An Ordinance prohibiting person's without authority turning on,
unsealing or -opening an.electrie gas or water meter of
service, or -tampering -with -any electric wire and gas
pipe -or water-pipe"owned by an individual or corporation
supplying gas, electric curren.t'or water to the City of
Salina'or its inhabitants, and providing for punishment
for same.
BE IT. -ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Every person who'.shall without authority turn
on* unseal or open an electric, gas or water meter or service or
in any way tamper with any electric wires, gas pipes and water
pipes or meters owned by any individual, company or corporation
supplying gas, electric current or water to the City of Salina,
or its inhabitants, or who shall attach thereto any contrivance
mechanism or device whatsoever, -so as to prevent, or which may
be designed or intended to prevent..the whole quantity of gas,
electric current or water supplied to any consumer at meter
rates from passing through and being measurdd by, the meter pro-
vided for such purpose, and every consumer of gas, electric cur-
rent or water at meter'rattes who shall knowingly permit the same
to be done for his or her benefit, of for the benefit of any
association, or corporation in which he., -or -she may have any inter-
est shall be guilty of a misdemeanor.
Section 2.
Every consumer of gas, electric current or
water at meter rates who shall, by means of any contrivance,
mechanism or device whatsoever, knowingly take, or use any gas,
electricity or water without the whole quantity so taken or used
having passed through and been measured by a meter provided for
such purpose shall be guilty of a misdemeanor.
Section 3. Proof of the existence of.any contrivance,
mechanism or device whoch prevents, or which may be designed or
intended to prevent the whole quantity of gas, electric current
or water supplied to any consumer at meter rates from passing
through and being measured by a -meter provided for such purpose
on the premises of any consumer of gas, electricity'or water at
metker rates, shall be prima facie evidence that such consumer
knew of the existence thereof, and that he was knowingly taking
and using gas, electric current or water as the case may be, with-
out the same having wholly passed through and been measured by a
meter provided for such purposes.
Section 4. That the servants and employes of,every com-
pany or corporation supplying gas, electric current or water to
the City of Salina or its inhabitants shall have the right at all
reasonable times to enter the premises of every consumer of gas,
eleetric'eurrent or water at meter rates for the purpose of in-
specting its wires, pipes and meter to ascertain whether or not
the meters are correctly measuring the whole quantity of gas,
electric current or water supplied to such consumer and a denial
of such right of inspection during reasonable hours by any con-
sumer at meter rates,'shall be prima facie evidence that such
consumer is taking and using gas, electric current. or water as
the case may be, without the whole quantity thereof passing through
and being measured by a meter prodded for that. purpose.
Section 5. Every person who shall knowingly or intention-
ally violate Sections Two (2) or Three (3) of this Ordinance shall
be guilty of a misdemeanor and on conviction thereof shall be
fined in any sum not to exceed Fifty Dollars (w50..00), and in ad-
dition thereto the individual, company or corporation, so supply-
ing gas, electrical current or water shall not be t$ereafter bound
to furnish either gas, electrical current or water to the person
so convicted of fraudulently taking or using either gas, electric
current or water.
Section 6. This ordinance shall take effect and be in
force from and after its publication once in the official City
paper®
