An Ordinance providing for the excavating, grading, paving, curb-
ing and. guttering of Ohio Street iri the City of Salina,
Kansas, from.the north.line of Iron avenue in said City,
to the south-line`of.-A:sh.Street in said City and pro-
viding.for the cost..thereof, how the -same shall be
assessed, and.the-manner of payment'therefor.
WHEREAS,`by,resolution duly adopted on the 9th day of May
11.31121;, the Board of Commissioners of the City of Salina, Kansas,
have declared that they deem it necessary to excavate, grade,
pave, curb' -and gutter Ohio Street in the City of Salina, Kansas,
from the north line .of .Iron Avenue in said Cuty to the south line
.of Ash Street in said City, and
WHEREAS, said resolution was published for six days in
The Salina Evening Journal, a daily newspaper published in the
City of Salina, the official C3 typ _iper -of said City, and
WHEREAS the majority.of'the resident owners of property
owning a majority in square feet of the lots'or real estate liable
to taxation for the cost of said improvement did not within twen-
ty days from the date of the last publication of such resolution
file with the City Clerk of said City their protest in wirting
against such improvement or*the making thereof, therefor,
BE IT ORDAINED by the Board of Commissioners of the City of SalinEy
Kansas
Section.l. That it is necessary an.d.it is hereby ordered
that Ohio Street in the City of Salina, Kansas, from the north
line of Iron Avenue in said City to the south line of Ash Street
In said City be excavated and graded-to.the established grade
thereof as established by.ordinance of the City of Salina, Kansas,
provided that at the intersections of streets and alleys, said
excavation and grading shall be carried to the lot ;ine of the
street so improved and that at such lot line the grade be made
to conform to the established;grade of such street or alley if
the'same has been established.
Section, 2. That it.is necessary and it is hereby ordered
that.Ohio Street in the city of Salina, Kansas, from the north
line of Iron Avenue in said City to. the south line of Ash Street
in said City be curbed and guttered with such material as the
Board of Commissioners may hereafter designate and select as here-
inafter provided for according to the specifications of the City
Engineer of said City hereinafter provided for, and that at the
intersections of streets and alleys said curbing and guttering
shall be carried to the lot lines of the street so improved.
Section That it is necessary and it is hereby ordered
that Ohio Street in the city of alina, Kansas from the north
line. of Iron Avenue in .said City to. the south line of Ash
Street in said City be paved with -such material As the Board
of Commissioners may her,eafter_.designate and select as here-
inafter'provided for according to the.specifications of the
City Engineer of said City hereinafter provided for, and that
at the.intersections of streets and alleys,said•paving shall
be carried back to the lot lines of"the street so improved.
Said street shall be paved for a width of"thirty-three (33)
feet excluding curb and. gutter Which are provided for herein.
Section 4.For.the'work and improvement herein provided
"for the City Engineer shall make and file with.the City Clerk
on or before the 13th day' -of February 1922 complete -plans and
specifications for the guttering, curbing and paving` of said
street with the following materials:
PAVING
1. 3 -inch vertical fiber plain wire out brick,
5 -inch concrete base;
Asphalt Filler.
2. 2 -inch asphaltic concrete;
5 -inch concrete base,
3. Asphalt macadam (penetration);
221 inch -wearing surface;
-6-inch macadam base.
4. One -course concrete 6 inches thick.
CURBING AND GUTTERING
Combined curb and gutter; concrete
From back of curb to paving line 30 inches;
curb to be 6 inches at top, 7 inches at bottom,
16 inches deep.
Gutter to be 6 inches at curb, 7 inches at paving
line.
and that on -or before the said last named date, said City
Engineer shall submit to the'Board of Commissioners, under oath,
detailed estimates of the cost of such paving and.of such curb
Ing and guttering'of said street with the different kinds of
material herein mentioned -and of the excavation and grading
of said street.
Section 5. That after such plans and specifications
shall have been made and prepared by the City Engineer and filed
with the City as aforesaid," the Board of Commissioners may* ad-
vertise f by advertisement published in the official City paper
of the City of Salina for three consecutive days for the re-
ceipt of sealed proposals for curbing, guttering and paving of

said street with the different kinds ofmaterial named and
specified in the preceding section hereof, and for the excavat-
ing and grading of said street to the established grade thereof
as herein provided for; and after the receipt.of such proposals
the Board of Commissioners shall select from the different kinds
of street paving material the kind with wick said street ought
in their judgment to be paved, and said.Board of Commissioners
may and are hereby authorized to let contracts for the grading
and excavating of said street to the lowest responsible bidder
therefor, and for the curbing and guttering of said street with
the materials so selected and for the paving of said street
.
with the materials so selected to thelowestresponsible bidders
therefor as determined by.said Board of Commissioners, for the
kind and.character of curbing, guttering and,paving which shall
be determined upon by Board of Commissioners -,and -for such exca-
vating and.gradirig; said Board of Commissioners reserve the right
to reject a##.

bids.
Section
6..
That
for such excavating and grading special
assessments shall be made for full cost thereof on all lots and
pieces of land, to the center of the block on either of the street
for the distance'to be improved according'to the appraised value
of said lots or pieces of -'land without regard to buildings or
improvements thereon, said appraisement to be: made in the manner
as hereinafter provided for. The entire distance to be'graded
shall constitute one grading district.
Section 7. That for such curbing., guttering and paving
special assessments shall be made.for the full cost thereof on
each block separately., on all lots or pieces -of land to the center
of the block on either side of the street according to the ap-
praised value thereof without regard to buildings or.improvements
thereon, for the distance, to be improved.
Section 8. After the passage and publication of this
ordinance the Board of—Gommissioners shall appoint three disinter-
ested appraisers., householders., who after having, taken,an oath
to make a true and Impartial appraisement,of all lots and pieces
of land liable to assessment and taxation for the cost of the
improvements herein provided for, shall within five days after
having been notified of their appointment proceed -to appraise said
lots and pieces of land liable to assessment and taxation as afore.
said., as may be designated by the Board of.Commissioners of said
City without regard to buildings or improvementsthereon
and after making said appraisement shall return, -the same to
the Board of Commissioners at the 'first meeting -of said Board
after such appraisement shall have been completed, and after
saia appraisement is returned to the Board of Commissioners
said Board of Commissioners shall designate a time for holding
of a special session of su.:h Board for the purpose ' of hearing
any complaints that may be made as to the value of any lots
or pieces of land appraised as aforesaid, of .which special
session due notice shall be given in the official.City paper,
at which special session.the Boa rd.of Commissioners may alter
the valuation of any lot or piecee of land if in.their opinion
the same has been appraised too high or too low..
Section 9. For the purpose of paying for the work and
improvement provided for in -this ordina.nee,the Board of Com-
missioners are hereby authorized and directed to. -issue inter-
nal improvement bonds of the City of ''alina in an amount not
to exceed the contract price of such improvement, and to run
for a period of ten years and be payable in ten installments,
together with the interest not to exceed 5 per cent per annum,
which bonds shall be made payable at the fiscal agency of the
State of Kansas; and for the purpose of paying principal and
interest on'said bonds as they severally become due and paya-
ble the Board of Commissioners shall apportion .and assess
against the'lots and pieces,of land within the taxing district of
such improvements, special assessments covering the cost of
such improvements, and the apportionment therein-:,ocontained
shall hodl good.for all the installments that are,to be col-
lected from the specific property chargeable with said. improve-
ment. Such,assessment and apportionment ordinance shall contain
the total amount.of tax apportioned to each _tract, piece and
parcel.of land within-the..taxing..distriet and shall state the
number...of annual instzllments..._in..whi.ch.._.such...tax. is to .be col-
lected; and thereafter..._the..- City Clerk shall. annually, at the
same time taxes are to be certified, certify to the County
Clerk of ~aline County, Kansas, a full list of all property
t liable for such work and improvement, together with the respect-
ive amaunts due on each.,of said tracts, pieces and parcels of
land, which amounts shall include the annual installments and
interest on.all unpaid balances for one ,year at the rate of

six per cent per annum and such amounts so certified shall be col-
lected as other taxes are' collected* Provided
that for the purpose
of defraying the cost of improving the intersections and areas
formed by the crossing of streets and alleys as well as where the
improvement is through or adjacent to property of the City., for
which the City would be a.liable the assessment shall be made aga'it'l
all taxable property in the City and paid by the City at large.
.Section 10. This ordinance shall take effect and be in force
from and after it's publication once in the official City paper.

City Clerk as aforesaid, the Board of Oommissioners may advertise by
advertisement published in the official city paper of the Aty of Salina
for three consecutive day a for the receipt of sealed proposals for ,
c.urbing, guttering end paving of said street with the different kinds of
material named and specifiXed in the preceding Section hereof,,and for
the excavating and grading of said street to the established grade
thereof as herein eV. -At- provided for; and after the receipt of sudh pro-
posals the Board of Commissioners shall select from. the different kinds
of street paving material the kind with which said street ought in their
judgment ,to be paved, and said i5o2rd of Uommissioners may and are hereby
authorized to let contracts for the grading and excavating of said street
to the lowest responsible bidder therefor, and for the curbing and ,
guttering of said street with the materials so selectedytc the lowest
and far the paving of said street with ifte materials so selected,
responsible bidders therefore. as determined by said Doard of Conmii':3sioners_.'
for the kind and character of curbing, guttering and paving v.,-hich shk1l
be determined upon by Board of commissioners and for such excavating

any and all bids.
Section Ax. That for such excavating and grading special
assessments shall be made for full cost thereof on all lots and pieces of
land.to the center of the block on either side of the street, for the
distance to be improved according to the appraised value of said lots or
pieces of land without regard to buildings or improvements thereon, said
appraisement to be made in the manner as hereinafter provided for. The
entire dista3me to be graded shall consit%ute one -grading district.
Section Seven. That for such curbing, guttering and
paving special assessment' -shall be made for the full cost thereof: --on each

Section Nine. For the purpose of paying for the work and
impr ovement A in this ordinance the Board of Commissioners are hereby
authorized. and directed to issue internal improvement bonds of the City
of Selina in an amount not to exceed the contract price %QVI&P=t ofAAAtW

installments, together with the interest not to exceed per cent
per annu.3p, which bonds shall be made payable at the fiscal agency of
the State of Kansa*; and for the purpose of paying, principal and interest
on said bonds as they severally become due andpayable the Board of
Commissioners shall apportion and assess against the lots and pieces of

coveritg the cost of such improvements) and the apportionment therein
contained shall hold good for all the installments that are to be
collected from the specific property chargeable with slid improvement.
Such assessment and apportionment ordinance shall contain the total
a=unt of tax apportioned to each tract, piece and parcel of land within
the taxing, district and si-p-11 state the number of annual installments in
which such tax is to be oallected; and thereafter the City Clerk shall
annually, at the Same time taxes are to be certified, certify to the
County Clerk of Saline County, Kansas, a full list of all property
liable for such work and improvement, together with the respective
a=mts due cn each of said tracts, piece -band parcels of land, which amounts
shall include the arcual installments and interest on all unpaid
balances for on e year at the rate of per cent per annum and such
a=unts sc certified shall be collected as other taxes are collected;
Provided, that for the purpose of defraying the cost of improving 'the �:
