An Ordinance specifying and selecting the paving material to be
used and letting a- contract for the .paving, excavating,
curbing and guttering of certain streets in the City of
Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that Bond Street
in the City of Salina, Kansas, from the west line of Highland
Avenue to the .east line -of Ninth.Street in said City, shall be
paved with one course vitrified vertical fiber side wire out
brick paving blocks not less than three (3) inches deep, with
Texaco Asphalt Filler or filler equally as good, laid on founda-
tion five (5) inches in depth of Portland Cement Concrete base
with one (1) inch Sand Cushion, such pavement within the limits
above defined to be thirty-six.(36)-feet in width from gutter
to gutter.
section 2. That it is'hereby determined that Bond Street
in the City of Galina, Kansas, from the west.line of Highland.
Avenue to the east line of Ninth Street in said City, shall. be
curbed and guttered with onel-piece combination cement curb and
gutter. Said combined curb and gutter shall be comprised of a
curb six (6) inches thick at the top and six and one-half (62)
inches thick at the throat, with combined gutter twenty-four (24)
inches wide, six.(6) inches wide at the throat and seven -(7)
inches thick next to the pavement.
Section 3. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict
conformity to and in complaince witth the plans and specifications
heretofore made by the City Engineer of Salina, Kansas, and now on
file with the City Clerk of said City, which said.plans and spe-
cifications are hereby incorporated in and made a part hereof,
in all respects as fully and completely as though.written out
at length herein; which plans and specifications -are hereby
adopted as and for the plans and specifications of such work
and improvements.
Section 4. That a contract is hereby awarded to G. M.
Smith and Mat Graham, Jr., co-partners doing business under the
firm name and style of the Smith -Graham Constreution Company,
for the paving, curbing, guttering, excavating and filling of
the above mentioned streets in the limits aforesaid with the
materials hereinbefore specified, for the paving actually laid
and put in place -and for the labor actually performed and.the

materials actually furnished at the following prices; for exca-
vating and grading seventy-two cents (72�) per cubic yard; for
Portland Cement Concrete combined curb and gutter eighty-two
cents -(82�) per lineal foot; for paving actually laid and put in
place Three and 23/100 Dollars ($3.23) per square yard/ All of
said work shall be paid for according to the measurement made by
the City Engineer of the City of Salina._ It is hereby determined
and found that the prices to be paid for the improvements as afore-
said is less than the estimated prices of each and all of said
improvements as now on file. with the City Clerk of the city of
Salina, Kansas.
Section 5. Such contract is awarded upon the express con-
dition that such work and improvements shall be done -in strict ac-
cordance with and in compliance with the plans and specifications
of the City Engineer therefor, which plans and specifications are
hereby made a part of this ordinance and of the contract awarded,
and upon further conditions among others that the persons to whom
said contract is awarded shall furnish to the City of 'Salina a
surety company bond in the appro2imate sum of the cost such im-
provements guaranteeing the prompt, proper and workmanlike con-
struction of all the same -together with a surety company bond guar-
aneteeing such pavement against all defects -in material and work-
manship for a period of five years from the,date of its comple-
tion and acceptance by said City; and said contract is. awarded
upon a further condition that said persons shall furnish the City
of Salina a good and sufficient surety company bond guaranteeing
said curb and gutter against all defects in material and workman-
ship for a period of two (2) years from the date of its,eompletion
and acceptance of such work by said City, together witha good and
sufficient surety company bond running to the State of Kansas in
an amount approximately equal to the contract price of said im-
provements and conditioned that said persons shall pay all indebted-
ness for labor and material furnished in making the improvements
provided for herein.
Section 6.
The Board of Commissioners of the City of
Salina, are hereby authorized to make and enter into on behalf of
said City all written agreements necessary in order to secure the
construction of the improvements herein provided for.

Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.
