ORDINANCE NO. 2472
An Ordinance specifying and seleeting.the paving material to be
used and letting a contract for the paving and excavating
of certain streets in the city of -Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Seetioh 1. That it is hereby determined that State Street in
the City of Salina, Kansas, from the west line of Ninth Street to
the east line of College Avenue in said.City, except,the inter -
sections of Tenth -Street and Phillips.Street which are already
paved, shall be paved with one course vitrified vertical fiber
side wire out birek paving blocks not less than three (3) inches
deep, with a Texaco Asphalt Filler or a filler equally as good,
laid oh a foundation five (5) inches in depth of Portland Cement
Concrete base with one (1) inch Sand Cushion, such pavement within
the limits above defined to be Thirty-two (32) feet in width from
gutter to gutter.
Section 2. Alleexcavating, filling and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict
conformity to and in compliance with the plans and specifications
heretofore made by the City Engineer of Salina, Kansas, and now
on file with the City Clerk of said City, which said plans and
specifications are hereby incorporated in and made a part hereof,
in all respects as fully and completely as though -written out at
length herein; which plans and specifications are hereby adopted
as and for the plans and specifications of such work and improve-
ments.
Section 3. That a contract is hereby awarded to G. M.
Smith and Mht Graham Jr.. co-partners doing business under the
firm.name and style of the Smit -Graham Construction Company, for
the paving, excavaging and filling of the above mentioned streets
in the limits aforesaid with the materials hereinbefore specified,
for the paving actually laid and put in place and for the labor
actually performed and the material actually furnished at the fol-
lowing prices; for the excavating and grading seventy-two cents
(72/) per cubic yard; for paving actually laid and put in place
Three and 23/100 Dollars ($3.23) per square yard. All of said work
shall be paid for according to the measurement made by the City
Engineer of the City of Galina. It is hereby determined and found
that the prices to be paid for the improvements as aforesaid is
less than the estimated prices of each and all of said improvements
as now on file with the City Clerk of the City of Galina, Kansas.
Section 4. Such contract is awarded upon the express
condition that such work and improvements shall be done in
strict accordance with and in compliance with the plans and
specifications of the City Engineer therefor, which'plans and
specifications'are hereby made a part of this ordinance and of
the contract awarded, and upon further conditions among others
that the,persons Ito whom said contract is awarded shall fur-
nish to the City of Salina a surety company bond in the approxi-
mate sum of the cost of such improvements guaranteeing the
prompt, proper and workmanlike construction of all the same
together with a surety company bond -guaranteeing such pavement
against all defects in material and workmanship for a period
of five (5 ) years from the date of its completion and accept-
ance by said City; together with a good and sufficient surety
company bond running to the State of Kansas in an amount ap-
proximately equal to the contract -pride of said improvements
and conditioned that said persons shall pay all indebtedness
for labor and material furnished in making the improvements
provided for herein.
Section 5. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into.on behalf
of said.City all written agreements necessary in order to se-
cure the construction of the improvements herein provided for.
Section 6. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.

An Ordinance specifying and selecting the paving material to be

of certain streets in the City of Salina, Kansas.,
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that State Street
