2471 Street ImprovementsORDINANCE NO. 2471 (-P�b1-�.she:d—in—T-he�Sa-l-.na=Eve:r-iin�=Jour_nal_Ma.r__ch-/__{.-�� 1.22_) An Ordinance specifying and selecting the paving material to be used and letting a contract for the paving, excavating, curbing and guttering of certain streets in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined'that Baker Street in the City of Salina, Kansas, from the south line of Walnut Street to the north line of,South Street in said City, shall be paved with one course vitrified vertical fiber side wire cut brick paving blocks not less than three (3) inches deep, with Texaco Asphalt Filler or filler equally as good, laid on a foundation five (5)' inches in depth of Portland Cement Concrete base with one (1) inch Sand Cushion, such pavement within the limits -above defined to be Twenty-two (22) feet in width from gutter to gutter. Section 2. That it is hereby determined that Baker Street in the City of Salina, Kansas, from the south line of Walnut Street to the north line of South Street in said City thall be curbed and guttered with one' -piece combination cement curb and gutter. Said combined curb and gutter shall be comprised of a curb 'six (6) inches thick at the top and six and -one-half (61) inches thick at the throat, with combined gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches next to`the pavement. Section 3.' All excavating, filling and rolling necessary for the proper construction of such improvements -shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and.specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which said plans and spe fications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which plans and specifications.are hereby adopted as and for the plans and specifications of such owrk and improve- ments. Section 4. That a contract is hereby awarded to G. M. Smith and Mat Graham Jr., co-partners doing business under the firm name and style of the Smith -Graham Construction Company, for the paving, curbing, guttering, excavating and filling of the above mentioned streets in the limits aforesaid with the materials hereinbefore specified, for the paving -actually laid and put in place and for the labor actually performed and the 1 A 1 I, - I 1 1 materials actually furnished at the following prices; for exca- vating and'grading seventy-two cents (72y) per cubic yard; for Portland Cement Concrete combined curb and gutter eighty-two cents,(82�) per lineal foot; for paving actually laid and put in place Three and 23/100 Dollars ($3.23) per square yard. All of said work shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby deter- mined and found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awarded upon the express con- dition that.sueh work and improvements shall be done in strict ac- cordance with and in compliance with the plans and specifications of the City. Engineer therefor, which plans and specifications are hereby.made a part of this ordinance and of the contract awarded, and upon further conditions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the'cost of such im- provements guaranteeing the prompt, proper and workmanlike construc- tion of all the same together with a surety company bond guarantee- ing such pavement against all defects in material and workmanship for a period of five years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said persons shall furnish tht City of Salina a.good and sufficient surety company bond guaranteeing said curb and'gut- ter against all defects in material and workmanship for a'period of two (2) years from the date of its completion and acceptance of such work by said City, together with a good and sufficient sure- ty company bond running to the State of Kansas in an amount approx- imately equal to the contract price of said improvements and con- ditioned that said persons shall pay all indebtedness for labor and material furnished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina, are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the con- struction of the improvements herein provided for. Section 7. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Passed and approved, March 6th, 1922. F. S.
