WHEREAS, by resolution duly Adopted onthe-lOth day of May, 1921, the Board of Commissioners of the city of Salina, Kan- sas., have declared that they deem it necessary to ekeavate,, grade., pave., curb and gutter Bond Street in the city of Salina, Kansas, from the west line of Highland Avenue-ih said City to the east line of, -Ninth Street in said..City, and - WHEREAS,, said resolution was published for six days in The Salina Evening Journal, a daily newspaper published in the City of Salina., the official City paper of said City., and WHEREAS., the majority of the resident.owners of property owning a majority in square feet of the lots or real estate lia- ble to tad ation for the cost of said'improvements.did not with- in twenty days from the date of the last publication of such re- solution file with the City Clere of said City their protest in writing against such improvements 6V the.making thereof, Therefore, BE IT ORDAINED by the Board of Commissioners of the City of Sali- na., Kansas# Section 1. That it is necessary and i t is hereby ordered that Bond Street in the city of Sal ina, Kansas., from the west line of Highland Avenue in -said City.tothe east.line of Ninth ,Street in said City be excavated and graded to the.establi.shed grade thereof as established by ordinance of the City of Salina*,, Kansas, ,provided that at the intersections of streets and alleys., said excavation and grading shall be carried to the. lot line of the street so improved and that at such lot line the grade be made to conform to the established grade of such street or alley if the same has been established. Section 2.That it is necessary and it is hereby ordered -that Bond Street in the City of alina., Kansas, from the west lineofHighland Avenue in said City to` the east line of Ninth Street in said City be curbed and guttered with such material as the Board,of Commissioners may hereafter designate and select as hereinafter provided for, According to the specifications of the City Engineer of said City hereinafter provided for, and that at the intersections of streets and alleys said curbing and gutter - ing be carried back to the lot line of the street so improved. 1 I I I I I Section 3. That it is necessary and itis hereby ordered that Bond Street in the city of Salina, Kansas, from the west line of Highland Avenue in said City to the,east-line of Ninth Street in said City bepavedwith such material as the Board of Commis- sioners may hereafter designate and select-as,hereinafter provided for, according to the specifications of the City Engineer of said .City hereinafter provided for, and that at the intersee,tions,of streets and alleys said paving be carried back to the lot line of the street to be improved. Said stret shall be paved for a width of thirty-six (36) feet excluding curb and gutter which are provid- ed for herein. Section 4. For the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on .or before the 13th day of February 1922, complete plans and speci- fications for the guttering, curbing and paving of said street with the following materials: PAVING 1. 3=inch Vertical fiber plain wire out brick; ,5 -inch concrete base;. Asphalt tiller. 2. 2 -inch Asphaltic Concrete; 5 -inch Concrete Base. 3. Asphalt macadam (penetration) 2-L inch wearing surface 2 6 -inch macadam base. 4'. One -course concrete 6 inches thick. CURBING AND GUTTERING Combined curb and.gutter; concrete. - From back of curb to paving line 30 inches. Curb to be 6.inches top, 7 inches bottom, 16 inches deep; Gu'tter to be 6 inches at curb., 7 inches at paving line; and that on or before said last named date said City Engineer shall submit to the Board of Commissioners, under oath, detailed estimate: of the cost of such paving and of such curbing and guttering of said street with the different kinds of material herein mentioned and of the excayatIon and grading df said street. Section 5. That after such plans and specifications shall have been' made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advert Ise by advertisement published in the official City paper of the City of Salina for three consecutive days for the receipt of sealed proposals for the curbing,, guttering and paving of said street with the different kinds of material named and specified in the preceding section hereof and for the,excavating and grad - Ing of said stret to the established grade thereof as herein pro- vided for; and after the receipt of such proposals.the-Board of Commissioners shall select from the different.kinds-.of street paving material the kind with which said street ought In their judgement to be paved and -said Board of.Commissioners.may and are hereby authorized to let contracts for the grading and excavating of said street to the-loviest responsible bidder therefor and for the curbing and guttering of said..street with the materials so selected, and for the paving of said street with the materials so selected, to the lowest responsible bidders thereforasdetermined by said Board of Commissioners,, for the kind and,chardeter of curbing, guttering and paving which shall be determined upon by said Board'of.Commissioners and for such excavating,and grading; said board of Commissioners reserve the right to reject any and all bids* Section 6. That for such excavating and grading.special assessments shall be made for the full cost.thereof on.all lots and pieces,of-land to the center of the block on6either side of the street for the distance to be.improved according -to the appraised value of said lots or pieces of land without regard to buildings or improvements thereon said appraisement to be made in the manner as hereinafter provided for. The entire distance to be graded shall constitute one grading district. Section 7. That for such curbing, guttering and paving special assessments shall be made for the full cost thereof on each block separately,. on all lots or pieces of land to the center of the block on either side.of,the street according to the appraised value thereof without regard,to the buildings or improvements thereon for the .distance to be ii#p3:,oved-. Section S. After the passage and publication -of this ord- inance the Board of Commissioners shall appoint three.disinterest- ed appraisers., householders, who after having taken -an oath to make a true and impartial appraisement of.all,lots and,pieces of land liable to assessment and taxation for -the cost of the.improvements herein provided for shall within five days after,having been noti- fied of their appointment proceed to appraise said lots and pieces of land liable.to assessment and taxation as aforesaid, 'as may be designated by.the Board of Commissioners of said -City, without re- gard to buildings or improvem.ents.thereon.and.after making said' appraisement.shall return the same to the Board of Commissioners at.the first meeting of said Board after -such appraisemeht shall haVe been completed, and after said appraisement is returned to I I I 1 I I I I 1 to the Board of,Commissioners-s-aid Board of,Commissioners shall designate a time -.for ho-lding-a specialr` session of such Board for the purpose of hearing any-compIdints that may be made as to the value of any lot or pieces of land appraised as aforesaid, of which special session due notice shall be given in the official City paper.'at,,which special -session the Board of Commissiones may alter the valuation of any lot or piece of land if in their opinion the same has been appraised toohigh or too low. Section 9. For, the purpose of payingforthe work and im- provement in this ordinance provided for the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract pride of such improvements, and to run -for a period of ten years and be payable in ten equal installments.,'together with interest not to exceed five percent per 'annum, 'which bonds shall be made payable -at the fiscal agency of the State,of Kansas; and for the purpose of I paying principal and interest on 'said bonds as they sev- erally become due and payable the Board of Commissioners shall ap- portion land assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering thecost of such improvements., and the apportionment therein con- tained shall hold good for all the installments -that are to be collected from the specific property chargeable with said improve- ments. -Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; ted; and there- after the City Clerk shall -annually, at the same time as other taxes are to be certified,, 'certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improve - ­�- I j,03 ment., together with the respective amounts due'on each of said tracts., pieces and parcels of land., which amount shallAnclude the annul installments and interest On all unpaid balances for one.year at. the rate of six per cent per annum and such amounts nts so certified shall becollected _as ,_other .taxes .are --C-O.11ected; Provided., that for the purpose of defraying.the.cost of improving the intersections and areas formed by the crossing of streets and alleys as well as where the improvement is-through-.or.adjacent topropertyof the City for which the City would be liable, the assessment shall be made against all taxable property of the City, and paid by the City at large. Section 10. This ordinance shall take effect and be in force from and after its publication once in.the official City paper-.
