2470 Street Improvements3,03 ORDINANCE NO. 2470-- ( �Putj sh-p_d L kal.ina—men_Journal ka_f__ JJ922) An Ordinance specifying and selecting the paving material to be used and letting a contract for the paving, excavating, curbing and guttering certain streets in the city of Salina, Kansas. BE IT ORDAINED by the Board of Com6missioners of the City of alim., Kansas: - Section 1. That it is hereby determined that Republic Avenue in the City of Salina., Kansas., from the west line of Santa Fe Avenue to the east line of Highland Avenue in said City, shall be paved with one course vitrified vertical fiber side wire cut brick paving blocks not less than three (3) inches deep,, with a Texaco Asphalt Filler or filler equally as good,, laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined to be twenty-three (23) feet in width from gutter to gutter. Section 2. That is it hereby determined that Republic Avenue in the City of Salina, Kansas from the west line of Santa Fe Avenue to the east line of Highland Avenue in said City, shall be curbed and guttered with oneliece combination cement P. curb and gutter. Said.combined curb and gutter'shall be comprised of a curb six (6) Inches thick at the top and six and one-half (6b ienhes thick at the throat,.with combined gutter twenty2four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All xcavating., filling and rolling necessary for the proper construction of such improvements shall be done and all of'such.improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of 'Salina, Kansas, and now on file with the City Clerk of said City, which said plans and specifications are. hereby incorporated In and made a part hereof in all respects as fully Ahd d67ffP16td1,Y as th6tgh Written out at length herein, which plans and specifications are.hereby a . doptal as and for the plans and specificatfons of such work and improve- ments. ,Section 4. That a contract is hereby awarded to G. m. Smith and Mat Graham Jr., co-partners doing business under the firm name and style of the Smith -Graham Construction Company., for the paving, curbing, guttering, excavating and filling of the abo-e mentioned streets In the limite aforesaid with the materials here inbeofe specified,, for the paving actually laid and put in place and for the labor actually performed and the materials actually furnished at the following prices; for excavzating and grading seventy-two cents (72¢x) per cubic yard; for Portland Cement Concrete combined curb and gutter eighty-two cents (82�) per lineal foot; for paving actually Paid and put in place Three and 23/100 Dollars ($3.23) per square yard. All of said work shall be paid for accordingto the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as aforesaid is less than the estimated.priees of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 5. Such contract is awarded upon the express condtion that such work and improvements shall be done in strict accordance witn and in compliance with the plans and specifica- tions of the City Engineet therefor, which plans and specifica- tions are hereby made a part of this ordinance and of the con- tract awarded, and upon further conditions among others that the - persons to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same together with a surety .eoiripany bond guaranteeing such pavement against all defects in material and workmanship for a period of five years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said persons shall furnish to the City of Salina a good and sufficient surety company bond guarqnteeing said curb and gutter against all de - fleets in material and workmanship for a period of two years, from the date of its completion and acceptance of such work by said City; together with a good and sufficient surety company bond running to eht State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness for labor and ma - tenial furnished in making the improvements provided for herein. Section 6. The Board of Commissioners) of .the City of Sa- lina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to se - cure the construction of the improvements herein provided for. 1 1 1 1 C 1 r i Section 7. That it is hereby determined that Republic Avenue in the City of Salina, Kansas, from the gest line of Santa Fe Avenue to the east line of Highland Avenue In said City, shall be paved with one course vitrified vertical fiber side wire cut brie paving blocks not less than three (3) inches deep, with a 'Texaco Asphalt Filler of filler equally as good, laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch Sand Cushion, such pavement within the limits above defined to be twenty-three (23) .feet in width from gutter to gutter. Said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and, six and one-half (61) inches thick at the throat, with combined gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) Inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and dune in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which said plans and specifications are hereby incorporated in and made a part hereof, & 0 in all respects as fully and completely as though written out at length herein; which plans and specifications are hereby, adopted as and for the plans and specifications of such work and improvements. Section 4. That a contract is hereby awarded to G. M. Smith and Mat Graham Jr., co-partners doing business under the firm name and style of the Smith -Graham Construction Corapa=y, for the paving, curbing., guttering,, excavating and fill- ing of the above mentioned streets in the limits aforesaid with the materials heveinbefore specified, for the paving actually laid and put in place and for the labor actually performed and the materials actually furnished at the following prices; for ex- cavating and grading seventy-two cents (72�) per cubic yard; for Portland Cement Concrete combined curb and gutter eighty-two cents (62�) per lineal foot; for paving actually laid and put in place 'Three and 23/100 Dollars ($3.23) per square yard. All of said work shall be paid for according to the measurement made by the City Fingineer of the City of A6 alina. It is hereby determined and found that the prices to.be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of alina, Kansas. Such contract is awarded upon the express con- dition that such work and improvements shall be done in strict ac- cordance with and in compliance with the plans and specifications of the City Engineer therefor, which plats and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a company surety fond in the approximate sum of the cost of such improvements prompt - guaranteeing the/proper and workmanlike construction of all the same together with a surety company bond guaranteeing such pave- ment against all defects in material and workmanship for a period of five veers from the date of its completion and acceptance by said City; and'said contract is awarded upon a further condition that said persons shall furnish the City of Salina a good and suf- ficient surety company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) years from the date of ii. -.s completion and acceptance of such work by said City; together with a good and sufficient surety clomp--umy bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness for labor and material furnished in making the, improvements provided for herein. Section 6. The Board of Cormissioners of the City of Selina are hereby authorized to -make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. Section 7. This ordinance shall take effect and be in full force from and eter its publication once in the official City paper.
