2468 Street ImprovementsORDINANCE NO. 2468 _F.ub..li_she_d_in_The_Sa.lina Journal March Z 1922) An Ordinance specifying and selecting the paving material to be used and letting a contract for the paving, excavating, curbing and guttering of certain streets in the City of Salina., Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Republic Avenue in the.City of Salina., Kansas., from the west line of 'Highland to the line Ninth Street in said City, Avenue east of shall be paved with one course vitrified vertical fiber side wire our brick paving blocks not less than three (3) inches deep, with a Texaco Asphalt Filler or a filler equally as good, laid on a foundation five (5) inched.in depth ofPortlandCement Concrete, base with one (1) inch Sand Cushion, such pavement within the limits above defined to be Thirty-three (33) feet in width from gutter to gutter* Section 2. That it is hereby determined that Republic Avenue in the City of Salina, Kansas, from the west line of Highland Avenue to the east line, of Ninth Street in said City, shall be curbed and guttered with one piece combination cement curb and_gutter. Said combined curb and gutter shall be comprisel of a.curb six (6) inches 'thick at the top and six- and one-half (6.1) inches thick at the throat, with combined gutter twenty-four (24) inches wide, six (6) inches thick at the throar and seven (7) inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specicications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City., which said plans and specificatirms are hereby incorporated in and made a part hereof, in all respects as fully and completely as though written out at length herein; which plans and specifications are hereby' adopted as and for the plans and specifications of such work and improvements. Section 4. That a contract is hereby awarded to G. M. Smith and Mat Graham Jr..., co-partners doing business under the firm name and style of the Smith -Graham Construction Company., for the paving, curbing, guttering:, excavating and filling of the above mentioned streets in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place and for -the labor actually performed and the materials actually furnished.at the following prices; for ex- cavating and grading seventy-two cents (72¢) per cubic yard; for Portland Cement Concrete combined curb and gutter eighty-two cents (82¢x) per lineal foot; for paving actually laid and put in place Three and 23/100 Dollars ($3.23) per square yard. All of said work shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby deter- mined and found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas.. Section.5. Such contract is awarded upon the express con- dition that such work and improvements shall be done in.strict ac- cordance with and in compliance with the plans and specifications of the City Engineer therefor, which plans and. specifications are hereby m a.e-a part of this ordinance and of the contract awarded, and upon further eondtions among others that the persons to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same together with a -surety -company bond guaranteeing such pavement against all defects in material and workmanship for a period of five years from the date of its completion and acceptance by said city; and said contract is awarded upon a further condition that said persons shall fur- nish the City of Salina a good and sftfficient surety company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) years from the 0 date of its completion and acceptance of such work by said City; together with a good and sufficient surety company bond running to the State of. Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said persons shall pay all indebtedness for labor and material fur- nish -ed in making -the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written -agreements necessary ii! order to secure the construction of the improvements herein provided for, N 1 C' 1 1 1 1 1 1 Section 7.
