AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES. AND
PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE PURPOSE OF PAYING
A PORTION OF THE COST OF CERTAIN IMPROVEMENTS IN THE CITY.

W WHEREAS, the Governing Body of the City of Salina, Kansas (the "City") has authorized the

". WEST GRAND AVENUE PHASE I
WATER MAIN IMPROVEMENTS
The installation of approximately 3000 lineal feet of 12" water main, fire hydrants, valves, fittings, and
necessary incidentals.
PROJECT NO. 05-1554
GOLDEN EAGLE ESTATES NO. 4, PHASE I & II
STREET AND BACKYARD DRAINAGE IMPROVEMENTS
Curb, guttering, grading and paving of. Huntington Road from Sherwood Lane to Wayne Avenue; Sherwood
Lane from Huntington Road east to Falconview Drive, including construction of the Sherwood Drainage
Crossing; Wayne Avenue to the east lot line of Lot 17, Block 3; Falconview Drive from its existing terminus
north to Wayne Avenue; and George Court, Jodi Court, and Lasha Court of the Golden Eagle Estates
Addition No. 4.
Approximately 809 square yards of concrete drainage ribbon to serve Lots 1-18, Block 1, Lots 1-15, Block 2,
and Lots 1-28, Block 3, of the Golden Eagle Estates Addition No. 4, Block 6 of the Golden Eagle Estates
Addition.

MAGNOLIA HILLS ESTATES, PHASE I
STREET, DRAINAGE & UTILITY IMPROVEMENTS
The curb, guttering, paving, grading and drainage for approximately 830 lineal feet of Stonepost Lane;
approximately 140 lineal feet of Brookefield Drive; and approximately 830 lineal feet of Ridgehill Drive.
The installation of approximately 2,271 lineal feet of six-inch and eight -inch water main, fire hydrants,
valves, fittings, service connections for water lines lying within curb lines and all appurtenances thereto.
The installation of approximately 1,509 lineal feet of sanitary sewer main, service connections for sewer
lines lying within curb lines, manholes and all appurtenances thereto.
The installation of approximately 1,157 lineal feet of sanitary sewer main, service connections for sewer
lines lying within curb lines, manholes and all appurtenances thereto .
The installation of a stormwater detention pond.

SANITARY SEWER EXTENSION
The trenching, backfilling, and installation of approximately 691 lineal feet of sanitary sewer pipline and

STREET, DRAINAGE, SANITARY SEWER, AND WATER IMPROVEMENTS
Curbing, guttering, paving, grading and drainage for approximately 363 lineal feet of a street to be known as
Piercy Court; the installation of approximately 430 lineal feet of sanitary sewer main, service taps and
manholes; the installation of approximately 260 lineal feet of six-inch water main.

QUAIL MEADOWS ESTATES, PHASE H
STREET, DRAINAGE AND UTILITY IMPROVEMENTS
Curbing, guttering, paving, grading and drainage for approximately 300 lineal feet of Caywood Drive;
approximately 737 lineal feet of Joanie Lane; approximately 562 lineal feet of Linda Lane; and
approximately 135 lineal feet of Rittgers Lane.
Installation of approximately 216 square yards of six-inch concrete drainage ribbon.
Installation of approximately 434 lineal feet eight -inch water main, fire hydrants, valves, fittings, service
connections for water lines lying within right-of-way and all appurtenances thereto (the "Water System
Improvements".
Installation of approximately 727 lineal feet of sanitary sewer main, service connections for sewer lines lying
within right-of-way, manholes and all appurtenances thereto.
Installation of approximately 86 lineal feet of sanitary sewer main, service connections for sewer lines lying
within right-of-way, and all appurtenances thereto.

LAKESIDE ADDITION
SANITARY SEWER AND WATER IMPROVEMENTS
The installation of approximately 1070 lineal feet of six-inch (6") water main, fire hydrants, valves, fittings,
and necessary incidentals.
The installation of approximately 307 lineal feet of eight -inch (8") sanitary sewer main, service taps,
manholes and necessary incidentals.
WHEREAS, the total costs of such improvements have been determined; the Governing Body
has caused the assessments against each lot, piece or parcel of land deemed to be benefited by such
improvements, to be determined in the manner set forth in the resolutions as to advisability of the
improvements provided for pursuant to K.S.A. 2-604; and an assessment roll has been prepared; and
WHEREAS, such assessment roll was filed with the City Clerk and has been open to public
inspection; and
WHEREAS, the City Clerk, at the direction of the Governing Body, caused notice of the
hearing on the special assessments to be published not less than 10 days prior to such hearing, and notice to
be mailed to the property owners to be assessed, in accordance with K.S.A. 12-609; and
WHEREAS, the Governing Body held a public hearing to consider each of the proposed
assessments.
BE IT ORDAINED by the Governing Body of the city of Salina, Kansas:
Section 1. Special Assessments to pay the cost of the following projects are hereby levied
against several lots, pieces and parcels of land liable for special assessments for said Improvements, as

Section 2. That the owner of Unplatted Tract 2 in Project No. 04-1488 has requested a deferral of
the special assessments levied on said tract hereunder; said tract qualifies under K.S.A. 12-6,110 et seq. for a
deferral of special assessments; and the City hereby grants a deferral of the special assessments levied
hereunder on said tract for a period of 15 years or until such property is platted or developed, whichever
occurs first.
Section 3. The special assessments provided for in Section 1 of this Ordinance shall be certified by
the City Clerk to the County Clerk in the same manner and at the same time as other taxes are certified. The

assessments and will be collected in fifteen (15) equal annual installments, together with interest on such
amounts at a rate not exceeding the maximum rate therefore as prescribed by the Act. The first installment
shall become due with the first payment of general property taxes for the year 2007. Interest on the assessed
amount remaining unpaid between the effective date of this Ordinance .and the date the first installment is
payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued
to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid
installments shall be added to each subsequent installment until paid.
Section 4. The owner of any piece or parcel of property liable for any such assessments may redeem
his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a
portion thereof, chargeable against said property, at any time on or before May 18, 2007, and to the extent of
any such payment, the property so paid,on shall not thereafter be liable for any further assessments for the
cost of said improvements, nor for any interest due thereon.
Section 5. This Ordinance shall take effect from and after its passage and publication in the official
City newspaper.
