2435 Improving State StreetX40 ORDINANCE NO.; 2435 ( Published in The Salina Evening Journal January Z Y, 10220; An ordinance providing for the. -excavating, Braiding and paving of State Street in the C ty of Salina, Kansas, from the west.line of Ninth Street to the east line of College Aven- ue in said City; except the ' in:tersections of Tenth Street .and Phillips Street; and providing for the cost thereof, how the same shall be assessed and the manner of payment therefor.. WHEREAS., by resolution duly adopted on the 24th day of.October 1021 the Board of Commissi: oners of the City of Salina.. Kansas, have declared that'they deem it necessary to excavate, grade and pave State Street in the city of Salina, Kansas,f rom the west line of Ninth Street to the east line of College Avenue in said City ex- cept the intersections of Tenth Street and Phillips Street in said City, which have already been paved, and WHEREAS, said resolution was published for sic days in The Salina Evening Journal, a daily newspaper published in the City of Salina, the official City paper of said Clty, and WHEREAS, the majority of the r' esident owners of property own- ing a majority in square gfeet of the lots or real estate liable to taxation for the cost of said improvements did not within 20 days from the date of the last publication of such resolution file with the City Clerk of said City their protest in writing against such improvements or the making thereof; THEREFCR E, BE IT ORDAINED by the Board of Commisd oners of the C_*ty of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that State Street in the Cgty of Salina, Kansas, from the west line of Ninth Street to the east line of College Avenue in said City, except the intersection of Tenth Street and Phillips Street in' said City be excavated and graded to the established grade thereof as established by ordinance of the City of Salina, Kansas, provided that at the intersections of streets and alleys except'the intersectio Tenth Street.and Phillips Stret, said excavation and grading shall be carried to the lot line of.the street so improved and that such lot line of grading be made to conform to the established grade of such street or alley if the same has been established. Section 2. That it is necessary and it is hereby ordered that State Street in the City of Salina, Kansas from the west line of Ninth Street to the east line of College Avenue in the City of Salina, Kansas, except the intersections of Tenth Street and Phil- lips Street in said City, which has already been paved, be paved with such material as the Board of Commissioners may hereafter designate and select as hereinafter provided.for, according to the specifications of the City Engineer of said City hereinafter pro - vided for; said street shall be paved for a width of thirty�.two (32) of 1 1 1 1 I I 1 I I' N feet excluding the curb and gutter which said curb -and gutter have already been,constructed,, provided that at the intersections of streets and alleys except --the intersection of Tenth Street and Phil- lips Street such paving shall extend.to the lot line of the street -§o improved. Section 3. For the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or be- fore the 13th day of February 1922 complete plans and specifications for the paving of said street with the following material: 1. 3 -inch vertical fiber plain wire cut bricks, 5 -inch concrete base, Asphalt.. Fi=ller. 2. 2 -inch Asphaltic concrete 5 -inch concrete base. 3. Asphalt macadam (penetration) 21 2 inch wearing surface 6 inch macadam base. ✓ 4. 1 course concrete 6 inches thick. and that on or before -said last named date said City Engineer shall submit to the Board of Commissioners, under oath detailed estimates of the cost of such paving of said street with the different kinds of material named herein and of the excavation and grading of said street. Section 4. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid,, the Board of ommissioners may advertise by advertisement published in the official City paper of the City of Salina for three consecutive days for the receipt of sealed proposals - for the paving of said street with the differentkindsof paving material named and specified in the preceding section.hereof, and for the excavating and grading of said street to the established grade thereof as herein provided for; and after the receipt of such propos- als the Board of Commissrioners shall select from the different kinds of street paving material the.kind with which said street ought in their judgment to be paved and said Board of Commissioners may and are hereby authorized to let.contracts for the grading and excavat- ing of said street to the lowest responsible bidder therefor., and for the paving of said.street with.the,materials so selected to the low- est responsible bidder therefor., as'dete*rmined by said Board 'of Com- missioners for the kind.and character of paving which shall be deter- mined upon by said Board of Commissioners and for such excavating and grading; said Board of.Commissioners,reserve the right to reject any and all bids.. Section 5* That for such excavating and grading special assessments shall be made for the full cost thereof on all lots and pieces of land to the center of the block on either side of the street for -the distance to be improved according', to the appraised value of said lots or pieces of land without regard to buildings or improvements thereon, said appraisement to be made in the manner as hereinafter provided for. The entire.distance to be graded shall constitute one grading district. Section 6. That for such paving special assessments shall be made for the full cost thereof on each block'separately, on all .lots or pieces of land to the center of the block.on either side of the street according to the appraised value thereof., without regard to buildings or improvements thereon for the distance to be im- proved. Section 7. After the passage and publication of this ordi- nance.the-Board of Commissioners shall appoint three disinterested appraisers., householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces.of ground liable to assessment and taxation for the cost,of-the improvements herein provided for shall within five days after having been noti- fied of.their appointment proceed to appraise said lots and pieces of land lible to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said City without regard to buildings or improvements thereon and after making said appraisement shall return the -same to the Board of Commissioners at the first meeting of said Board after such appraisement shall have been completed and after said appraisement is returned to the Board of Commissioners said,Board of Commissioners shall designate a time,for holding of a special session of.sue.h.Board for the purpose of hear- ing any complaints that may be made as to the value of any lots or pieces .of land appraised as aforesaid, of -which spedIal session due notice shall be given in the official City paper, at which spe- cial session the Board of Commissioners may alter the valuation of any lot or piece of land if,in their opinion the same has been ap- praised too high or too low* Section 8. For the purpose of paying for the work and Im- provement in this ordinance provided for., the Board ..of .Commissioners are hereby authorizedanddirected to issue internal improvement bonds of the City of 6alina in an amount not to exceed the contract price of such imrpovement, and to run for a period of ten years and be payable in ten equal installments, together with interest not to ex- I I 1 I 1 1 1 Beed five per cent per.annum, which bonds shall,be made payable at the fiscal agency of,the State of.Kansas; and for the purpose of paying principal and interest on said bonds -as they severally become due and payable the Board of �Qommis.sioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such.improvement, and the appoittionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvement.' Such . assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district, and shall state the number of annual inst7&llments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time as other taxes are to be certified, certify to the County Clerk of.Saline County, Kansas, a full list of all property liable for such work and improve- ment together with the respective amounts due on each of said tracts pieces and parcels of land, which amount shall include the annual installment and interest and all unpaid balances for one year at the rate of six per cent per annum, and such amounts so certified shall be collected as other taxes are collected. Provided, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys as well as where the improvement is through or adjacent to property of the City for which the City would be liable, the assessments shall be made against all taxable property in the City; and paid by the City at large* Section 9. Section 4, That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board Of Commissioners may advertise by advertisement published in the official city paper of the City of Salina for three consecutive days for the receipt of sealed proposals for the paving of said street with the different kinds of paving mat- erial named and specified in the preceding section hereof and for the excavating and grading of said street to the established grade 'thereof as herei. provided for; and after the reveipt of such proposals the Board of Commissioners ha 1_ lect from the different kinds of street paving Amok mat er ial* Ewth which said street ought in their judg- ment to be paved and said Board of Commissioners may and are hereby authorized to let contracts for the grading and excavating of Said street toy thy;' lowest responsible bidder thereforand for the paving of said street with the materials so selected to the lowest responsible bidder# therefor, as determined by said Board of Commissioners for the kind and character of paving which shall be determined upon by said Board of Commissioners and for such excavating and grading; said Board of Commissioners reserve the right to reject any and all bids. Section Five. That for Wach excavating and grading special assessments shall be made for,,full cost thereof on all lots and pieces of land to the ovoter of the block on either side of the street for the distance to be improved according to the appraised value Of said lots or pieces of land without regard to buildings or improvements thereon.said appraisement to be made in the manner as hereinafter pro- vided.for. The entire distance to be graded shall constitute one grad- ing district. Section Six. That for such paving special assessments shall be made for the fall cost thereof on each block separately, on all lots or pieces of land to the center of the block on either side of the street for the distance to be improved. Section Seven, After the passage and publication of this ordin- ance the Board Of Commissioner shall appoint three disinterested app- raisers, householders, who after having taken an oath to make a true and impartial appraisemtnt of all lots and pieces of land liable to assessment and taxation for the cost ofj,improvementtherein provided for shall within five days after having been notified of their appointment -4 - proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commiss- ioners of said city without regard tobuildingsor improvements thereon and after making said appraisement shall return the same to the Board of Commissioners at the first meeting of said Board after such appraise- ment shall have been completed and after said appraisement is returned to the Board of Commissioners said Board of Commissioners shall desig- nate a time for holding of a special session of such Board for the, par - pose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid ,,of which special session due notice shall be given in the Official city paper at which special session the Board of 'Commissioners may alter the valuation of any lot or piece of land if in their opinion the same has been appraised too high or too low.
