An Ordinance providing for the construction of certain sewers
in the City of Salina, Kansas.
WHEREAS, by certain resolutions duly adopted on the 27th
day of February 1922, the Board of Conxrissioners of the City
of Salina, Kansas, have declare d that the construction of cer-
tain 1,,ateral sewers to be situate within the City of Salina,
Kansas, and within certain lateral sewer districts of said
City asheretofor e provided by ordinance are improvements nec-
essary to be made, and
WHEREAS, said resolutions in each instance were published
for six consecutive days in the Salina Evening Journal, a
daily newspaper published in the City of Salina, the.official
City paper of said City, and
WHEREAS$ the majority of the,resident owners of proper-
ty owning a majority in square feet of the lots or real es-
tate liable to taxation for the cost of said improvements did
not within twenty days from the date of the last publication
of any such resolutions file with the City Clerk of said City
their protest in writing against such improvements or .the
making thereof, Therefore,
BE IT ORDAII\IED by the Board of Cor=is sioners of the City of
Salina, Kansas;
Section 1. That the following described sewers be con-
structed, laid and built in the City of Salina, Kansas, to -wit;
A 10 -inch sanitary sewer lateral in Lateral Sewer Dis-
trict No.l-A, commencing at the present manhole at the inter-
section of Lincoln Avenue and Eighth Street in said City,
running thence easterly to alley 170 feet, thence north in
alley about 600 feet. Manholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral. Sewer dis-
trict No.2-k, commencing at the present -manhole at the inter-
section of Lincoln Avenue and 'Tenth street in said City, thence
running westerly to alley 170 feet, thence north in alley 480
ft. Manholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No. 3-A, commencing at the present manhole on Harsh btreet in
the alley between Ninth Street and Tenth Street in said City
running thence north in the alley, to center line of Hamilton
Street. Ivlanholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer dis-
trick No.l-C, commencing at the present manhole at the inter-
section of Spruce Street and College Avenue in said City,.run-
ning thence west on Spruce Street about 350 feet. Manholes as
designated on plans.
A 19 -in "ch sanitary sewer lateral in Lateral Sewer Dis-
tricit No.2-C, commencing at the present manhole on University
Place east of Missouri Pacific Railway in said City, running
thence west onUniverstty Place to 'alley west of Chicago Street
therein. Manholes as designated on plans.
. A 10 -inch sanitary sewer lateral in Lateral Server Dis-
trick No.3-C; commencing at the proposed manhole on University
Place in alley between Clark Street and ChicagoStreet in said
City, one sewer running'south in alley 375 feet, the other one
running north in alley 800 feet. :Manholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No::4-C, commencing at the present manhole in alley between Ash
Street and State Street east of Missouri Pacific Railway in said
City, running thence west in alley 1180 feet. Manholes as desig-
nated on plans.
An 8 -inch sanitary sewer lateral in Lateral Sewer District
No.l-E, commencing from present sewer at the intersection of
alleys south of Park Place, between Front Street and Oakdale Avenue
in said City, running thence south 250 feet. Manholes as designated
on plans..
.An 8 -inch sanitary sewer lateral in Lateral Sewer District
No.2-E, commencing from present sewer at the intersection of alleys
south of .Gypsum Avenue, between Penn Avenue and Columbia Avenue
in said City, running thence south 225 feet. Manholes as desig-
nated on plans.
A10 -inch sanitary sewer lateral in'Lateral Sewer District No.
3-E, commencing at present stub of sewer at the end of paving on
Kansas Avenue and Iron Avenue; runnin thence south on Kansas Avenue
about 500 feet. Manholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No.4-E, commencing at present stub of sewer at the end of paving
on Qhio -Avenue and Iron Avenue' in said City, running thence ' north
on Ohio Avenue to center line of Johnstown Avenue therein. Man-
holes ad designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No -1-F, commencing at present end of sewer on Eleventh Street,
225 feet south of Charles Street, running thence south on Eleventh
Street 200 feet all in said City. Manholes as designated on
plans .
A 10 -inch sanitary sewer -lateral in Lateral Sewer District
No.2-F, commencing at the present manhole at the intersection of
Highland Avenue and Republic Avenue in said City, running thence
west on Republic Avenue to center line of ninth Street therein.
Manholes as designated on plans.
A 10 inch sanitary sewer lateral in Lateral Sewer District
No.3-F, commencing at present manhole at the intersection of
South Street and Putnam Avenue in said City, running thence south
on Putnam Avenue to Morrison Avenue therein. Manholes as desig-
nated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No. l -G, commencing at the present manhole in alley between
Beloit Avenue and JyIinneapolis Avenue in said City on the west
side of Fourth Street, runningthence east i -n alley to Osborne
Street therein. Manholes as designated on plans.
A 10 -inch sanitary sewer lateral in Lateral Sewer District
No.2=G, commencing at the present manhole at the intersection
of Highland Avenue and Claflin. Avenue in said City, running
thence westerly to alley 200 feet, thence south in alley 600
feet. Manholes as designated on plans.
Section 2. For the work and improvement herein provided
for the iTty hngineer shall make and file with the City Clerk
on or before the 10th day -of April 1922, complete plans and
specifications for the construction of the above named sewers
and that on or .before said last named date said City Engineer
.shall submit to the Hoard of Commissioners under oath, detailed
estimates of the cost of such sewer construction as mentioned
in Section One (1) of this ordinance.
Section 3. That after such plans and specifications shall
have been made -and prepared by the City Engineer and filed with_
the City Clerk as aforesaid, the Board of Commissioners,,may ad -

vertise by advertisement published in the official City paper
of the City of Salina for three consecutive days for the re-
ceipt of sealed proposals for the construction of the sewers as
mentioned in Section One (1) hereof; and after the receipt of
such proposals the Board of Commissioners may and are hereby au-
thorized to let a contract for the construe tion 'of said sewers to
the lowest responsible bidder therefor; said Board of Commission-
ers shall and hereby reserve the right to reject any and all bids.
Section 4. That for such. sewer construction special assess-
ments shall be made in regard to each separate sewer herein pro-
vided for, for the full cost hereof, on all lots and pieces of
land to the center of the block on either side of the street for
the distance in each instance to be iii. proved according to the
appraised falue of said lots or pieces of land without regard to
buildings or improvements thereon, said appraisement to be made
in the manner as hereinafter provided for.
Section' 5. after the passage and publication of this.
ordimn ee the Board of Commissioners shall 1. appoint three disin-
terested appraisers, householders who, after having taken an oath
to make a true and impartial appraisement of all. lots and pieces
of land liable to assessment and taxation for the cost of the
improvement herein provided for shall within five days after havig
been notified of their appo intra nt proceed to appraise said lots
and pieces of land liable to' assessment and taxation as aforesaid,
as m.,y be designated by the Board of Commissioners of said City,
without regard to the buildings or improvements thereon, and
after making said appraisement shall return the 'same to the Board

and -after said appraise-
ment is returned to the Board of Commissioners said Board of Com-
missioners shall designate a time for holding of a special session
of such Board for the purpose of hearing any complaints that may
be made as to the value of any :lot or piece of land appraised as
aforesaid of which special session due notice shall be given in
the official City paper, at which special session the Board of .
Commissioners may alter the valuation of any lot or piece of land
if in their ppinion the same has been appraised too high or too
low.
Section 6. For the purpose of paying for the work and im-
provement of this ordinance provided for, the Board of Commission-
er`s are hereby authorized and directed to issue internal im-
provement bonds of the City of Salina in an amount not to exceed
the contract price of such improvement, and to run for a period
of not less than ten years and be payable in ten equal annual
instal lments, ° together with the interest not to exceed 5 per cent
per annum, which bonds shall be made payable at the fiscal agency
of the State of Kansas; and for the purpose of paying principal
and inteerest on said bonds as they severally become due and pay-
able the Board of Commissioners shall apportion and assess against
the lots and pieces of land within the taxing district of such
improvements, , special assessments covering the cost of such
improvements, and the apportionment therein contained shall hold
good for all the installments that are to be collected from the
specific property chargeable with said improvement. Such assess-
ment and apportionment ordinance shall contain the total amount of
tax apportioned to each tract, piece and parcel of land within
the taxing district and shall state the number of annual install-
ments in which such tax is to be collected; and thereafter the
City Clerk shall annually, at the same time taxes are to be cer-
tified, certify to the County clerk of Saline County, Kansas, a
full list of all property liable for such work and improvement,
together with the respective amounts due on each of said tracts,
pieces and parcels of land, which amounts shall included the
-annual installments and interest on all unpaid balances for one
year at the rate of 6 per cent per annum, aii such amounts so
certified shall be collected as other taxes are collected.
Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.
