranteeing su,h pavement against all defects in
material and workmanship for a period of five (5) years from the
date of its completion and acceptance by said City; and said con-
tract is awarded upon a further condition that said persons shall
furnish the City of Salina a good and sufficient surety company
bond guaranteeing said curb and gutter against all defects in
material and workmanship for a period of two (2) years from the
date of its completion and acceptance of such work by said City;

together with a good and sufficient surety company bond running
:to the State of Kansas in an amount approximately equal to the
contract price of said improvements and conditioned thA, said per-
sons shall pay all indebtedness for labor and material furnished
in making the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina
are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the con-
struction of the improvements herein provided for.

Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the -official City
paper.

improvements guaranteeing the prompt,' proper and workmanlike con-
struction of all the same together with a surety eompanybond guar-
anteeing such.pavement against all•defects in material and workman-
ship'for a period of five (5) years from the date of its completion
and acceptance by said City; and said contract is 'awarded upon
a further condition that said persons shall furnish the City of
Salina'a.good`and.sufficient surety company bond guaranteeing
said curb and gutter against all defects in material and workman-
ship for a . period of two (2) years from the date of its completion
and acceptance of such work by said City; together with a good and
sufficient surety company bond running to the State of Kansas in
an amount approximately equal to the contract price of said
improvements and conditioned -that said persons shall pay all
indebtedness for labor and material furnished in making the im-
provements provided for herein.
Section 6 The.Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements'necessary in order to secure
the construction of the°improvements herein provided for.
Section 70 This ordinance shall take -effect and be in
full force from and after its publication once in the official
City paper.
