An Ordinance specifying and selecting the paving material to be
used and letting a contract for the paving, excavating,
curbing and guttering of certain streets in the city
of Salina; Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas.
Section 1 That it is hereby determined that Ninth Street
in the City of Salina, Kansas from the south line of Republic
Avenue to the north line of Jewell Avenue in said City, shall
be paved with one course vitrified vertical fiber side wire out
brick paving blocks not less than three (3) inches deep, with a
Texaco Asphalt filler, or a filler equally as good, laid•on a
foundation five (5) inches in.d epth of F.ortland,Cement Concrete
base a with one (1) inch Sand Cushion, such pavement within the.
limits above defined to be Thirty-three (33) feet in width from
gutter to gutter.
Section 2. That it is hereby determined that Ninth Street -
in the City of Salina, Kansas', from the south line of Republic
Avenue to the north line of Jewell Avenue in said, -City, shall
be curbed and guttered With one piece combination cement curb
and gutter. Said combined curb and gutter shall be comprised
of a curb six (6) inches thick at the top and six and one-half
(62) inches thick at the throat, with combined gutter twenty-four
(24) inches wide, six (6) inches°' -thick at the throat and seven
(7) inches thick next to the pavement.
Section 3. Alle excavating, filling and rolling neces-
sary for the proper construction of such improvements shall be
done and all of such improvements shall be made and done in
strict conformity to and in compliance with theplans and speci-
fications heretofore made`by the City Engineer of,Salina, Kansas,,
and now on file with the City Clerk of.said City, which said
plans and specifications are hereby incorporated in and made a
part hereof -,in all respects as fully and completely as,though
written out at length herein; whcih plans and specifications are
hereby adopted as and for the plans and specifications of such
-work and improvements.
Section 4. That a contract is hereby awarded to G. M.
Smith and Mat Graham Jr., co-partners doing business under the
firm name and style.of the Smith -Graham Construction Company,
for the paving, curbing, guttering, etcavating, and filling of
the above mentioned streets in the limits aforesaid with the
materials hereinbefore specified, for the paving actually laid
and put in place and for the labor actually performed and the

material.actually furnished at the following prices; for ex -
cavating and grading seventy-two cents (72/) per cubic yard;
for Portland Cement Concrete combined curb and gutter eighty-
two cents (82�) per lineal foot; for paving actually laid and'
put in place. Three and 23/100 Dollars ($3.23) per square yard.
All of said work shall be paid for according to the measurement
made by the City Engineer of the City of Salina. It is hereby
determined and found that the prices to be paid for the improvements
as aforesaid is less than the -estimated prices of each and all of
said improvements as now on file with the City Clerk of the City
of Salina., Kansas.
Section 5. Such contract is alvarded,upon the express con-
dition that such work and 'improvement -s shall be done in strict ac-
cordance with.and in compliance with the plans and specifications
of the City Engineer therefor, which plans and specifications are
hereby made a part of this ordinance and of the contract awarded,
and upon further conditions among others that the persons,to whom
said contract isawarded shall furnish to the City of 13alina a
surety company bond in the approximate sum of the cost of such
improvements guaranteeing the prompt-, proper and workmanlike con-
struction of all the same together with a surety company bond
guaranteeing such pavement against all defects in material and
workmanship for a period of five years fromthe date of its com-
pletion and acceptance by said City; and said contract is award-
ed upon a further.conditon that said persons shall furnish the
City of '"alina a good and sufficient surety company bond guarantee-
ing said curb and gutter against all defects in material and work-
manship for a period of two (2) years from the date of its comple-
tion and acceptance of such work by said City, together with a good
and sufficient surety company bond running to the State of Kansas
in an amount approximately equal to the,eontraet price of said im-
provements and conditioned that said persons shall pay all indebt-
edness for labor and material furnished in making the improvements
provided for herein.
Section 6. The Board of Commissioners of the City of
Salina are -hereby authroized to make and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements herein provided for.
Section 7. This ordinance shall take effect and be
in full force from and after its publication once in the offi-
cial City paper..
