ORDINANCE NO. 2474

An Ordinance providing for the condemnation and appropriation
.of a certain tract and parcel of ground in the City of
Salina, Kansas, for the purpose of widening Johnstown
Avenue in said City from the west line of Ohio Street
to the east line of Kansas Avenue -in said City, and pro-
viding for the appointment of appraisers thereof.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is necessary and should be and there
is hereby appropriated and condemned for the purpose of widening
Johnstown Avenue from the west line of Ohio Street.to the east
line of. Kansas Avenue'in the City of Salina, Kansas, the fol-
lowing described, tract, piece and parcel of ground to -wit:
"The South thirty-five (35) feet of Surveyors Plat "G"
as shown by the recorded plat thereof in the office of the Reg-
ister of Deeds of Saline County, Kansas, and otherwise more
particularly described as all of that piece, tract or parcel of
land situate in the City of Salina, `aline County, Kansas, and
lying within the following metes and bounds, to -wit:
Commencing at a point thirty-five (35) feet west of the,
Southeast corner of the Southeast Quarter (S. E. 4) of Section
Twelve (12), Township Fourteen (14), Range Three (3) Viest of
the Sixth Principal Meridian in Saline County, Kansas, thence
west 598 feet, thence north thirty-five (35) feet, thence east
598 feet, thence south thirty-five (35) feet to the point of
beginning.".
Section 2. The Mayor by and with the consent of the
Board of Commissioners shall appoint three.disinterested apprais-
ers and householders to assess the damages caused thereby and said
appraisers shall ascertain the actual value of the land so taken,
without reference to the projected improvements, and the actual
damages done to all other porperty thereby; for the payment of
such value and damages the appraisers shall assess against the

City the amount of benefit to the public generally and the remaind-
er of such amount shall be assessed against the property within
the benefit district to be created, which in their opinion, shall
be sepecially benefited by the proposed improvements. Said ap-
praisers shall make due reportto the Board of Commissioners of said
City concerning their proceedings.
ection 3. This ordinance shall take effect and be in
full force from and after its, publication once in the official
City paper.
