(_Pu:b.l:i:shed_in_The_Sal.ina_Eve.ning—Journal March_/ / , 1922 ) An Ordinance regulatinng - 'the' handling and sale of -dairy prod- ucts in the City, of Salina, Kansas, and providing a penalty for the violation thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. The powers and duties required by this ordinance are hereby conferred upon and required to be per - formed by the Sanitary and Health Officer of the City of Salina, Kansas Section 2,.. It shall be unlawful for any person to sell or offer for sale any milk or cream within the City of Salina, without having previously registered his, her or their names and places of business with the City Clerk in a book provided for that purpose. Each cow shall be registered with a proper descrip- tion and an individual number. No,cow shall be registered except those that have been inspected and tested for tuberculosis at least once a year by a registered and commissioned veterinary. The owner shall pay to the City Clerk a registration fee of fifty cents (50¢x) for the first cow and ten cents (10.¢x) for each addi- tional cow. Said registration fee shall be paid annually. The City Clerk shall keep said fees in a special fund to be used in defraying the expenses of this department. Section 3. The City Clerk shall assign to each Milk Vendor a number, and this number shall be,placed on the delivery wagon and cans in plain, readable figures. Section 4. Any duly registered and commissioned veteri- nary appointed by the Board of Commissioners of the City of Salina is hereby authorized to make an official test -for tuberculosis and said verterinary shall place a tag on such cow or cows that successfully pass the test; giving certificate to the owner; dis- posing of cows that do not pass the test according to the state laws. Section 5. For the purposes of this ordinance, the fol- lowing definitions of milk, cream, and ice cream are hereby adopted. Milk is the fresh, clean, lacteal secretion obtained by the complete milking of one or more health cows, properly fed and, kept, excluding that obtained within fifteen (15) days before.and five (5) days after calving, and contains not less than eight and one-half (8.5) per cent of solids not fat, and not less than three and one-quarter(3.25) per cent of milk fat, and contains no pre- servative., added water, or other foreign substance. Cream is that portion of milk, rich in milk fat, which rises to the surface of milk on standing, or is separated from it by centrifugal force, is fresh and clean, contains not less than eighteen (18) per cent of milk fat, and contains no preser- vative or other foreign substance. Ice Cream is a frozen product of the above defined cream, sugar and natural flavoring, whcih shall contain not less than Ten (10) per cent of butter fat. Section 6. It shall be unlawful for any person to sell or offer for sale any milk containing a preservative or visible dirt or dark colored sediment, or any milk to which water has been add- ed, or any milk showing less than eleven and three-quarters (11.25) per cent milk solids, .or any milk which shall contain less than three and one-quarter (3.25) per cent fat, unless branded in clear letters and figures the per cent of the fat the milk contains, or any milk which contains more than two hundred thousand (200,000) bacteria per cubic centimeter: Section 7. It shall be unlawful to sell or.offer for sale any milk produced by any cow or cows before the fifth day after or fifteen days before freshening. It shall be unlawful to sell or offer for sale any milk or cream,which has`been drawn or handled by a person suffering from or exposed to any contagious disease. Section 8. It shall be,unlawful for any keeper, proprietor or employee ofa hotel, restaurant,,boarding house, or lunch counter, to serve or place before his guests or boarders any milk which fails to conform to the standards herein defined, un- less a,placard bearing the words, "Skimmed milk served here' in' plain black letters not less than four inches high, is posted in a conspicuous plaee.in his place of business. Section 9. All milk, cream and ice cream receptacles, measures and ut6nsils-shall be protected from dirt, dust or other contaminating influences during delivery by keeping all milk and cream measures and utensils inside of a sanitary wagon, or in a tight box, or closet having a close fitting lid. It shall be unlawful to bottle milk or cream until it has'been colled to a temperature of sixty (60) degrees Fahrenheit or lower. It shall be unlawful to bottle milk -or cream from other containers or trans- fer milk from one receptacle to another while en route, or to. bottle in any room unfitted for the purpose. 1 ' A 0u Section 10. All milk sold shall be delivered in sealed receptacles to the purchaser and all purchasers shall return such receptacles after the contents have been removed, and not later than Seventy-two.(72) hours after delivery to customer, and the receptacles shall be thoroughly cleansed before return by the customer. The person delivering the milk -shall have a right to demand prompt return of his or her receptacles and shall not be obliged to receive same when not thoroughly cleansed as herein provided. Section 11. Any person in the City of Salina receiving milk or cream for sale shall keep said products in a clean, well ventilated and sanitary place, and it shall be the duty of said persons to thoroughly cleanse and sterilize all milk or cream receptacles and utensils as soon as empty. Section 12. The Sanitary and Health Officer of the City of.Salina, Kansas, shall inspect all premises of dairies furnish- ing milk to the City of.5alina at least once a month and as often as he deems necessary, and this official shall have authority to prohibit the sale of milk from any dairy in which cows are kept in an insanitary place; or milk kept or delivered in vessels not properly cleansed. The Sanitary and Health.0fficer shall have the power to enter without previous notice any dairy, milk depot, milk sales room, or any place where milk is kept or sold, and take such amount of milk as will prove a sufficient sample for the necessary tests. The Sanitary and Health Officer is authorized, and it shall be his duty to cancel without previous notice the registration of any person who shall violate any of the provisions of this ordinance or orders of the Sanitary and Health Officer. Section 13. The Sanitary and Health Officer, or his assist- ants, shall make a chemical and bacteriological analysis of the milk supplied to the City of Salina as"often as he deems necessary. The Sanitary -and Health Officer shall make,a report of these in- vestigations as to the sanitary condition of the dairies furnish- ing dairy products to the City of Salina, once a month to the City Commission, and said findings shall be published in one or more of the local newspaper. Section 14. The City Commissioners and Sanitary and Health Officer shall have authority and it shall be their duty to make such reasonable rules and regulations relative to the scoring of dairies and'the grading of milk and cream as shall be found neces- sary to carry out the intent and provisions of this ordinance. Section 15. Any creamery or other corporation -or individual acting as milk distributor shall furnish to the Sanitary and Health officer of the City of Salina a full list of all producers furnish - milk to them and said list shall be kept up to date from month to month for reference and for a checking system on the part of the .Sanitary and Health Officer. Section 16. Any person violating any of the provisions of this ordinance or the rules and regulations promulgated by the Board ofsCity Commissioners and Sanitary and Health Officer of the City of Salina, provided by this ordinance, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be pun- ished by a fine of not less than Ten Dollars ($10.00) or more than One Hundred Dollars ($100.00) and confined in the City Jail until such fines and costs are paid. Section 17. This ordinance shall take effect and be in full force from and after May lst, 1922, and its publication once in the official City paper.
