2433 Improving 9th StreetORDINANCE NO;: 2433- (Published_in the Sa.l.ina_E_v_eriing Jour_na.l_Januar_y_,Z 1.922_) An Ordinance providing for the excavating, grading,, paving, curbing and guttering of Ninth Street in -the city of Salina, Kansas from the north line of ©'tis Avenue in said City to the south line of Euclid Avenue in said City, and providing for the cost thereof, how the same shall be assessed, and the manner of payment therefor. WHEREAS, by resolution 'duly adopted on the 13th day of June 1921 the Board of Commissi oner,s. of the. City of Salina, Kansas, have declared that they deem it necessary to excavate, grade, pave, curb and gutter Ninth Street in the City of Salina, Kansas, from the north line of Otis Avenue in said City to the south line of Euclid Avenue in said City, and WHEREAS said resolution was published for s x, a T p i d ys in he Salina Evening Journal, a daily newspaper published in -the City of Salina, the official City paper of said City, and WHEREAS, the majority of the.resident owners or property owning a majority in square feet of the lots or,real estate liable to taxation for the cost of said improvement did not within twenty days from the date of the last publication of such resolution file with the City Clerk'of said City thieir protest in writing against such improvement or the making thereof, THEREFORE., BE IT ORDAINED by the -Board of Commissionersof the City of Salina, Kansas: Section l.That it is necessary and it is her•eby,ordered that Ninth Street in the City of Salina, Kansas, from the north line of Otis Avenue in said City to the south line of Euclid Avenue in said City be excagated and graded to the established grade thereof as established by ordinance of` the City of Salina, Kansas, provided that at the intersection of streets and alleys, said excavation and grading shall be carried to the lot line of the street so improved and that at such lot line the grade be made to conform to the estab- lished grade of such street or,alley if the same has been established. Section 2, That it is necessary and it is hereby ordered that Ninth Street in the City of Salina, Kansas, from the north line of Otis Avenue in said City to the south line of Euclid Avenue in said i City be curbed and guttered with such material as the Board of Com- missioners may hereafter designate and select as hereinafter provid- ed for according to the specifications of the City Engineer of said City hereinafter provided for,'and that at the intersections of streets and alleys said curbing and guttering shall be carried back to.the lot line of the street so improved. 1 1 1 1 1 1 1 1 Section 3. That it is necessary and it is hereby ordered that Ninth Street in the City of Salina, Kansas from the north line of Otis Avenue in said City to the south line of Euclid Avenue in said City be paved with 'such material as the Board of Commissioners may hereafter designate and select as.hereinafter provided for according to the specifications of the City Engineer of said City hereinafter provided for, and that at the intersections of streets and alleys said paving shall be carried back to the lot line of the street so improved. Said street shall be paved for a width of thirty-three (33) feet ex- cluding curb and gutter on each side of said street and excluding ten (10) feet parking in the center of said street which are herein provided for. Section 4. That it is necessa=ry and.hereby ordered that the park -way in the center cf Ninth Street.in the city of Salina, Kansas, from the north line of Otis Avenue to the south line of Euclid Avenue ins aid Oity be curbed with such materials as the Board of Commission- ers may hereafterdesignate and select as hereinafter provided for ac - cording to the specifications of the City Engineer of said City herein- after provided for. Section 5. For the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or beofre the 13th day of February, 1922, complete plans and specifications for. the guttering, curbing and pving-of said street with the following ma- terials: PAVING 1. 1. 3 -inch vertidq�l fiber plain wire.cut brick 5 -inch concrete base. Asphalt filler. 2. 2 -inch asphaltic concrete; 5 -itch concrete base. 3. Asphalt macadam (penetration) 22 inch wearing -surface. 6 inch macadam base. 4. One -course concrete 6 inches thick. CURBING AND GUTTERING ALONG SIDES OF STREET Combined curb and gutter; concrete From back of curb to paving line 30 ienhes; Curb to be 6 inches at top, 7 inches at bottom, 16 inches deep; Gutter to be 6 inches at curb, 7 inches at paving line. CURBING AROUND PARK WAY Curb concrete 6 inches at top, 7 inches at bottom, 16 inches deep. and that on or before the said last named date, said City Engineer shall submit to the Board of Commissioners, under oath, detailed estimates of the cost of such paving and of such curbing and guttering of said street with the different kinds of material mentioned herein and of the exca- vation and grading of said street. Section 6. That after'such plans and specifications shall have been made and prepared by the City Engineer and.filed with the City,Clerk as -aforesaid, the Board of Commissioners may advertise by advertisement published in the.official City paper of the City of Salina for three consecutive days for the _receipt of sealed pro- posals for curbing, gutteringand paving of said street•:with the different kinds -of materials.named and specified in the,preceding section hereof and for.the excavating and grading of said street to be established grade thereof as hereinafter provided for; and after the receipt of•such proposals; the Board of Commissioners shall se- lect from the different kinds of street paving material the kind with which said street ought in their judgment to be paved and said Board of Commissioners may and are hereby authorized to let contracts for the grading and;.e:xcavating, of said street„to the low- est responsible bidder therefor, and for the curbing and guttering of said street, including said parkway, with the materials so se- lected and for the paving of said street.with the materials so se- lected to the lowest responsible..bidder.s therefor, as determined by said Board of Commissioners, for the kind and character of curbing, guttering and paving,which shall be determined upon by said Board Of Commissioners and for such';excavat.ing and grdding; said Board of Commissioners reserve the right to reject_any and all bids. Section 7. That for such excavating and grading special ass- essments shall be made for -the full cost thereof on -all lots and pieces of land to the center of the block on either side of the street for the distance to be+'improved according to the.appraised value of said lots or pieces of land without regard to buildings or improvements thereon, said,appraisement to.be made in the manner as hereinafter provided for. The entire distance to be graded shall. constitute one grading district. Section 8. That for such curbing, guttering and paving special assessments shall be made for!'the full cost thereof on each block separately, on all lots or pieces of land to the center of the block on either side of the street, according to the appraised value thereof without regard to thebuildings or improvements thereon, for the distanc-e to be improved. Section 9.After the passage and publieation.of this ordinance the Board of Commissioners shall appoint three disinterested apprais- ers, householders, who after having taken an oath to make a true and impartial appraisement of ,,all lots and pieces of -land liable to assessment and taxation for the cost of the improvements herein pro - I 1 I (')g' b rte! � i vided for shall within five days after having been notified of their appointment proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be'designated by the Board of Commissioners of said City, without regard to buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners,at the first meeting of said Board after such appraisement shall have been completed, and after said appraisement is returned to�the Board of Commissioners said Board of Pommissi overs , shall designate a time for holding of a spe- cial session of such Board for the purpose of hearing any complaints that may be made as to the Alue of any lots or�pieces of land ap- praised as aforesaid, of which special session due notice shall be given ih the official City paper, at'whcih spsecial session the Board of Commissioners may alter the valuation of any. -lot or piece of land if in their opinion the same has been appraised too high or too low. Section 10. For the purpose of a paying for the work and im- provement -in this ordinance.provided for the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the ,C-,ty of .Salina in an a_ -mount not to exceed the contract price of such -improvement., and to run for a period of ten years and be payablein ten equal installments, together with the interest not to exceed five per annum, which bonds shall btemade payable at the. fiscal agency, of" the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such im- provements special assessments covering the coet of such imrpvoements and the apportionment therein contained shall hold good for all the. installments that are to be collected from the specific property charteable with said improvement. Sufh assessment and Ppportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time taxes are to be certified,.certify to the County Clerk of `'aline County, Kansas, a full list of all property liable for such im rk and improvement, together with the respective amounts due on each of said tracts, -pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of six per cent per annum and such amounts so certified shall be collected as other taxes are collected; Provided that for the purpose of defraying the cost of improving the intersections and areas formed by the cro.ssing.of streets and.alleys.-as well as where the improvement.is through or adjacent to property of the City, for which the.City would be liable, the assessment shall be made against all taxable property in the*City and paid by the City at large, Section 11.
